Two weeks ago I ordered a trial bottle of the acai berry and a trial bottle of the colon cleanse, 2 lots of 3.95 were debited from my credit card. I have just checked my online bank account to find that not one but two! Payments of £74.53 have been deducted! I have most certainly not agreed to any terms and conditions that let this absolute disgrace of a company take this money, luckily I noticed on the day this went out otherwise I would be incurring charges from my bank. I will be calling viv3 labs first thing monday morning (they are conveniently closed at weekends) and demanding an explanation and a refund of my cash. When ordering the free trial nowhere on the website does it have an option to agree to terms and conditions.

Do not buy this product, it is a scam and they will fleece you for all you have!

I will be contacting watchdog and msn regarding this as people need to know what this company is doing.

There is a way out.

I have also asked ViV3 for a refund after they have taken from my account almost 175 Euros.

I ordered two products for free trial and notice they have charged me for that.

Calling them for the first time, the lady was unpleasant telling me its my fault and that I should have read the TEC.

I wrote them consistently that I didnt agree to their TEC. that in the whole process of writing down your private details, they didnt refer me to the TEC and I didnt marked that I agree.

There is also reference to their cancellation policy that allow the client to cancel and receive a refund if not satisfied from the product or service.

At the end, they refunded me for the amount of 160 Euro, which is for me a loss of 20 Euros (including the delivery fees) but at least its not 180 EUROS.

I am smarter now, and will not do the same mistake again.

I have been trying to cancel this for over a month and they are still trying to take money from me. I have tried every way so far (post, email, terlephone) and as of yet nothing. I have just reported them to watchdog. hopefully something can be done about these guys

The problem that this company doesn, t come under just 1 name. I was caught by the same scam except it came under the name of PureLift Ultra, but they use the verry same scam.
I have made a fraud complaint through the police & am in touch with Trading Standards. I have also phoned Visa who said that due to the number of fraudulent complaints registered they are setting up an enquiry. Hope u get sorted.

i have same problem, no one answering, and my pre paid credit card has no fraud coverage so i have no recoursae for the 103.00 they took in two payments...i am looking for somkind of number and what does +44 in a phone number mean anyways? apparently i heard there is a n email address : support@viv3.com but havn't tried it yet, just saw it in this group, havn't had luck onfinding an actual web site... if you figure anything out let me know, lori

Hi All,

I am also a victim of these frauds. :(
placed my order on 26th June, received products on 10th Aug and was charged on 12th of august...

The website clearly says you need to cancel the account in 15days of TRIAL PERIOD but they charged in on the second day itself...

Also they told me the amount debited cannot be refunded...this is such a scam...
Also they didn't even send me a cancellation mail...

please you people can help me with this it would be highly appreciable... thanks

I have gotten back £200+ from them if they have taken your money so can you.

please read. i called them quoting the order numbers they gave me originally in an email and cancelled the accounts they stopped charging me, i then asked them to escalate the matter seein as they took the money without my consent. the lady said that i would receive an email, the email said the following :-

Dear Customer, Thank you very much for contacting our customer service at Viv3 Labs by phone. We would like to inform you that on 2009-07-13 you were charged for the shipping and handling cost on your free trial. The 15 days free trial starts from the day of the shipment of the order and implies that you have 15 days to test your order for free. As stated in the terms and conditions of the purchase that you accepted during the purchase process, if you do not cancel your account during the 15 days trial period, you will be charged for the product separately and thus the free trial converts into a regular subscription. We confirm that on 2009-07-30 you were charged for the product for the amount of (2x) 118.63 USD. We have now cancelled your account. This cancellation implies that our company will make no more charges and no more products will be shipped to you. Best regards, Viv3 Labs Customer Service Toll-free UK [protected] International Contact Number +44 [protected]

i then replied back saying that is not good enough and that i did not accept no terms and conditions and there was no box for me to tick i want my money back
their reply :-

