AM Used Auto Parts [AMUAP] - Used engine

A used engine was ordered from AM Used Auto in Lithia, FL on October 6, 2022. The VIN for the car needing the engine was given to AM to ensure the used engine we were buying was the proper one. AM Used Auto also indicated that their used parts were tested and came with a 1 or 3 year warranty. They sent the engine, and upon unwrapping it at the garage, the mechanic found a hole caused by a saw in the manifold (see photo) and at least one mounting bolt was broken (these things did not happen in transport). There were a multitude of other things wrong with the engine the mechanic found upon inspection, so many in fact that he could not take parts off the old engine to "fix" the newly purchased engine. In addition, the engine was the wrong emissions type so would not fit in the car. These things were reported to AM Used Auto and they indicated we should send it back, but charged a 20% restocking fee and return shipping. We paid $2295 and received a check back for $1536 (they subtracted $459 for restocking and $300 for shipping). In addition, we paid $488 to send the engine back to AM Used Auto. Their website indicates that if a part sent by them is incorrect, they do not charge restocking or shipping fees. AM has been contacted multiple times and they insist they do NOT have a VIN on file so were justified in charging the restocking/shipping fees, as ordering the wrong engine was our fault. We would never have ordered the engine without knowing it would fit the car as we are not mechanics, which is why we gave them the VIN. In addition to being the wrong engine, the engine they sent did not meet their guarantee, as it was completely unusable due to the hole and broken mount(s) and was clearly NOT tested as they indicate. We would like to be reimbursed the $458 restocking fee, and the shipping fees of $300 and $488.
