Call the Federal Trade Commission FTC and file a formal complaint to protect your rights.
Phone number for FTC [protected] then call your state attorney general's office, commerce dept, and the Better Business Bureau. Contact your Congressman/woman or your Senators...this company is a predatory loan servicer...They do not own your mortgage so it is illegal for them to foreclose on your home! Only the lender who can produce your mortgage note has that legal right. Make a request to ASC to produce your loan documents...they wont do it because they don't know who does...wall street...

Wow what a fraud this company is, I was advised by my prior mortgage co 2 years ago that my loan was sold to ASC and I have had nothing but bad service, incompetent customer service reps (who dont speak proper english, they sound like they just graduated highschool) and after the wonderful stature that the US is in, the interest rates have gone up for us individuals that thought that by having the american dream and being lied to be the so called mortgage brokers 3 years ago that promised us people that getting an ARM mortgage would be the best thing and that the banks in 3 years would never raise you more and 100 a month well i went from 1700 a month to 2600 a month and trying ever month to pay therefore I can have a future for my son, ASC sends me letters ever month how they can help me and i have been trying to get help from them for 1 year and again they have denied to atleast lower my mortgage atleast $200 a month their denial is I put myself in the mess im in due to by debt to ratio, well if the gas was not 3.00 agallon and my sons school tuition would not have gone up 125 a month and my car insurance and the price of food then i would be able to pay my mortgage on time and not have to pay a late fee every month, ASC is a company that thrives on lowering the esteems of individuals and sends these monthly letters that they will help and contact them and when you contact them you are on the phone on hold about 1/2 hr and then they tell you oh you are on the wrong extension let me trasnfer you and again it is a constant battle to deal with a company like ASC, i could imagine how the employees must laugh when we hang up in distress and crying that we will try anything to keep our homes but dont worry the higher ups that are rippingus hard working people they will also fall one day KARMA is a ### and they way all those people treat us on the phone it will all come back to each and everyone of them. ASC is not a helping mortgage co they rip you off with phone charges, late charges and most of all raising rates, stocks are going down why are our mortgage rates going up.. I purchased an extended warranty with ASC Warranty on August 26th of 2021 for $2,545 (6 years; 120,000 miles) at Keast Auto Center in Harlan, Iowa. My GM truck had 9300 miles on it when I sold it and I requested a complete refund, since I never used the warranty - GM has this truck under complete warranty for 3 years, 36,000 miles. The finance person at the dealership where I purchased the vehicle told me that there would be a cancellation fee and that I should only expect to get $2,490 back. In fact, I only received a total of $2,290.95 back (ASC reimbursed $1,490.15, saying there was a 9% usage fee) and (the dealer refunded $800.80 saying that ASC Warranty had stated this was the dealer's portion of responsibility). I called ASC Warranty at 888.207.0166 and spoke with a representative for ASC Warranty who told me the difference was a 9% proration! However, this vehicle's GM vehicle warranty covers this vehicle COMPLETELY for 3 years, 36,000 miles and ASC Warranty was never liable to pay out anything during the short time I owned this vehicle; however, the representative argued that they would have been liable. I will only be satisfied with this situation when ASC Warranty refunds the other $199.05. I will also be filing a complaint with the BBB and CFPB.
My heart goes out to everyone who is suffering at the hands of a predatory lending scheme. I'm going to share my story with you AND THEN follow up with someone who was able to, just very recently, get Wells Fargo to help them. I want homeowners, or recent homeowners, to at least call and/or e-mail Cara K. Heiden, Mary Coffin, and Sharon Cecil in the WFHM Executive Office. In November 2006, Wells Fargo d.b.a. American Servicing Company (ASC) decided to escrow on my mortgage loan. For no reason. My taxes and insurance were always paid on time. Theyd never escrowed before. Then, instead of paying my annual property taxes once, they paid them twice. And I had already paid them. Then they pre-paid my property taxes that werent due for another year. Id never had an escrow account with them, so usually the balance was zero. Now it was -$5500.00. My mortgage payment increased from $655 to $1446 a month. I cant pay it.
Wells Fargo admits their error. They promise to fix it. Then they dont. Again they promise to fix it AND reverse all the late charges. Doesnt happen. No one corrects the original mistake so the snowball effect is creating havoc with my mortgage, with my credit, and on my life.
