Seller is in breach of contract cuz the biz is closed and charged Buyer $500 to end the contract. We signed up for martial arts classes at Victory MA on 6***. We signed the contract on 1/31 for 12 months and paid $2,800 in total. They charged us $250 per month with a $50 down payment. The contract says in article 6 that the school can close and cancel classes without notice for holidays, special events, and maintenance, but it shouldn't affect our payments. But since mid-March, the Governor of Nevada closed the facility, so the Seller broke the contract by not providing in-person martial arts instruction for more than 5 weeks. They tried to do virtual classes, but only by talking, not doing any physical stuff like we agreed. When we tried to end the contract, they charged us an extra $50 for the courses we already paid for from January till now. They also made us pay for an extra month of classes at $300, so we had to pay a total of $500 to end the contract without any penalties or damage to our credit. We paid the $500 just to protect our credit, not because we agreed to their termination conditions. We don't want our money back for the virtual classes, but we do want a refund for the $500 termination fee they charged us when they couldn't fulfill the contract.
