Royal Palm Vacations U S Mail & Wire Fraud

I commented on Don in SC and then realized that I probably should file a complaint myself.

I am informed that I have a federal claim against Royal Palm Vacations, also DBN Financial d/b/a Capital Financial.

Contact: U.S. Postal Service [protected].

Fraud must contain:

1. A false statement of a material fact
2. Knowledge by the defendant that the statement is untrue
3. Intent on the part of the defendant to deceive the alleged victum
4. Justifiable relieance by the alleged victum on the statement
5. Injury to the alleged victum as a result.

In other words, Royal Palms Vacations also DBN Financial d/b/a/ Capital Financial knowingly made statements that were not true. In our decision-maing process, we relied upon statements to be true. And we have all been scammed out of thousands of dollars, leaving us in a worse position than before the fraud. If they had told me that (a) dealing with RPPV would be problematic (b) we would have a low probability of obtaining rentals in the area that we wanted at the level desired and (c) they would come up with inappropriate offerings in areas remote from our requested search, we would have excused ourselves and gone home.

Fraud contains an element of "False Pretenses":
Royal Palm Vacations is a ficticious name. They falsely pretend to be operating in Reno, Nevada when, in fact, all business is being conducted in the Clearwater/Largo area. They give the address of an unoccupied office in Reno, NV. Correspondence comes with a return address of Reno, NV but closer examination reveals a 33771 (Largo, FL) postmark.

Mail Fraud requires deception through the US Mail; Wire Fraud requires the use of interstate telephone or electronic means such as the internet. If you received an invoice from Captial Financial, made a telephone call to [protected] or received an email from PRV et al, you qualify for a federal complaint. If you get any emails or mail from RPV et al, save the envelopes and print the emails.

If you are 55+ you are considered in a "vulnerable" category. If you are 65+, the fines, imprisonment and damages increase. Did I hear treble damages? A plaintiff may recover the money that was lost. All states allow Punitve Damages in addition to actuual damages. I seem to recall the the Fed is not deterred by bankrupcy either. They might pierce that veil and persue the participants until satisfaction.

Some employees (current and past) have the same name as people listed in the Florida Department of Corrections Inmate Releasse:

Lisa Johnson, DC No. 570785; out of custody 12/16/2003; offense history of illegal possion of credit card, utter instrument and grand theft.

Robert Norman, DC No. 027595; released from custody 10/16/2005; history of grand theft and possession of firearm by felon.

Angela Shaw (aka) Angela Snipes; DC No. 207766; released 03/30o/2008; history of grand theft, cocaine sale or possession.

Are they one in the same? Would RPV/DBN/Capital Financial be a good environment to invite poor judgement and mischief? I have not verified that the employees and inmates are one in the same. What a coincidence. Check it out for yourself. Please google all the info in order to verify.

Vulnreable in SC

I have filed a formal affidavit with Ed Lary of the Florida Office of the Attorney General, Economic Crimes [protected]. I intend to follow up my phone call to the US Postal Service with an on-line complaint as instructed by them. The state is persuing on a civil level, but the Feds will get your money back and put people in prison. I hope that I am not the only one complaining to the US Postal Service.

All ran out of Tampa Bay... (Largo, FL) actually.

For all of you Royal Palm members... there is NO office in Nevada... we were told to tell you that so you could not find where they were...

Google any of the above listed names, or look on ABC Action News of Tampa Bay... and search any of those above names... you will see big news reports of scams...

They never have any vacations available to you... if you place a request for vacation, they will respond "sorry, no avail" which means no availability... when they never even check. For airfare, we used the same websites that you at home do... travelocity, orbits, and expedia... then we would add a percentage to that price because we had to make some money too... So, all this company does is take your $3000.00 - $6000.00, and your ASC (Annual Service Charge). Then they sit there, and do nothing except to reply to you..."sorry no avail" and continue collecting your ASC every year...

Royal Palm Vacations They make it so hard to use their service to plan a vacation

Sorry to say I too fell pray to this scam, I have tries to plan 3 trips since I bought this scam 8/19/08. I have contact RPV and cancel my membership to no avail. You get the run around and quote the contract is nonrefundable and non cancel able. Thank God I purchased the lowest plan $4495.00 but only had them charge $2449.00 to my credit card. After talking to them on 11/18/08

The so called free cruise is also a joke. Just try to redeem it.

I called my bank since my membership was charged using Visa Debit card and file a dispute of the charge and immediately cancel that card so they could not charge any more to that card. My bank told me you have up to 120 days to file a dispute of a charge.The dispute can take up to 90 days to settle from what they tell me.

Today I filed BBB report and urge you all to do the same!

Today I spoke with Nevada Consumer affairs they are well aware of RPV and I filed a claim with them here.

The person I spoke to said an investigation was in progress, but could not give any details. She asked if I had any information that could be of help to include anything that I have found in my claim, any information is helpful.