ASC Phone calls and letters threatening foreclosure were relentless. I have spent hours on the phone trying to resolve the problem. So many ASC Customer Service agents promise all your problems are taken care of, rest assured. When you check the next day to confirm all is well (youve learned to check) they can't even find a note in the record that you ever called. So then I am forced to start the process to correct my loan all over again with a different agent (weird isn't it that you can never get the same agent because they don't have extensions, and they refuse to give you their last name. They will give you their three-letter employee ID code that has never helped me a bit. Many agents refused to give me the companys physical address when I wanted to talk with someone face to face. Over this six-month nightmare I was assured over and over and over, that yes, definitely this time, they had truly made the corrections I had been assured already been made. Yes, isnt it wonderful, my mortgage loan had been approved for loan modification and the loan I’d been told dozens of time had been reinstated, had really for sure this time been reinstated. I was always told I would receive a letter confirming all was well with my loan. I was told not to make any monthly payments on the loan because until the correction had been processed through their system, the payment would be considered a partial payment and would be returned to me. So in February and March I couldnt send in a payment because the monthly payment amount was never corrected. I was forced over and over again to start the agonizing process from square one with another agent. Most agents couldnt find any notes in my record. I had the brilliant idea that faxing the whole story, along with receipts, and other requested forms, would be the answer to our communication problem. I would finally receive a letter confirming receipt of the requested documents. Four days later Im told my documents were never received so my home is in foreclosure.
On April 23, 2007, I was emergency admitted into River Oaks Mental Hospital for 10 weeks due to a complete emotional breakdown. I was suicidal and unable to care for myself. Wells Fargo Mortgage made a mistake, and acknowledged it. However, they were unable (or unwilling) to fix the problems their error created. My sister was given power of attorney so she could resolve the issue. Upon discharge from the hospital an ASC agent confirmed my loan had been fully reinstated, the payment had been corrected, the escrow balance adjusted. They promised the late charges and additional interest charged because of their error would be credited back to the account. I insisted and they agreed they would contact the credit agencies to report their mistake, remove all negative remarks, and change all comments they had made regarding my mortgage account to paid as agreed.
Two days later I received a notice advising me of the sheriffs sale date set for my home.
My home was my savings account. And it was my retirement account. More important, it was my security blanket.
The October 3, 2007, sheriff sale date has been postponed and Wells Fargo has told me they want a satisfactory conclusion to this nightmare. Ill keep you posted. Today is October 9, 2007.
WFHM admitted errors and apologized in two letters received on October 24, 2007, and October 29, 2007, from Todd M. Boothroyd (contact info shown above), credited $12, 000 to my mortgage loan, corrected the negative reports made to the credit repositories, reinstated my loan. I breathed my 1st sigh of relief in nearly a year.
THEN THEY SOLD MY HOME AT A SHERIFF SALE. They took my home, almost $100, 000.00 in equity, and I'm lost without my home. God Bless my 70-year old mother who is now forced to take care of her 46-year old, disabled, daughter. I still believe something good is going to happen. I really do. Two years of fighting for all I'm worth just can't end like this. I will NEVER stop trying to find restitution and peace. And I will NEVER STOP sharing my story just in case it might prevent someone else from losing their home. From facing agonizing months on end. Being turned inside out with fear and pain. From losing their retirement, their live savings, their security. If I had children, I don't know how I'd be able to face it. I don't know how these companies are able to do what they do to famies who have trusted them. It just breaks my heart.
BUT remember, some of the readers of my blogs have been e-mail me sharing good news about the help they are beginning to receive from Wells Fargo Bank. So DO NOT GIVE UP!

The blog you posted saved our future! The key to ASC success was dealing with one individual, and after sending emails to Wells Fargo's President, V P, And CFO, I had a response in four days from ASC! My wife was the one who took the call that morning while I was out dropping off the kids at school, and when she called me on the road with the news which was:"We are calling you from the executive department of ASC, and are very sorry you have had to go through this, we are assigning you to an individual who is going to get things straight, and it doesn't get higher than this", I could not believe what I was hearing, something that we worked months on with nothing but confusion, misunderstandings, three months delinquent, then all of the sudden...this? It was like seeing 911 all over again, I don't believe what I'm seeing, and hearing!
I wept behind the wheel to the point of almost having to pull over, but continued driving because I needed to get home to my wife and hear it again in detail. As I walked through the door, I saw this look of disbelief in her eyes mixed with a joy I have not seen for a long, long time. When I sent those emails out, I never thought a reply was coming, but something happened. In the subject line of those emails read "Why do you want my home?" I proceeded to explain the 100's of horror stories written by ASC victims, and how they all sounded alike, as did mine. The one question they had to ask when contacting my wife that morning was "how did he get that email information?", and my wife's reply was "you can get almost anything off the internet these days", which is how I found you Kelly.