As indicated in our previous communication to you, you have accepted the terms and conditions of the purchase, indicating that unless you cancel your account within the 15-day trial period you will be charged for the product, in addition to the shipping and handling charges. i replied back again saying that i have contacted my bank and they have started a claim for me to get my money back i have also left negative feedback about your company on many sites and that i demand that you give back my money

The same thing has happened to me I have been charged 149.32 and incurred 2x £22.00 pounds worth of bank charges as a result of each transaction. I did not recieve the 'free trial' pack and 5 weeks after the order received what I thought was the trial bottle only to find the invoice attatched - they took this money from me within 2 weeks of each other and I did not get a chance to cancel - I have sent numerous email - even spoke to someone called Cindy who assured me it has now been cancelled. Can I get anyone to answer me now - NO. I have sent threatening emails about reporting them and such and they just keep quoting the small print... so I have 1 bottle of life cleanse and almost £200 missing from my account. My bank - name begins with a B and there logo is a Pheonix... say they can not stop payments or cancel my card because I gave the details out on-line. The only option left to me is to close my account which I can't do until beginning of september when they have taken the charges for these transactions. So not only have I lost this money - I can't do anything to prevent it from happening again! I have never clicked on a pop-up before and I will not do so EVER AGAIN... Meanwhile S****Y emails will continue.. I am not letting this go - have decided that I will work out which consumer programme is best place to publicise this...

I understood it to be just a free trial for both Life Cleanse and Acai Berry and I only had to pay for postage GBP 3 or AUD$7.95 . The customer service advised it's a free trial for 15 days and because I didn't cancel within 15 days, they charged my visa AUD$152 each for the "free" 2 x trial bottles. Two weeks later they shipped another two bottles and charged my visa once again for $139 each without any consent. I asked the customer service in Viv3 whether I can send these back for a refund and he said "you can do whatever you please with those, Madam, it's yours and you paid for it already. Bye Madam" and hang up. I will notify my bank of this scam to reject further charges.
Viv3 is one BIG SCAM! So, I hope people will read this note and learn from other people's experience like mine

I agree with the above unfortunately I checked them on the internet too late and they have taken the money out of my account three times before I had noticed I have now cancelled my card and hopefully this will stop further payments being taken out. I have never bought anything over the internet before with my credit card and I will never do it again.
I am now going to send them a letter regarding the payments and as I deal with the police every week I shall be informing them to take further steps if they can.

Hello there I too ordered the free trial for both life cleanse (viv3 labs) and acai tablets which are supposed to work together. However unlike yourself did not realise until after 15 days i had to cancel. I have been charged in total (which is for two lots of tablets they sent) over two hundred and sixty pounds! I called and said the terms and conditions were not noticeable and it was not made clear the offer was subject to such terms and conditions. I spoke to them twice but feel was fobbed off and told it would be moved to high priority. I said I wanted to return 2nd shipment as not happy with product and did not want such an expensive product. I only ordered as they were supposed to be free trials. All contact is via email and i've been told would not receive any refund for life cleanse. Cm services for acai tablets let me return the 2nd shipment (55 pounds worth)
but still have to pay for 1st shipment. I simply cannot afford such horrendous charges i'm currently on maternity leave and have no spare cash. I eat healthily and exercise so only wanted tablets to combine these and was not expecting too much but think they're a complete waste of time and have no positive benefits whatsoever.

Hi guys, Im coming to join your club. I too have had the delight in finding today that my account has been debited by £74.47 twice! I feel such a fool as I normally am very careful about these things, but realise that I too cam be duped. I called Phytoscience Ltd and spoke to a lady who said that they were just "the warehouse" and didn't I check the small print. She also gave me a number but guess what/ Its no longer available. To be honest I didn't see anything in the small print, but then I know they can hide these things up quite well. I've called my bank and they have said that there is the chance that the company can go back in next month and take again, so I'm petrified as next month I've no salary as I'm starting up my own company. She advised that I change my whole bank account, but then its the hassles that go along with it. I've e-mailed Watchdog to see if they can do anything, so perhaps if any of you get the chance, you should do the same? The more back up we get perhaps we can stamp out these lousy people. Let's hope they get whats coming to them. Also, to all Scottish dupsters - e-mail Jane Barrie of The Sunday Mail, as she does The Judge page, and perhaps she can investiage them as they are based in Scotland? A bit of pressure from the national newspaper could get us our monies back? Keep me posted!

