CLAIM #2266425

I recently purchased a 2014 Range Rover with low miles and an impeccable service record all documented on Carfax. Even the slightest maintenance issue that required was done at the Land Rover dealership including something as simple as an oil change. The manufacturer's warranty was expired so buying a warranty was an absolute must. The first place to come to mind was Carshield. For years I had seen the commercials starring celebrities, so I figured that if it was good enough for them it was also good enough for me. So I purchased the gold plan which is the highest plan that they would give me for my vehicle. This was fine for me because it covered everything that I needed to be covered. Months after purchasing the policy my alternator failed and my vehicle was towed to the shop. Carshield paid for this repair and the whole transaction was flawless. I was impressed so I told everyone I knew about Carshield and two of my friends even purchased a policy. In addition, my sister purchased a policy and we were on a family plan (I guess that is what it's called) so she was given a discount. About 4 months ago my water pump failed. I was driving and I saw my temperature gauge very quickly rising to the "H" so I immediately pulled over and shut off the engine. I then saw smoke coming from under my hood so I lifted the hood and saw my fanbelt chewed all up and that is where the smoke was coming from. Nothing else under the hood was smoking. So I didn't try to restart the engine (which would be foolish) because it overheated and it no longer had a fanbelt I then called a friend who towed my truck home since I was only about 2 miles from my house. That evening I got online and found a AAA-approved shop and the following day AAA towed it to the shop. The mechanic found out that the water pump had seized and caused the engine to overheat, Carshield paid for the water pump to be replaced, and after the mechanic said the vehicle wouldn't start. So the technician did different diagnostic tests and found out the engine needed to be replaced. He contacted Carshield and told them the problem and that's when the trickery and deception started. Carshield told my mechanic that they needed an estimate and then they contacted me for the Bill of Sale and maintenance records. I was then asked to explain what happened. I did and it seemed as if the person I spoke with was asking questions about me continuing to operate the vehicle after I noticed there was a problem. I told them that I pulled over right away and shut the engine off and had it towed and the rep commented that I did exactly the right thing by not continuing to drive it. The adjuster contacted my mechanic the next day and asked him questions about me continuing to drive it. He told them that there was no way of determining how long it was driven after the water pump failure. He told them that even if I pulled over as soon as it happened, about the time this registers on the dash or the overheating light comes on the damage is usually already done to the engine and you would be very lucky if it hasn't. The adjuster told the technician that he would call him the following Monday, this was a Wednesday. About two weeks passed and neither I nor the mechanic had heard anything from Carshield. So I called and I was told by a rep that the adjuster said that he couldn't open the file I sent him with my carfax that had all of the maintenance records. I then asked why wasn't I contacted so I could re-send the files because that was weeks ago. The rep stated she didn't understand why and then stated that the mechanic had to resubmit everything that he sent all over again. This was over a month after he sent his initial paperwork and estimate and he was told that he had to resend it. Weeks passed again so I called Carshield again and then I was told my claim was denied. I then asked for the name of the adjuster and I was given just a first name and the rep refused to give me a last name. What really is crazy is that the name (Dawn) that he gave me turned out to be totally false because I called the mechanic to get the name of the adjuster he was dealing with. So the rep obviously lied to me. Matter of fact, I then remembered to look at the email address that I was given to send the maintenance records I was told that this person was the adjuster on my claim.

Also, the rep told me that my mechanic told the adjuster that I just kept driving the vehicle and I was the cause of the damage. Once again another lie. I called the mechanic and asked about this and he said he didn't tell them anything of the sort and he would testify to that. I am blessed because my fiance is a lawyer and she has her own law firm with two partners. I told her about the situation and she told me that her firm successfully sued Carshield 3 times within the past 4 years. So she has already prepared the paperwork and we are just waiting on the denial letter to get here. We have already got qualified witnesses to testify that the claim should have never been denied for continual use of a damaged vehicle can not be proven. I am blessed I won't have to worry about legal fees and I also have another vehicle that I can drive.

Desired outcome: I would like my vehicle to be repaired, nothing more or less. If not, I will be requesting a whole lot more in court.