All I did was Google "ASC Complaints", and OMG, there you were, along with more than I could handle. Fox Television even contacted me based on a blog I submitted, and had been getting so many calls, yet mine stood out, and wanted to do a live interview with me at my home, but I had to decline, for that was the day we were to get the news on the Special Forbearance Option that was about to be put into motion. We got the forbearance, yet within a week, ASC called back, and based on a plan I suggested they use, was submitted to the investor, and they approved it three months ahead of schedule.
All of the delinquent payments were then rolled back into the loan, interest reduced, payments reduced, and the rest goes into the history books. I've got you to thank for this Kelly, and I have passed this info to others whom have contacted me, and told me that they are starting to move forward in a positive way. ASC has also told me that the plan I suggested they implement for us, will now be used in other situations. A plan that has never been used before. I'm a Realtor, suffering like everyone else, yet WAMU agreed to a loan mod on another property that I own, and worked so well, I had to tell ASC where they were falling short, and how this plan could make it a win, win situation for the both of us. 3% year one, 4.5%, year two, 5.7%, year three, and every year thereafter.
So there you go. It's snowballing, and God used you, as he has used me to help those who are at a total loss as to who to trust, and which direction to go. I still look back on that morning when I got that call from my wife, and immediately thought of you. I saved your blog in Microsoft word, and was able to retrieve it. I needed to say thank you over and over again. I'm a firm believer that when you do good for others, good comes back to you. You're a God send Kelly, and I owe so very much to you for what you have taught me. If not for that information I just happened to stumble across that day while on a last chance mission, our home would now be gone. A million hugs and kisses to you my dear, you to are a totally awesome person!

no hope with hope for homeowners program
American Servicing Company claims they are reviewing your information in attempt to approve you for the HOPE program. However, BEWARE...I was just denied...they stated per FHA guidelines, all my debts including the new written down mortgage and any revolving debt needed to be below 31 percent. However after reading the FHA guidelines on line, there numbers don't match up. I have read FHA requires the front to not exceed 31 percent, but not the total debts. This is a cover up I believe. When they say they are reviewing your case based on FHA guidelines, they are really reviewing by their own criteria. I can afford my new payment that would be written down to half of what it was prior. However, now I'm another victim to this Foreclosure mess. I feel ASC has no intentions on helping their existing clients as they state. BEWARE...also worse customer service ever, even the supervisors lack credibility as they are just as evasive and inconsistent as their dim wit employees
i was supposed to get help and i wasnt even behind city misplaced my certified check and sent my payments back to me witch put me in forclosure .i called for help from hope .big mistake i made the payments, i was supposed to with the help of hope they forclosed anyway i have prof of all payments and city recieving them and still lost my home. city said they never spoke to anyone on my behalf about my payments.after the foclosure hope said the lady that helped me didnt even have a lincience to work in my state.they hendered my case not helped it .i lost

I am going to adding to the long list of complaints against ASC. My due date without late fees is the 16th of each month. In Oct. of 2008 they received my payment in full. Then on the 27th of the same month they sent me another statement stating the payment was reversed. I called to see what was going on.They said my bank refused payment. I called my bank and they said that since they, ASC, electronically collects instead of mailing in the check, they had hit a wrong number or something. I tried to call them back and was waiting on the phone for about 10 minutes. Nobody ever answered. In the mean time because of their mistake I am stuck with being a month behind. ASC has got to be the absolute worst mortgage company there is.
Please advise everyone and anyone who is checking on "ASC", "America's Servicing Company", they are, in fact, a/k/a "WELLS FARGO BANK, N.A.", do not be fooled by the great reputation of Wells Fargo Bank, because it is truly, honest to God, "ASC"! They have so much money, there's no end in sight, they have the ability to falsify documents, make false accusations, promises or negotiates for mitigation of your loan is only a deploy to delay you and make you believe they are working "with" you, but truthfully, they are biding their time until a "default" can be entered in the foreclosure matter that is presently pending, then they'll tell you that they need additional paperwork and/or 30 days to decide, which is a code for 30 days they will have your home sold at auction and they will invite you out of your home. Seriously folks, tell anyone and everyone you know that deals with Wells Fargo or ASC to remove any and all accounts from both of them. Your only way to make any money is to own stock with Wells Fargo Bank, N.A. and become a stockholder. You are guaranteed to lose your home or property if you are in business with them. Check on Wells Fargo's ownership in whatever other businesses so you have a better picture.