Make sure to get the form for Reno NV and not the other one.

Today I spoke with SC Consumer Affairs and there was a complaint already filed against them. I also filed a complaint.

The person I talked to called the credit reporting agency Equifax and Experian it seems the 2 Major Creding Reporting Agency's do not even accept information from companies like RPV. She told me to not send another penny to them since it would not appear on a credit report. On my contract from RPV it does not have that you the consumer have the right to cancel this contract in 3-4 days if you choose, anywhere in writing in the papers that I signed. It IS A FEDERAL LAW THIS MUST APPEAR on all contracts to give you a way out of the contract. It is also SC LAW that this clause must appear. This is called the door to door policy.

If any one has any other info please contact me.

Please do not take this law I have only reported what I have found in my own experience so far in trying to get out of this SCAM.

I too fell for RPV's lies and want to help get them back in prison and get our money back! Thanks for your information. I was feeling a little down, because the BBB in Reno just closed by case when RPV refused to give a refund, which I knew they would.
I gave them $4200. at presentation on Sept. 26 in PA and another $250 for dues. I have been sending info to BBB of Nevada and Ed Lary in FL Attorney General Office. Will now pursue with US Postal Service. I have saved all emails and correspondence.
Would like to stay in touch on what occurs.

Royal Palm Vacations Travel Club

This company totally misrepresents itself in a presentation given to sign you up for a lifetime travel club. Promising 4-5 star resort vacation week-$550 locked in for life. A plan that is willable to your children. They don't deliver never have resort in area you want. No real discounts you can't get yourself on hotels.com, expedia, etc. Complimentary cruise is a scam also!

Royal Palm Vacations Ripoff - lies

Anyone wishing to file a complaint on this company should contact the Florida Attorney Generals Office. Thats where I sent mine. If enough people file maybe we can get something back from these crooks.
If you got screwed by the Certs travel company that offeres the travel awards you should file against them too.

Scammed for $4000 by RPV and CERTS, supposed to get free "minivacations" sent "deposit to CERTS, heard nothing.
Booked a hotel room on RPV website, same price as the hotel website plus a booking fee on RPV. I am writing to the PA and FL AG for an investigation and refund.

We also booked a vacation on US Airways website that was several hundred dollars cheaper than the exact same vacation on RPV. Is there anywhere else to complain ?

We too have been scammed out of $4, 450. We want our money back and would like to be part of any class action suit. They have offered us nothing but junk not where requested and not on dates requested. Say they have to wait for something to come in. We have been waiting for a month now. Long enough to see that this is a scam. Gifts were a hoax too.

Well I can tell you I signed up for RPV also and wrote my check to World Vacations which was deposited in an account for Imperial Incentives, Bank of America Clearwater, FL. So tell me they are not one in the same. This is the company offering the complimentary gift and giving the presentation for the travel club. If they can't get you to fall for there Travel Club the least they're hoping is get $199/per person for the cruise. Which is also a bogus deal to if you read their terms as Mr. Peaden, CEO of Certs stated. So which state are they in now and how many US citizens will be taken of their hard earned $$ before someone takes them out. Oh yea Mr. Peaden says he is CEO of Certs, Inc dba-Imperial Incentives, dba-World Vacations Destination, dba-Capital Financial Marketing, dba-Suncoast Vacations, dba-Suncoast Incentives LLC, dba-World Vacation Network, dba-travelservices USA, need I go on. Or is Nick Congleton or Donald W. Griffin CEO. Hmmm maybe the Attoney General Bill McCollum will find out.

I spoke with the representative in Reno( Elise). She wasvery abusive and told me that we had a contract. I told her we were canceling and asked to speake with someone other than her. She stated she was in charge. I ask her for her attorney's name so that our atty. could send our cancellation. She refused.
My wife and I would like to se thease people shut down.

Concerning Royal Palm Vacations, I am in the same boat as all of you, I did send a formal complaint to the Attorney General Of Florida, and am awaiting news. We have all been scammed, and none of us will get our money back, as there are more than one company involved, including Capital Financial, Suncoast vacations CERTS, and others. BEWARE: all they want is your money.
Please get in touch with the AG of Florida. We must stick together, perhaps a class action suit?
Any other ideas? I did send a complaint to the BBB of Florida as well.

Royal Palm Vacations Watch out

I totally agree with the other complaint. Asked for a refund and did not get one. Go to google maps and do a street view of their corporate headquarters. 316 California Ave, Reno, NV 89509, USA. Some how the whole company works in a mailbox at The Postal Depot! I am digging on this one some more.

