FSR IS NOT following the laws that are in place and there is NO help to stop them!

They send people to their attorney without properly informing a resident that they have a past due balance or late fees they have not paid.

They are required to send a certified letter at the very least. They charge over $30 for certified letters that they DO NOT send and this has been confirmed by an employee. They do not apply payments to past due balances, and they do not have past due balances on the statements or on the website. They will not discuss the issue claiming they can not talk about it once it has been sent to the attorney. The attorney represents FSR but can not produce a single invoice or statement sent to FSR informing them of the outrageous fees they are charging for work they are not doing and on top of that they do not confirm the owners name, address, mortgage etc. I was charged thousands of dollars for letters they sent to the wrong person, the wrong address and the wrong mortgage company most of which were sent back to the attorney according to the tracking numbers provided by the attorney. They are also suing people for late fees and other fees that are not HOA dues. They are not certified thru TREC and legally cannot collect extra fees all according to the laws that are in place to protect homeowners yet no one is following the law and there is no help to stop what they are doing. I was harassed and told I had to pay $6000.00 for a remaining balance I had on my account for $200.00! YES $200.00 that I had no idea about. They even applied a payment I made to the wrong account. I have written the D.A. I have filed complaints and will continue to do so because they are doing this over and over again and because they threaten people they get paid out of sheer fear.

The law also states attorney's fees cannot be more than $2,000.00 but they are allowing them to basically charge anything they want. Why isn't FSR over seeing what the attorneys are doing?! There is so many unethical things they are getting away with and it is NOT OK! I am a single mother with 4 children and when I received a lawsuit out of the blue last year it sent me into a major depression. I had been paying my dues for 2 years never knowing they were sitting on a $200.00 remaining balance on my account allowing attorneys to charge crazy amounts of money for work they did not do! They even charged me for researching 2 owners when I am the only owner. They charged me for searching bankruptcy when they knew I had been paying my dues and the ladies in the office know my family. I have lived in this community for 15 years. I have had people reach out to me asking what to do and all I can do is send them the laws and encourage them to research and complain. FSR should be audited on a regular basis. They should not control the board members in our community who are supposed to look out for their residents but instead they pick and choose who they send to the attorney based on their relationship with the residents. I also researched to find when and where they discussed my case in particular to make that decision and it never took place. These people have too much power and are obviously benefiting in big ways knowing nothing is being done to stop them. I have now spent over $5,000.00 so my home would not be foreclosed on over a $200 late fee from 2020! I could go on and on about many other issues. For example they do not send out info about mtgs until a few days before, when the law says it must be 30 days. They schedule the meetings on weekdays at 9a.m. or 4p.m. therefore in order for residents to attend they would actually have to take off work. These people are SCAMMERS to say the least and there should be accessible help for people who have to go through hell to save their home!

Claimed loss: $5,000.00 and months of turmoil

Desired outcome: Class Action Law Suit