Fraud and scam
I set up a prepayment plan after waiting 2 months for ASC to admit to having my paperwork to modify my loan. I was already unable to refinance because my X ruined my credit and my interest rate went from 8-10%. I finally got someone on the phone explaining that I was surviving a violent relationship and may have hardship in the near future. She was very nice and set me up on a forbearance repayment plan. I had to come up with $1557.00 to show good faith and I did. I went hungry and did not pay my second loan. She explained I could not be late on these payments and that I should have them automatically withdrawn, I said ok since my payment went down . Well last month, out of habit, I made it online and realized I could mess everything up like that. This month my payment was due on the 7th and on the 12th I realized the payment was not deducted. I called in, got treated like an animal, transferred 3X, I was told I had to pay more money because I broke the contract!
I explained it was supposed to be taken out automatically, they said I was being difficult and transferred me to some international line that hung up on me. When I called back I amazingly got the same girl who set me up the first time, she was so nice, even apologized for what I went through and said she was sorry she did not explain the first time that only the FIRST payment was withdrawn automatically! She explained in order to get my payments back on track and the same amount each month, I would have to come up with the $1557 again and the remaining 7 payments would be $1300. By the end of the conversation, my payments were 1600! I explained it was not my fault and not even seven days late! She said I broke the contract, I said I have a second also, that would make my payments over 2000 a month! I am going to have to let them take my house? How can they do this when i am obviously on a low income budget and on a adjustable rate loan. CAN SOMEONE PLEASE REFINANCE ME WITH BAD CREDIT AND TAKE ME AWAY FROM THESE MONSTERS? IT IS BEAUTIFUL AND I AM NOT ABOUT TO GIVE IT TO THEM!

In November 2007, Wells Fargo dba American Servicing Company (ASC) decided to escrow on my mortgage loan. For no reason. My taxes and insurance were always paid on time. They’d never escrowed before. My mortgage payment increased from $655 to $1446 a month. I can’t pay it.
Wells Fargo admits their error. They promise to fix it. Then they don’t. Again they promise to fix it AND reverse all the late charges. Doesn’t happen. No one stops the snowball effect Wells Fargo’s mistake is having on my mortgage and my life.
Phone calls and letters threatening foreclosure were relentless. I have spent hours on the phone trying to resolve the problem. Various ASC Customer Service agents promise all your problems are taken care of, and when they call you again the next day, didn't leave a single note regarding my call, or that I even had called, in my record. I started the process all over again with a different agent (weird isn't it that you can never get the same agent because they don't have extensions, won't give you their last name -- just a three letter employee ID code that won't get you anywhere. One agent refused to give me his physical address when I wanted to talk with someone face to face. Many different customer service (?) agents over this six month nightmare assured me, that yes, definitely this time, they had truly made the corrections I thought had already been made. My loan had been approved for loan modification and the loan I’d been told dozens of time had been reinstated, had really for sure this time been reinstated. I was always told I would receive a letter confirming all was well with my loan. But the promised confirmation letters never came. And I was forced once again to start the agonizing process with a new agent. AND, the notes in my records either did not exist (according to one agent) or were very confusing (according to another.)
On April 23 I was emergency admitted into River Oaks Mental Hospital for 10 weeks due to a complete emotional breakdown. Wells Fargo Mortgage made a mistake, and acknowledged it. However, they were unable (or unwilling) to fix the problems their error created. Instead, two days after they told me (AGAIN) my loan had been fully reinstated, I receive notice my home was scheduled for a sheriff sale in 8 days. Two days after they promised the charges resulting in their error would be removed, and they would contact the credit agencies to report their mistake, and remove their negative remarks.
Wells Fargo’s illegal lending practices caused emotional distress that resulted in my emergency hospitalization. I'm bipolar, my condition worsened, my depression bottomed out and I became suicidal. I was unable to function. My sister was given power of attorney, and, even though they were aware of my condition, and that they were the source of the resulting breakdown, they still refused to work with her.
On August 14, I was told, again, my loan had been reinstated. While waiting again for another confirmation letter that never comes, I call them again. I didn't contact anyone else for help because I didn't think I needed to. ASC was always so sorry after they didn't follow through on one of their promises. Then they reassured me all was well. I was very stupid.
My home was my savings account. And it was my retirement account. More important than anything, it was my security blanket.

My heart goes out to everyone who is suffering at the hands of a predatory lending scheme. I'm going to share my story with you AND THEN follow up with someone who was able to, just very recently, get Wells Fargo to help them. I want homeowners, or recent homeowners, to at least call and/or e-mail Cara K. Heiden, Mary Coffin, and Sharon Cecil in the WFHM Executive Office. I give you their e-mails, direct phone number, and address below. Please try. I'll say prayers for you and your dear families. Remember, keep trying. Expect God to bless you. And I know he will.
