Vivid Racing Vivid Racing is a scam and I am taking legal action against them in small claims court

Vivid Racing is a scam and I am taking legal action against them in small claims court. I placed an order with them for a stock item (*** Headers) however after they took my money, they told me that it is not a stock item but made to order. I requested a refund less a 20% materials fee (whatever that is). Then a guy emails me and says that my refund was processed and on it's way. Five days later another guy ) emails me and say that my refund was used on the purchase of another set of *** Headers. Please follow the email stream and draw your own conclusions about their business practices: From: Sent: Thursday, March 11 4:36:01 PM To: Subject: Re: Hi Sir, Understood and thank you for reaching back out. I will now email *** a cancellation request on your behave and start the refund process with them. Normally this take around 24 - 48 hours to have processed and refund ready. As soon as they confirmed the cancellation of your order and refunded the amount I will then issue you a refund from Vivid Racing. I estimate the for you to have your refund is 3- 5 business days. Therefore when your order was accepted all the materials needed to build your headers was ordered and pulled. They confirmed with me that they have already started production on your headers on 03/08. They are extremely backed up and they are hand made here in Arizona. ETA is confirmed 4 weeks from the time of order. I asked to cancel due to ETA. They advised we can but there is a 20% materials and production fee since they have already started building you order. Please let me know if you like to continue and I can process you a refund and cancellation. Also just another update. I was able to get confirmed cancellation of your order from *** this evening. I have already submitted a refund request with my staff/ accounting team. As soon as one of the return and cancellation agents is able to finish processing they will then reach out to you with an email containing refund information. Just to be clear; Item was: $1646.30 Shipping: $38.53 20% of $1646.30 is $329.96. Therefore your return amount is $$1316.34 + shipping (38.53) totaling = $1355.57. Vivid Racing 5/5 Ordered front and rear bumpers May 5th through their website using *** for a total of $1467.00

5/5 Ordered front and rear bumpers May 5th through their website using *** for a total of $1467.00. I placed two separate orders so both bumpers would ship as they were complete. This was for the bumpers, plus one freight charge, since I talked to Adam over the phone and he agreed to those terms. I was given a 4-6 week lead time. I received receipts and confirmations email the same day. 5/6 My order was placed on hold due to COVID increasing the lead time to 8-10 weeks. I replied the same day, agreeing to the added lead time and I asked if my orders would still be shipping separate, and if my shipping address could be updated, as I would be moving in about 10 weeks. I received no reply. 5/21 I received an auto generated email "Your order has been processed and is scheduled to be drop shipped directly from our vendor or manufacturer. Once we have your order tracking number(s), we will forward them over so you can follow the progress of the shipment. If you have any questions, concerns, or issues, please don't hesitate to contact me." 6/20 I received an auto generated email "Thank you for your order! As you are aware this is a SPECIAL ORDER part. Your order is confirmed with us and now its time to get excited and wait!" I replied requesting an update to my order and received an email back from Brooke "I am going to work on an update for this and reply as soon as I get the information. Hope you are having a good day.". 6/25 No reply to previous email. Requested a status update. Received a reply from Tanner C. "Please allow up to 24-48 hours due to high volume. If you are needing further assistance please give us a call at " I tried 8 times, to call while they were open and no response, I left 4 voicemails with my contact and order info. 6/30 Emailed again for a status update. Received a reply from Tanner C. "The manufacturer let me know ETA is about 1 month left or sooner" Replied asking if this was for both of my orders. Tanner responded with "That was for *** Front Bumper. Do you have another order with us I can check on that?" 7/3 I replied with yes, I have two orders, one for Front and one for Rear. 7/6 Tanner C replied "Hope you had a wonderful holiday weekend. That is going to have the same ETA roughly as the front." 7/28 Requested an order update. No response 7/31 Requested an order update. No response 8/7 Requested an order update. No response 8/11 Requested an order update. No response 8/15 Requested an order update. I am moving and need to update my shipping address. 8/20 Ben P. Responded "I'll need to cancel your current order and I'll create a new order with the correct address. I'll need to collect a new payment once I create your new order. I'll also notify our supplier of the situation when I go to cancel your order to insure that production of your bumpers is not impeded or delayed, I'll go ahead and start this process now. I will send you a *** invoice with the updated shipping address" I agreed to this the same day. 8/25 Ben P reached out asking me what I was waiting on, and I told him I was waiting for the new *** invoice to pay. He sent the new invoice. This is where stuff got shady. The new invoice was $80 more than the original invoice. 8/25 Ben P. "You should have been refunded $1547.00, which is the exact price of the new invoice. One of your old orders was $509.00 and the other was $1038.00 which added comes out to the $1547.00 were you shorted on one of these refunds?" I replied with screenshots of my *** refund which was $509.00 and $958.00. Ben P. replied "I've figured out what happened, you actually owed $80 still on the front bumper that was never paid, so you had only paid $958.00 out of the $1038.00 owed on that one. I apologize for the inconvenience but since we've already discounted these as much as possible I'm unable to waive the $80, let me know if you have any further questions or concerns." I immediately called Ben over the phone and asked why I was sent a invoice for $1467.00 and never sent anything saying I had a balance due. I refused to pay the additional charge they added on this new invoice. Ben P. told me I was not charged for shipping on the second order, and that was the deal I made with Adam for this sale. Ben said he would have to clear this with a supervisor as they couldn't legally sell the item for $80 less (something about taxes?), as they were not even going to make any money off of this deal as it was. Ben put me on hold and came back and told me they can only ship the bumpers together and not separately. I agreed to those conditions and he assured me he would call me back in 15 minutes. Ben never called me back. Half an hour later I received an email from *** that the invoice for $1547.00 was canceled and a new invoice for $1467.00 was issued. I replied to Ben through email requesting confirmation that $1467.00 was the full invoice amount and I would not be charged anything in addition to this. Ben confirmed and I paid this invoice 8/26. 9/13 Requested order update - Per our last phone conversation I should be receiving both of my bumpers on September 21st and have received no shipping confirmation. 9/14 Ben P. "I just spoke with *** and they let me know that the front bumper has been done for a little while now and the rear bumper is going into powder coating this week, so it should be shipping out by next week." 9/21 Requested update. No response. 9/24 Requested update. Ben P. "I just now heard back from *** that I emailed on Monday concerning this, they let me know that the front bumper is all setup and they are supposed to get the rear bumper back from powder coating tomorrow morning at which point they will package it and get it shipped out. So if everything goes as they've told me it will this will be shipping out tomorrow, and as soon as they get us the tracking details we'll be sure to forward them to you" I replied back "Thank you for the update. Another week delay, do we know what caused this one?" 9/30 Requested update. No response. 10/2 Requested update. No response 10/6 Requested update. I decided to write this review here today. I also called *** directly and they answered the phone and told me my bumpers would be shipping today. Summary: Ordered 5/5 - Promised a 10 week max lead time (7/14). It has been an additional 11 weeks, for a total of 21 weeks I have been waiting for my bumpers. I would not do business with this supplier, they tried to get more money out of me, and have not been responsible, or able to keep to their word for lead time.