OK we've all been scamed by this ruthless lot.
Now I can't contact them...emailing is being returned.
So here in Australia WHO can we contact to firstly cancel any so-called orders ?
and have the money taken from our accounts refunded, as no product has been received and NO permission has been given for the money to be taken out except for the initial $1-
Isn't there some fraud squad that looks into these scams?

If I were you I would worry too...
These people and not scared of law, the office of trading standards or bad press.
Their aim is to to milk as much money as they can
They try to satisfy upset customers from time to time in order to prolong the life of their dirty operation.
Thats what it is!
And there is nobody to pursue...nobody to held responsible...
I searched Companies House and surprise surprise...
The company was set up by the incorporation agent in february this year. It has no directors as those who acted as company officers on incorporation resigned the same day...and I am rather certain...there is not even an official shareholder as of today...
another lesson for all of us here...

oh no I am really worried now! I like you only read the conditions after and when I rang up to cancel I was told I was going to be charged £3.95 anyway and the free product hadn't been shipped yet so I should wait 3days and call again- I called today and asked to cancel the order and was told that my details were now off their database but now after reading all of these complaints I'm not so sure.

OMG i have just relised that 2 amounts of $144.35 has been deducted from my bank account i didnt not no that i would be signing up for any ongoing deductions and i have not received any items i cant believe i have been scammed what are these tablets doing to my health if this is the case!

I've also been scammed, but my bank is not refunding me any money taken out of my account (to date £280) as I clicked on the terms and conditions. Apparently, this means I've agreed to have any money taken out at any time. My bank won't help me recover the money and when I managed to contact this scamming company they said they were totally entitled to my money and I should have read the T&C, they have now cancelled my agreement and have said no more money will be taken out of my account (a day later a further £75 was taken out again). I have cancelled my accounts with my bank and moved all my money to another bank, but the account that the company are taking money out of wont be shut (leaving a huge debit and getting bigger by the day as this company keeps taking money out).

I don't know what to do and no one is helping me with this.

I am from New Zealand and fell into the same trap, of applying for the free trial, no product received and then a huge payment deduction from my account of NZ $180. Yes I had to call their expensive toll number to get a refund, the first operator I got was extremely rude and kept saying it is too late, I can't get my money back even though I repeatedly said I didn't receive any goods, I asked to speak to a team leader, supervisor or manager and she wouldn't do it, she just said it's too late for a refund and hung up on me, by then I was absolutely p****ed and called back again I have to pay for this call and got a gentlemen who said he will put through a complaint, request a refund but then there is no guarantee, I do not like leaving things like this, is there anything else I can do, anyone else I can speak to that is not from that callcentre. I hate the fact that a company can do this to people and being in the UK there is a huge distance barrier that prevents you from walking into their store, I am so mad...but don't want it to end here.

This is a total scam. ### company with no scruples and where is the money going? I entered into a "Free Trial" a free trial that does not exists. If you read the small print opened product can't be returned. You supposedly can return the goods within 14 days, so how can you try it. The small print also asks you to give the product 3 months to take effect. Huh. These pills work out at £2.50 each, I will have mine analysed! As you enter your card details to cover the P & P the company are already preparing to deduct £75.60 from your account 14 days later for each product ordered. When you realise what has happened its too late even with full card protection. You have entered into a direct debit agreement. Help you say to your bank. The bank can do nothing even closing your account and cancelling the card does not stop this scam The bank can only assist you by writing to VIV3 and asking them to stop making withdrawals, they advise you also to call the company and write your own letter. Once this has all been done the company can still make withdrawals before the bank intervenes, these recent withdrawals can maybe claimed back but the first ones can't. Hopefully there is a company to claim against but in today's Daily Mirror 6/8/09 there is no such company! what are the banks doing for their clients. Why are HOTMAIL allowing this so called company advertise on their site with pop ups? I have been with my bank for almost 40 years and I am a very unhappy client.