In November 2006, Wells Fargo d.b.a. American Servicing Company (ASC) decided to escrow on my mortgage loan. For no reason. My taxes and insurance were always paid on time. Theyd never escrowed before. Then, instead of paying my annual property taxes once, they paid them twice. And I had already paid them. Then they pre-paid my property taxes that werent due for another year. Id never had an escrow account with them, so usually the balance was zero. Now it was -$5500.00. My mortgage payment increased from $655 to $1446 a month. I cant pay it.
Wells Fargo admits their error. They promise to fix it. Then they dont. Again they promise to fix it AND reverse all the late charges. Doesnt happen. No one corrects the original mistake so the snowball effect is creating havoc with my mortgage, with my credit, and on my life.

When you check the next day to confirm all is well (youve learned to check) they can't even find a note in the record that you ever called. So then I am forced to start the process to correct my loan all over again with a different agent (weird isn't it that you can never get the same agent because they don't have extensions, and they refuse to give you their last name. They will give you their three-letter employee ID code that has never helped me a bit. Many agents refused to give me the companys physical address when I wanted to talk with someone face to face. Over this six-month nightmare I was assured over and over and over, that yes, definitely this time, they had truly made the corrections I had been assured already been made. Yes, isnt it wonderful, my mortgage loan had been approved for loan modification and the loan I’d been told dozens of time had been reinstated, had really for sure this time been reinstated. I was always told I would receive a letter confirming all was well with my loan. I was told not to make any monthly payments on the loan because until the correction had been processed through their system, the payment would be considered a partial payment and would be returned to me. So in February and March I couldnt send in a payment because the monthly payment amount was never corrected. I was forced over and over again to start the agonizing process from square one with another agent. Most agents couldnt find any notes in my record. I had the brilliant idea that faxing the whole story, along with receipts, and other requested forms, would be the answer to our communication problem. I would finally receive a letter confirming receipt of the requested documents. Four days later Im told my documents were never received so my home is in foreclosure.

They promised the late charges and additional interest charged because of their error would be credited back to the account. I insisted and they agreed they would contact the credit agencies to report their mistake, remove all negative remarks, and change all comments they had made regarding my mortgage account to paid as agreed.
Two days later I received a notice advising me of the sheriffs sale date set for my home.
My home was my savings account. And it was my retirement account. More important, it was my security blanket.
The October 3, 2007, sheriff sale date has been postponed and Wells Fargo has told me they want a satisfactory conclusion to this nightmare. Ill keep you posted. Today is October 9, 2007.
WFHM admitted errors and apologized in two letters received on October 24, 2007, and October 29, 2007, from Todd M. Boothroyd (contact info shown above), credited $12, 000 to my mortgage loan, corrected the negative reports made to the credit repositories, reinstated my loan. I breathed my 1st sigh of relief in nearly a year.
THEN THEY SOLD MY HOME AT A SHERIFF SALE. They took my home, almost $100, 000.00 in equity, and I'm lost without my home. God Bless my 70-year old mother who is now forced to take care of her 46-year old, disabled, daughter. I still believe something good is going to happen. I really do. Two years of fighting for all I'm worth just can't end like this. I will NEVER stop trying to find restitution and peace. And I will NEVER STOP sharing my story just in case it might prevent someone else from losing their home. From facing agonizing months on end. Being turned inside out with fear and pain. From losing their retirement, their live savings, their security. If I had children, I don't know how I'd be able to face it. I don't know how these companies are able to do what they do to famies who have trusted them. It just breaks my heart.
BUT remember, some of the readers of my blogs have been e-mail me sharing good news about the help they are beginning to receive from Wells Fargo Bank. So DO NOT GIVE UP!

OK - wow, how do you share your heart so well? You have blessed me with your success story. Can you imagine how many others will be encouraged, uplifted, and energized when they read your words?
I wish you would have been able to do the FOX interview! It sounds like God is using you by giving you so many opportunities to share your story! Very few people go to the forbearance table with a specific plan, a win-win for both the lender and the homeowner. That is key and something I never considered.
Both investors and lenders would most certainly warm to homeowners who calmly expect a successful resolution.

