At the Roses Store on Talbert Blvd, Lexington, NC, I was refused service since I was not wearing a face covering. NC has a face covering mandate currently in force, however, I am unable to wear a face covering due to physical and mental difficulties which are being treated by a Doctor. According to the State Mandate I would be exempt from the Face Covering requirement.
2.4. Exceptions. This executive order does not require face coverings for - and a face covering does not need to be worn by - a worker or Guest who:
a. Should not wear a face covering due to any medical or behavioral condition or disability (including, but not limited to, any person who has trouble breathing, or is unconscious or incapacitated, or is otherwise unable to put on or remove the face covering without assistance);
Therefore, I feel that I was discriminated against under The Americans with Disabilities Act of 1990 or ADA.
If I cannot enter the store to shop, without a Face Covering, then other reasonable accommodation should be made, such as ordering online for curbside pickup.
This could have all been avoided if the store managers were trained in proper adherence to the federal laws regarding disabled persons such as myself.
Needless to say, I will never set foot in a Roses Store again, in the future.
