Lobel Financial - Violation of fair debt collection act

Made arrangements for two payments. One via phone and one as a post dated check two weeks thereafter to be mailed in. Both checks processed on one date prior to the actual post date and the larger of the two bounced in my account days later my vehicle was being repoed. They violated Federal laws under the Fair Debt Collection Act and they don't seem to care. They will not take responsibility for their accounting issues. They scam people into second chance loans and screw them over any chance they get

The original problem is, you bought a vehicle that you could not pay for. "Second chance" loan? That means you are a repeat offender. They trusted you, tried to help you, but you cheated them. When will you take responsibility for your issues?

You sent a check and it bounced... It is against the law to write a check on an account that funds are not available on... That said, how can you claim they broke the law if you also broke the law...
"Section 3-104(2)(b) of the UCC, defines a check as a draft drawn on a bank and payable on demand."

In addition, the Criminal Penalties for writing a bad check in New Mexico for first offence is Up to $1000 fine or 30 days in jail, or both. If you have done this before, you could face One to 3 years in jail, or up to $1, 000, or both.

Now, you said you post dated the check and that has additional penalties since a check is a PAYABLE ON DEMAND instrument.