The blog you posted saved our future! The key to ASC success was dealing with one individual, and after sending emails to Wells Fargo's President, V P, And CFO, I had a response in four days from ASC! My wife was the one who took the call that morning while I was out dropping off the kids at school, and when she called me on the road with the news which was:"We are calling you from the executive department of ASC, and are very sorry you have had to go through this, we are assigning you to an individual who is going to get things straight, and it doesn't get higher than this", I could not believe what I was hearing, something that we worked months on with nothing but confusion, misunderstandings, three months delinquent, then all of the sudden...this? It was like seeing 911 all over again, I don't believe what I'm seeing, and hearing!
I wept behind the wheel to the point of almost having to pull over, but continued driving because I needed to get home to my wife and hear it again in detail. As I walked through the door, I saw this look of disbelief in her eyes mixed with a joy I have not seen for a long, long time. When I sent those emails out, I never thought a reply was coming, but something happened. In the subject line of those emails read "Why do you want my home?" I proceeded to explain the 100's of horror stories written by ASC victims, and how they all sounded alike, as did mine. The one question they had to ask when contacting my wife that morning was "how did he get that email information?", and my wife's reply was "you can get almost anything off the internet these days", which is how I found you Kelly.
All I did was Google "ASC Complaints", and OMG, there you were, along with more than I could handle. Fox Television even contacted me based on a blog I submitted, and had been getting so many calls, yet mine stood out, and wanted to do a live interview with me at my home, but I had to decline, for that was the day we were to get the news on the Special Forbearance Option that was about to be put into motion. We got the forbearance, yet within a week, ASC called back, and based on a plan I suggested they use, was submitted to the investor, and they approved it three months ahead of schedule.
All of the delinquent payments were then rolled back into the loan, interest reduced, payments reduced, and the rest goes into the history books. I've got you to thank for this Kelly, and I have passed this info to others whom have contacted me, and told me that they are starting to move forward in a positive way. ASC has also told me that the plan I suggested they implement for us, will now be used in other situations. A plan that has never been used before. I'm a Realtor, suffering like everyone else, yet WAMU agreed to a loan mod on another property that I own, and worked so well, I had to tell ASC where they were falling short, and how this plan could make it a win, win situation for the both of us. 3% year one, 4.5%, year two, 5.7%, year three, and every year thereafter.
So there you go. It's snowballing, and God used you, as he has used me to help those who are at a total loss as to who to trust, and which direction to go. I still look back on that morning when I got that call from my wife, and immediately thought of you. I saved your blog in Microsoft word, and was able to retrieve it. I needed to say thank you over and over again. I'm a firm believer that when you do good for others, good comes back to you. You're a God send Kelly, and I owe so very much to you for what you have taught me. If not for that information I just happened to stumble across that day while on a last chance mission, our home would now be gone. A million hugs and kisses to you my dear, you to are a totally awesome person!

Yes, I'm still in my home but now after Wells Fargo Bank dba Americas Servicing saga was all worked out, loan reinstated, $12, 000+ credited to my mortgage account -- 20 days later my home was sold at a sheriff sale. I walked with eyes wide open smack dab into the middle of a foreclosure rescuer scam artist LLC. "Equity-Strippers." To just say just the very least, and leave you alone, they forged a Quit Claim from me to them, mortgaged my property to the max hat at one time had significant equity (for me) and now I'm fighting with

The complaint has been investigated and resolved to the customer’s satisfaction.
OMG...we are also with ASC and like the others here, we were mislead and have been hit with foreclosure. We called hundreds of times, with no avail...never was told the same thing twice...was told payments were never received on time...and the straw that broke the camel's back was when they took it upon themselves, without our authorization, to debit our checking account for two payments! They claimed they had our conversation with them recorded with our authorization of the transaction. We asked to hear that recording and of course, they weren't allowed to do that. This all because we tried to work with them by asking for a deferred payment for 1 month and they were going to send us the papers to sign and return. While waiting for those "papers", we were notified our home was in foreclosure! This all began 7 months ago...we contacted a company that works with foreclosures and we were told ASC is the worst company to work with. Oddly enough, through all this, we kept receiving letters from ASC saying they wanted to work with us...I had a odd feeling about that, and after reading all of the complaints here, I now know my gut feeling is justified. What can we all do about this horrible company? I am beyond sick about losing our home...the last letter we received from them stated they would give us their decision in 30 days...and it has been well over 30 days. How can these people continue doing this? PLEASE, someone respond...I don't know how much more of this I can take!
