To Whom it May Concern,
The Carl’s Jr. advertising campaign depicting women, suggestively posed, in various stages of undress is in violation of the Arizona Criminal Code §13-3501 “Obscenity” which states that content is obscene and “Harmful to minors” if:
…that quality of any description or representation, in whatever form, of nudity, sexual activity, sexual conduct, sexual excitement, or sadomasochistic abuse, when both:
(a) To the average adult applying contemporary standards with respect to what is suitable for minors, it both:
(i) Appeals to the prurient interest, when taken as a whole. In order for an item as whole to found or intended to have an appeal to the prurient interest, it is not necessary that the item be successful in arousing or exciting any particular form of prurient interest either in the hypothetical average person, in a member of its intended group and probable recipient group…
(ii) Portrays the description or representation in a patently offensive way.
(b) Taken as a whole does not have any serious literary, artistic, political, or scientific value to minors.
If we are to apply these laws in spirit or word, the Carl’s Jr. advertisements are in violation of Arizona state obscenity laws and should be considered harmful to minors.
This said, WHY is no one doing anything to prevent minors from such exposure? These ads are aired on multiple networks and at all times of the day. They are offensive to women and children, and are clearly targeted for the adult, male pornography-watching “community”. If you search the internet, you will find thousands, if not tens of thousands, of complaints regarding the obscene nature of these ads. Obviously, the average adult applying contemporary standards is offended by these depictions. I want to know: Why is this form of criminal activity and obscenity being overlooked and taken as acceptable?!?
I would like to see someone enforce the obscenity laws that have been laid out by state law. Carls Jr. should be charged criminally.
Gabriela, the manager and Ana refused wouldn't let me use restroom before ordering. I like to wash my hands before I eat. my request is to be nice to customers.