I too have been sucked in with this scam, apparently if you do not cancel your account before the 15 day 'free' trial you then pay the full amount for the 'free' sample, and then they send you a second pack before you know it and get billed for a second lot! hopefully I have now cancelled this. The timing is very clever I don't have the time or the enregy to persue this but I hope some will!

Same thing has just happened to me. I cant believe it, i have lost over £120 to these people and their customer services are no use. They have apparently cancelled any future payments but had the pleasure in telling me that i wouldn't get my money back! They do not give a damn. I wish i had researched this stupid offer before i thought some quick fix would help me lose weight. The bloody things dont even work.

PLEASE DO NOT GO NEAR ANY COMPANY THAT OFFERS FREE TRIALS. SAVE YOUR MONEY FOR SOMETHING BETTER XXX

I kept on nagging at them, sending emais putting forward my case: that I DID cancel within the 15 day period. I threatened to take them to court, report them to the police, etc.
Finally, today they cracked. here is the email I got:

Dear Customer,

Thank you very much for contacting our customer service at Viv3 Labs.

As indicated in our previous communication to you, you have accepted the terms and conditions of the purchase, indicating that unless you cancel your account within the 15-day trial period you will be charged for the product, in addition to the shipping and handling charges.

However, as part of our customer care, we strive to provide excellent customer service and would therefore prefer to resolve this issue by granting you a refund for the amount of 118.63 USD.

We would like to confirm to you that we have reviewed your claim and issued the refund following your request. The amount of 118.63 USD was credited to your account today.

Please note that it normally takes up to 5 working days for the refunded money to appear in your account. However, depending on the banking policies it could take up to 15 days in exceptional cases.

Acai/Internal cleanse SCAMMMMMMMMMMMMMMMM!

I also found out the HARD way..

I sourced the internet & these products for days before deciding to order the 'free samples'.. it all looked legit... before I put my details to the order i even checked for any fine print to see if i was getting myself 'locked' into anything i may not be aware of OR want to be...

I didn't see anything on there, so i went ahead with the order ~ BIG MISTAKE!

I DID question the postage chargesas they differed from what was stated AND got a response from the company VIA email TWICE! so they do email when they feel like it..

Then i noticed an amount of $70.80 out of my account... which is now under investigation.

A few weeks later when i went to pay my bills, they had basically cleaned me out!

I got onto the bank but they wont do anything until the 'pledge' leaves my account ( imagine how frustrated I am today, to KNOW that MY money is still in my account but that these CRIMINALS are going to get it all ).. I am WILD!

I then found this site & it was like OMGGGGGGGGGG what is this...

Everyone else that's had it happened to them also...

I've had to contact the Police & am about to lodge a fraud report with them also..

I emailed the company today & the response NOW was one of 'this is an automated service' ~ ### it is!

In the email i sent them, it just happened to state that I KNEW who they were, where they are & that I was going to the Police & lodging a complaint of fraud against them..

So good luck to ALL of us in getting OUR money back..

I'll be MORE careful next time... definitely close my account & THINK twice about NEVER purchasing online again!

I also was duped by Viv3 and i'm still waiting for the products to arrive and my money back which they double billed from my account.
I also noticed another company appearing in the Google Adds here (based in Australia) selling the same scam, same web layout same everything, I thought this is a complaint website, why do they allow them to advertise here?
And as to the dupers, we all should get together and hire an assassin to castrate the ###.

I to was scammed if you have ordered anything from these people immediately cancel your credit card, cut your losses, inform your bank as to what has happened. As fror cancelling your trial through these people good luck as they make it impossible to do.
