Home Depot, Kingsport, Tennessee sold and delivered an electric start, self propelled "Toro" Lawnmower to my residence. The mower failed after one year and four months; well within the 2 year body and 3 year engine warranty period as advertised on the sales floor.
Upon contacting the store, their customer service department and the mfg.; all have stonewalled the complaint with no resolution in sight. This has meant my keeping a detailed record of every phone call; including the date, time, phone number, person I spoke with and notes on the conversation.
There exists an express warranty, and a warranty of merchantability; along with a contract in the form of a purchase with all five points of a contract existing.
There also exists a liability on the behavior of Home Depot for their failure to perform a portion of the contract; which becomes a breach of contract.
Included in this is my right to be made whole again as the machine is now useless. This translates to return all of my purchase money and if need be; all legal expenses for the warrantied item.
This noted, the term 'time is of the essence' is important; as the Home Depot must perform their warranty repairs or replacement or refund in a timely manner or face additional penalties as permitted by law.
I intend to be very specific with Home Depot in letting them know of my intentions should they not perform by a given date and time.
This is what all people should put in front of the company who specializes in disrespecting Veterans.. as I am one.
Desired outcome: Return all monies as shown on the receipt

The warranty shown is not a guarantee by the retailer to perform such service. It is a guarantee by the manufacturer to cover certain costs, should problems arise within the governing timeframe. These services are performed by local, authorized Toro service centers.
In order for any mower to perform adequately, it must be winterized properly and maintained at the first of spring the following year. Failure to do so, can result in problems. The most important aspect in winterizing any single plug engine is to drain and use all fuel -- preferably that of ethanol free. Not doing so can clog the carburetor. It's also a good idea to check the plug for wear and clean the air filter. And of course, checking for the proper oil and quality of oil. Many mowers claim that you never need to change the oil, only add as needed; I find the engine runs better with the cleaner lubricant. Personally, I'll sharpen the blade before the initial use and make sure it's properly balanced too.
If you don't feel equipped to handle such basic tasks, an authorized Toro service center can assist. During this time of year, however, expect longer than normal wait times.
