IRS off set my tax refund of more than $2, 000.00 to pay my wife's debt, but at the time we were not even married and it isn't my debt! It has been over a year now sitting in another agency and I can't get it back. I have even sent in a copy of my marriage certificate/lic. and they still won't refund it. I am elderly and I desperately need these funds. Thank you. Mr. John R. Gay

Unfortunately for you, when you married your wife you also married her debt. Was this an IRS debt? If not you may need to make a serious complaint. The only entity that can offset that is the IRS itself. Only debts owed due to a judgment can be garnished from tax refund and then only in a few states. If the debt was a government backed student or other loan or an IRS debt, you ar SOL. Sorry.