RPV is also doing presentations in Texas. I went to a presentation in San Antonio invited by a company named "All Inclusive Excursions" another alias of RPV. I did not have the 3 day cancellation clause on my contract. I charged $3601.00 on American Express. I have never used the travel services because I read the complaints on the web. I have been disputing the charge with AmEX but RPV claims that I signed a "no cancellation" contract. I do have a contact person with RPV ( Arnulfo Vasquez) who never return calls and just refuses to give me a refund. Following is the address in Texas:

... I wish to say that I am sorry... I had no Idea this company that I worked for was like this. Please take this information and do what you have to do with it.

Royal Palm Vacations, Travel Services USA, United Vacation Network, Suncoast Vacations, Suncoast LLC, World Vacations, Imperial Incentives... and many more names... all the same company... many different lawsuits with Atty generals and the state of FL... All ran out of Tampa Bay... (Largo, FL) actually.

For all of you Royal Palm members... there is NO office in Nevada... we were told to tell you that so you could not find where they were...

Google any of the above listed names, or look on ABC Action News of Tampa Bay... and search any of those above names... you will see big news reports of scams...

They never have any vacations available to you... if you place a request for vacation, they will respond "sorry, no avail" which means no availability... when they never even check. For airfare, we used the same websites that you at home do... travelocity, orbits, and expedia... then we would add a percentage to that price because we had to make some money too... So, all this company does is take your $3000.00 - $6000.00, and your ASC (Annual Service Charge). Then they sit there, and do nothing except to reply to you..."sorry no avail" and continue collecting your ASC every year...

FYI: Christy Daniels is the Office Manager (she was in prison for a few years because she was running a fraudulent business before working for these companies... funny huh?!), Amanda is the office supervisor... and the owner of all those false and fraudulent businesses is... Nick Congleton.

To anyone who is a member of any one of those listed fraudulent companies, ... I highly suggest contacting the Florida Atty General, and the Nevada Atty General... good luck all...

There was nowhere in the contract from Royal Palm Vactions (RPV) that I had the right to cancel within 3-4 days.
I have yet to receive the gas rebate that I was promised for attending their meeting.
RPV is supposed to offer better prices than other travel agencies but
I priced out a cruise to Hawaii on Royal Palm Vacations and the exact same cruise with Princess Cruise lines. They both came back with the exact same price . We were told at our meeting on August 5, 2008, that we could expect savings up to 60 % and I received an e-mail on 11/25/08 from a RPV’s representative stated that they would beat any travel agencies amount by, at least, 10%.
Royal Palm Vacations is supposed to be located in Reno, Nevada but I discovered that it is not accredited with the Better Business Bureau there..

I filed a fraud complaint with the US Post Office. Has anyone had any luck getting their money back?

went to the presentation, did not purchase, they kept making us a better offer that we almost went for it, thankfully we didn't, just received my certificate to send in (with $199 per person) to book a cruise, no phone numbers, web address, don't think I should send it in? did anyone deal with imperial incentives for this cruise?

Wow I purchased a membership with this company and have been one hundred percent happy. The funny thing is if they cancelled you and agree to refund you then why are you complaining unless you are one of those people who have nothing better to do in life. And secondly the complaints are about the incentive for the presentation; does no one read anymore the incentive is not even from them it was from another company and the post card that everyone received just like me said that on it along with fees would apply; so why is everyone complaining about that; people who walk around this world thinking they should get something for free when it does not say free put a shame to the rest of us tax paying citizens who know it is a government law that to pay taxes. I have been so happy with this company and have booked a vacation in Aspen with my family this Christmas. If people would attempt to use them instead of just believing what they read they to would be happy.

They were running this same scam in Chattanooga two weekends ago at the Hilton Garden Inn. My wife and I bought into the scam and when I got home I decided to Google it and found all the people that were disappointed. Per my contract I called within 3 days to cancel and boy were they pissed. Luckily I paid in full with American Express so they are helping me out if Royal Palm doesn't give me the refund. RPV said they wouldn't refund my money till I sent them the "travel gift" which is basically a wooden box with a cheap travel guide in it. I sent it Fedex and when the package arrived in Reno, NV there was nobody at the business to accept the package. After I found that out I disputed the charge with AMEX and I'm going to let them handle it.

Man, did we get lucky. We went to the Seminar yesterday and asked if we could think it over during lunch. We were told yes, and to come back by 4:00 - we went back at 3:45 to pick up our free trip information and decline the offer but Royal Palms folks were packed up and gone. I was so ticked at the time but it made them look very suspicious. I hope nobody buys from them, they are typical salesman. I hope they have trouble sleeping at night.

ALSO WENT TO SEMINAR IN GREENVILLE NC BUT DID NOT BUY AND SENT IN FOR 3 DAYS AND 2 NIGHTS IN THE US AS OF AUGUST 21 2008 HAVE NOT HEARD A THING SO MAYBE EVERYONE IS RIGHT

Does anybody know if there is a way legally to stop making payments. We are still making payments on the package that we bought. I know that some have said there is no way to get our money back, but I wasn't sure if there was a way to just stop. Any help would be much appreciated.
