A large percentage of new homeowners in this community were never informed that their property was located within a mandatory Homeowners Association (HOA). It is unlawful to sell a home that is part of a mandatory HOA without providing full and proper disclosure during the required disclosure period.
At no point prior to or during closing were HOA documents or disclosures presented, explained, or signed by the affected homeowners. One to two years after purchase, residents began receiving unexpected invoices that included late fees, attorney fees, and interest charges. Many residents were further threatened with liens or foreclosure for nonpayment of dues they were never informed about.
We, the homeowners, respectfully request a formal investigation into:
1. FirstService Residential for failure to properly disclose mandatory HOA membership and for unfair collection practices.
2. Hunt Communities for contracting and authorizing FirstService Residential to manage the community without ensuring proper disclosure to buyers.
We further request that homeowners who were never informed or who never signed any HOA related documents NOT BE BOUND TO THIS MANDATORY HOA, as such enforcement constitutes an illegal and unethical imposition.
