My name is Nel Sewraj. I purchased a 2019 Mercedes C180 from CMH in Ballito, KZN on the 28 December 2021. Qoute number: 2248

COMPLAINT 1:

Prior to taking delivery of the vehicle, I made numerous enquiries to CMH salesman Sheldon Tonkin both telephonically and in person to ascertain whether the preowned vehicle (2019 Mercedes C180) I was purchasing was previously accident damaged. I was given the assurance by CMH Ballito salesman, Sheldon, that the vehicle is accident-free. A day after taking possession of the vehicle I learned that the vehicle had been damaged and repaired. Two days after taking possesssion of the vehicle, I returned it to CMH Ballito and Alan King, the manager, inspected the vehicle and concurred that the body work of the vehicle was indeed damaged previously, and the repair done was substandard. A Dekra report also confirmed this.

My grievance: I paid R 484 150 for the vehicle which I was assured was accident-free. Subsequently, I learned the vehicle was damaged in an accident. To date, dealer has not offered me any financial compensation for selling me an accident damaged vehicle. This is not fair because the vehicle is accident damage which means its value/ cost should be depreciated. CMH needs to compensate me financially.

COMPLAINT 2:

I was also given the assurance by salesman Sheldon Tonkin and that the vehicle was serviced by Mercedes Benz a few weeks before I took it. He also confirmed that the vehicle had one previous service before (so two services in total). The manager Alan King confirmed this as well. But, no service book was included with the vehicle. Subsequent to taking the vehicle, I called Mercedes Benz to verify the service history of this vehicle using its VIN Number. I was surprised to be informed by Mercedes Benz that this vehicle has never ever been serviced! So, the vehicle was given to me by CMH without ever being serviced by Mercedes, although I was told otherwise. CMH also promised to provide get the service invoices from Mercedes for me (I have this in writing - see attachment).

My grievance: I need written proof that two services have been done on the vehicle. And I need these services to be uploaded/updated onto the Mercedes electronic database/records.

COMPLAINT 3:

No spare key was provided with the vehicle. CMH promised to code and key and get it to me as soon as possible. Almost two months have gone by and they have provided no spate set of keys.

CONCLUSION OF THESE MATTERS:

There was no due diligence done in this sale by CMH Ballito. And for the above reasons, I cannot keep this quality and state of a vehicle. The deal is off. I would like to return the vehicle as soon as possible if CMH cannot compensate me and provide all documentation, and the outstanding key, required.

Desired outcome: The deal is off, unless:1. CMH financially compensates me for selling me an accident-damaged car.2. CMH provides the vehicle's service history, & captures it to the Mercedes electronic system.3. CMH supplies the outstanding car key.
