Janice Banducci was referred to me by a dearly loved customer of mine. She came highly thought of but I should have listened to the red flags after I walked into her dump of an office, that there was something up. I don't want to pay for the decorating and high priced plant service just like the next guy, but this was horrible dump.
She never showed up for her appointment and had this paralegal take down my personal information in which I was uncomfortable with because she had been a customer as well and I had not gotten a explaination as to why this was happening this way and when I ask, the gal was very very short with me,
They tried to get me to sign a agreement that night and I refused as I had not even met this attorney and not sure if I even wanted to hire her. The office staff of 1 then got this Janice Banducci on the phone readily and I got pushed from that end to come in the end of the week. I decided to go back because the attorney talks a great game and I thought I was being critical in the state of needing to file for divorce but not wanting to file.
I met with her a few days later, and she seemed ok. She was to have documents ready for me to sign next week. That week came and went and they did not return a call, and the same for the next week although I placed several calls that week, and the next week I placed calls daily and requested my return of 1850.00 retainer I had to give them prior to having any documents drawn. I have requested a copy of the "contract" and they finally provided me with a blank contract. Banducci tried to get me to just look at the documents she had ready and I refused because I just wanted my money back as I cannot find any clients of hers besides DUI drivers and this is family law in which was her specialty from her own mouth, although she isn't known in out humble town as even an attorney. I have put a demand letter to her in writing and verbal and she chooses to ignore me completely.
Please get more than one opinion on attorneys and if they seem shady and something not jiving, RUN AWAY FAST. It's not worth it.
I immediately filed a complaint with the Bar Assn stating facts only. There is NO signed contract by myself and never agreed in writing for anything. I produced copies of this with my complaint. The Bar Assn contacted her and in a letter they write to me they stated Janice Banducci met with me, completed the Summary Disso and then called me into the office. She stated that I refused and said that I had simply changed my mind to go forward on the case. Her word some how counts because others have not complained to the State Bar. They took her word for absolutely everything and said that she owed me about $300 refund and that she had already sent to me. Yes, she did that right before I got the State Bar letter. I have seen her many times in the Court House since including just last week in the ladies room. I have sat in the Court rooms countless hours and NEVER once has she been heard for a client or with a client. The comment that "Family1" made is such a joke and it's either Ruben that is her body guard or Lisa that was her secretary and that is a whole story in itself that I won't get into. Either way, I can say that IF you have had Janice Banducci "for years", there is something drastically wrong.
Kern County Superior Court is the last place anyone should be. It's a grimy place mostly (not all) filled with attorneys that are so polished in lying to their clients and making deals on the side. The corruption and legal bullying is very frightening although it's because the attorneys and judges are not familiar with the case that is before them. I can personally tell you that if you are without a lawyer and the opposing side has an attorney that is liked by the court at all, you either should try your best to settle out of court or I guess steal the money to hire a court favorite. Kern County supports the attorneys and help them with billable hours for sure. Good luck to all...
I so agree bako2013, the laws were created for the honest and respectable citizens. It's hard to find comments or facts about attorneys because of the obvious. Yes, people will not always agree with their attorney, and make harsh comments and say things about them purely out of frustration and anger. On the other hand there are oaths attorneys agreed on and the public ought to hold them to it. I know that my public complaint cost me dearly in many ways however it needed to be noted so that others can make an educated decision. One can look on the CA State Bar website for complaints on attorney conduct in which most wronged clients won't bother in making a formal complaint. It's very sad. It's up to individuals to do their research, however there also needs to be a website for past client's to share information that could help future client's as well. Accountability is a GOOD thing!
As with any human, we all have good and bad days. Requesting and accepting money in exchange for services should be earned.
I made the mistake of hiring Ms. Banducci myself on a recommendation, I am no longer friends with that person. She and the rest of her staff were all lost, then throw in the Kern County Family court and anyone with half a brain is ready to go off the deep end. I typically support the Kern County justice system, however having spent 4 of the last 5 years going to the system that has changed. Everyone there from the judge to every last attorney are there for themselves and the facts mean nothing.
So good luck if you get stuck in that mess.
Janice Banducci is no good, she knowingly engages in deceptive practices and she is incompetent. Don't Hire her. Soon, hopefully, she will be prosecuted for engaging in fraud. She is an arrogant idiot and "Family 1" is a liar and [censor], who only did a Google search after reading Evil Esquire concerning Janice Banducci, all that person is attempting to do is distort the truth about their friend Janice to mislead the public!
We always have found Janice Banducci to be an awesome lawyer; she is very precise and to the point and this can rub a lot of people the wrong way. I have had Janice as my lawyer for years and am extremely happy with the services that she has provided. She has been nothing but professional, honest and forthwith from the first day that she has helped me. Ms. Banducci is an amazing lawyer and has always looked out for the best interest of my children and our family.

If you were never provided a signed contract detailing everything this attorney was going to do for you then you have got her for fraud. File with the Bar Assoc immediately! Best of luck!