If at all possible avoid doing business with this mortgage company. I fell on hard times after becoming disabled and losing my wife to cancer over a year ago. This included my mortgage payment causing it to be a month late with no possible chance of catching up in the near future. ASC set up payments to be drawn from my checking account at the end of the month at the time I get my check. Problem solved... Hardly, ASC calls my home 10 or more times a day in collection calls. They set the payment schedule, but cannot change my status in their computers to reflect this, or so they say. I say BULL to this. Why should I have to explain to their employees programs set up by one of their own. This is harassment pure and simple. I did not choose ASC as my mortgage lender. They bought my mortgage from another company, I wished they would sell it back
Last month, I mailed my payment from Ventura to Los Angeles a week before my mortgage payment was due. What is that? A 50 minute drive? After four days, when my payment did not post, I called them. They told me to call back the next day (the deadline day for being on time). I did so. They told me to call later in the day, that by 2:00 or 2:30 all payments would have been posted. I called and my payment was still not there. I was told the payment was not there or it would be in the system as pending. I put a stop payment on the check and paid over the phone so I could be assured the payment was received. About a half hour AFTER I paid the mortgage over the phone, my check was posted to my account. So next thing I know, TWO payments are being charged to my bank account. It took two more days of phone calls to get this straightened out. So by that time, I had a stop payment fee AND a pay by phone fee. I was out money, and they had made their phone fee telling me that my payment had never been received. Although the customer service people I talked to (for the most part) tried to be helpful, it is obvious that there is a ton of ineptness in the process they have going on down there. Absolutely amazing. I can hardly wait to get out of this loan! Eight months and counting... :)
Here's how it started our mortgage got sold to ASC . And every 2 or 3
months our payment would go up.we were getting late fee's
even though we would send our payment on the 1st of every month.
It took us a few weeks to get intouch with them. They told us we were sending our payment to the wrong address? WE USED THE COUPON THEY SENT US! Our payment stared at 400.00 a month but
when our house was foreclosed on it was over 1000.00 a month. And
with things as they are we could not pay it.We tried to get them to work
with us, but we got no help.Because of them my life has been turned
upside down. i have lost all faith in all mortgage companies.I feel as if they just swept us under their rug and hollowed who's next!
After ASC bought out our Mortgage. Our Homeowners Insurance renewal was due. We had our own underwriter and had our new binder which I faxed to ASC at the fax number given by them to prove continued coverage. I kept all paper work including the fax conformation with number, date, and time.
Today in our mail we received notice that they had never received proof of coverage and had set up a policy and would add this into the monthly payment. Illegal as one can get.I have also tried repeatedly to contact these people, where ever they are, probably out of the country and non English speaking, to get information on taxes, no luck.
I am very dissatisfied and will use every opportunity to insult this company and make sure other consumers understand the awful service this so called company gives.
My spouse inadvertently missed a payment in OCT '07. For the next year we made all payments on time. I recently started paying our bills online and when I called ASC to get billing info, they informed me of the missed payment, 16 months later. I have now learned that it took 12 months for us to reach the magical 30 days past due and our last four payments have been reported to the credit bureaus as such. And just when we had finally gotten everything in order to re-finance and get a great rate. Shame on these crooked, back-handed posterior exhaust ports! They have my phone number, but I guess it was too much trouble to phone and let us know their was a problem.
I am writing in regards to a breakdown away from home. Our second one while on vacation to be the least times to expect Car trouble! So traumatizing to my family - My vehicle has left us stranded and with very little response from the most recent breakdown. We left messages while being stranded on the side of the (busy freeway in Long Beach Ca) freeway and never got a follow up call the next morning. Called roadside and found out it only covers 3 miles and only a $50 dollar towards the tow. Towing operator took too long to get info or dispatch tow that -We had another tow from Pepboys reward program show up faster! Not to mention it was after dark on the busy 710 freeway! I know it is impossible to xray a car or know when your next breakdown will occur but by all means at least reach out to your clients to follow with peace of mind that you will assist to keep you informed... I had to call to get my own claim started after leaving detailed message to please call us. Car was taken to a Nearest Pepboys to get diagnosed and possible repairs for the cooling fan over heating car and still after two days no call back or to repair facility to pay claim. Advisor or rep had said they could not go beyond value of car after being explained it still had almost $350 dollars in value left on account! I was shocked to find out of a cost cap to the value of car! The warranty had done so well and find out that on your vacation nearing the last dollar amount left for coverage you cant even get home or be more informed to get the car back on the road is so disappointing. Still stranded in Long beach CA covering extra charges for hotel, taxis and all other related expenses out of pocket! Rental company claiming I cannot get a rental cause in not local resident with collateral or return! Never had such a bad experience already complained to enterprise after being a ling time customer! (Another issue) Still have not gotten home to added frustration and worry that no one cares anymore. Worst vacation experience ever. Still haven't gotten peace of mind that they cover the claim to get my car back from repair show. Horrible, horrible incident to go through.
