Santander consumer usa is a misleading and fraudlent company and harasses me daily with phone calls.
In feb. 2011, santander represntative called me reagrding my late jan.2011 payment. I told her I had just mailed the payment on feb 7th, same day. I explained that I was currently unempoyed and lving on a fixed income from my pension. I also told her I had asked for a deferment in december and was told that santander consumer usa does not do that. She than informed me that was untrue and that I could defer my jan.2011 payment and therefore the payment I just sent in would count towards feb.2011 and my account would be caught up and my next car not would not be due until the regular march 15th payment. I received a call in late feb. Regarding my late payment for feb. I informed the represnentative of my previous converstaion about a deferment and that I was told I was caught up. I insisted he check the notes on the account, he told me he see's that the deferment request was submitted but had been denied. I was shocked, I askd him why I was denied and that the last representative gave me the impression that it was assured. He told me that I had been denied because I was not eligible and the last representative does not have the authority to approve deferments. I asked him, what kind of notification I should have received telling me that it was denied and he said "none". Therefore I would not received any notice that my account was considered to be still be past due or that I did not meet the deferement criteria because I was not 60-90 days past due. Santander consumer usa never responded to my written letter of concern about this matter which was sent via of cdertified mail and signed for by a gini moore. I get harassing calls 3-4 daily from santander consumer usa, yet no response to my written compliant/ question of their practice

PAY your BILLS and stop crying... santander does deferements to help but they never are mandatory and santander can do what they will... if you have missed your payment it is YOUR duty to get caught up... Thats according to the contract you signed. Be lucky they didnt ask for the full balance of the loan after the first time you were late! They have the right to do that as well
