October 2024, I signed a contract to purchase a home from Toll Brothers in Georgia.
That was a very exciting time for me as I embarked in a new chapter of my life.
We paid the earnest deposit and provided a pre approval letter to the Sales office.
Within two weeks after signing the contract, I requested to terminate contract. My lender denied the loan. Per the contract, I had 45 days to terminate based on lender approval.
I was very upset with this outcome and hurt, so I contact Toll Brothers (the Director of Sales) about the denial of the loan, she said that she "would work with me" as the time grows nearer. I asked if they could remove the basement price from the contract to lower the price (as indicated on the contract, #2), but she told me that she could not do that. As the last resort, the contract says that the seller will offer a refund of the deposit if a loan is not secured.
Not only one denial letter was written, but I sought out funding from other companies, and received denial letters from them as well.
Not only this was the worse customer experience I have experienced from a company, but all of the employees have misled me, along with not showing any empathy. I feel that they back their own employees instead of following their contract terms.
I am asking for my deposit back. This is a lot of money for me and it hurts even more that it is making their pockets larger.
Desired outcome: I would like for my deposit returned to me.
