We are supposed to be done with our Auto Loan this March 2024 but because of Bayanihan 1 our loan was extended to June 2024. There was no email or sms message regarding the Bayanihan 1 they just decided to stop debiting our account. Eversince we applied for this loan and availed for the Auto Debit facility we always made sure that there is money in the bank before the due date every month and even during the Bayanihan 1. We were just shocked that 1 day a collection agent showed up at our doorstep. We checked our account and there were like 5 months worth of payment that they did not deduct so we are very furious. How can they accused us of breaching the contract when they are the one who did not fullfill their obligation to auto debit. We ended up calling customer service and ask if they will advice us to just terminate auto debit and just do OTC payment every month which they said that is not necessary. Yesterday when my wife went to visit a branch that handles the loans here in Cebu for the million of times already they told us that the SOA is still not available and they can only give us the payment history which was just rubbish and very hard to follow. Whie she was driving home from the bank a collection agent called and told her that the SOA has been emailed by him not even caring that she was driving and keep on asking her to check the emailed SOA. This really show that some people in the bank has direct contact with the collection agent which is funny enough that when you try to bring up the issue about collection agents in the bank they have a hard time acknowledging them. Then a woman claiming to be from the legal department called telling all BS. When we checked the SOA from the collection agent it was really big shocked they want us to pay 430K+ when we only have 4 months left on our Auto Loan that has a 35K monthly.

We have been looking for legal remedies and I already looked into filing a complain to BSP. I also saw a court case in which a client won a case against EastWest Bank where he sue them using Data Privacy Act for using a collection agency to harass him

I just want a fair resolution of this issue but EastWest Bank has not given us any avenue for our side to be heard. This is really frustrating and stressful.

Same thin happened to me tried to talk to the through their autoloans collection hotline and they always inform me that a loan officer is handling the account but could not give the number of this loan officer they will always inform you that they will call within 24 hopurs. Not sure what they are hiding as if none of them want to discuss the details of this bayanihan act and the payment holiday. Just want to be done with it and pay them but still as if there is a protocol to insure that autoloans client of eastwest bank are left clueless and passed around without any real action. I am to looking at legal action againt them hope to get update on you thanks.