Mr. Lopez: First, let me say that you need to learn how to spell. When a person "sues" he is not "sewing" as you stated. Its obvious that your demeanor and attitude is not one that belongs in the mortgage collection business. People who have ASC are not all "horrible credit rating" people. Some of these people have the down payment and good credit, but aren't able to get put with a "prime" mortgage company. You need to understand that there are reasons, legitimate ones, as to why people have their credit marred. Maybe you should look into those reasons before berating people. Do you really think that if ASC walked into a courtroom, where the whole point of the law is JUSTICE that their lawyers have a better chance of winning against opposing counsel(s)? Come on Mr. Lopez do some research before berating and showing your poor thoughts for humanity! I have ASC and I have had no problems with them. Now, if I had to deal with someone like you, then yes, I would have to say my dealings would not be with that of a person in deals with people in a considerate, friendly, and tactful manner. Stop trying to humiliate others to make you seem a better person to yourself!
I have had 8 mortgages over the past 30 years and this company took over my mortgage about 3 years ago. ASC is by for the worst mortgage company i have ever delt with. They only use automated systems which calculate payments, applications and escrow accounts for the benefit of the company and not the bowerer. The structure is to increase charges/fees to the borrower and set up traps which require constant monitoring. If your payment is changed for what ever reason and is one dollar short the whole payment goes into suspense and you are automatically reported 30 days late. There is nobody to talk to, and if you get a hold of anybody they will do nothing! The provisions of the escrow accounts continue to change and beware of property tax payments. I had ASC pay property taxes on my behalf when they had already been paid. The arbitrarily set up an escrow account and it took me a year to get it removed. They charged fees all along the way which also took me a year to get back. This company is unbelievable! I have been sooo frustrated, I would rather deal with the IRS than these guys

We were behind on our mortgage, we were trying to catch up sent them a payment that they would not accept because we were 3 monthes behind and so we went into foreclosure, before I even sent that payment, we were trying to work with them to get the arm rate to a fixed rate because this is what caused us to get behind, we could not afford the amount it went up to when the arm changed. We were not told it would increase by 300 dollars or more. They asked for information to work on it and than repeatedly said they never recieved the faxes.. So I would refax. Than they would have it but it would be the 1st one I faxed them. Also as I work in credit we have to get a decision to someone within 30 days. These people were dragging their feet and said 30 to 60 days well of course foreclosure would hit before they finished. So we took money from a 401k plan to catch up and were told that loan modification would no longer be able to help us we had to start all over with the art dept. which meant refaxing everything yet again. They finally said 30 to 45 days it has been 60 nothing has changed on our loan and we have not recieved any kind of decision from them. So I feel this company wants you to fail so they can take your home from you. They are part of Wells Fargo and it is sad to see such a large company scamming people and than advertising how great they are...
ASC loan scam!
I want o open a lawsuit case against ASC. I don't know how did ASC took over my home loan from my bank. I was behind my payments. We tried to do short sale with ASC. Buyer offered $385, 000 and ASC rejected. ASC said that they want $407, 000. New buyer agreed to pay $407.000 to buy my condo. Real estate broker gave a new offer of $407, 000 to ASC and they said negotiator will contact broker and buyer. Nobody ever heard from them at all. Realtor, seller, and buyer (me) called ASC so many times, we couldn't get hold on anybody, we did only couple of times spoke someone but they transfered us to someone else and we had to leave a message again. They never started short sell even new buyer agreed to pay what they asked. We had to wait for them for a while. Never received a phone call or a letter nor a notice. Then after while Someone knocked my door and he said " my condo is sold in auction yesterday". I said"how is that possible, we agreed to on sale with bank, we are waiting for them to close it." Guy acted like he does not know it and keep saying it happens to everybody. ASC should of at least give us a foreclosure sale notice or warning something like that. They could of say that they change their mind on short sale, they don't want to sale it. Then I would look for other solution. But HELL NO, ASC JUST DECIDED TO SALE IT ON AUCTION WITHOUT LETTING OR TELLING ANYONE IN THAT CONDO. THE ONLY THING WE HEARD WAS " CONDO IS SOLD IN AUCTION, YOU HAVE TO LEAVE THE UNIT".

How AWFUL! We have been dealing with this horrible company for months trying to get a loan modification agreement - they sent us another persons agreement, lost our information many times, lied and lied and lied, can't keep their story straight. The rip-off company!
My father was transfered to this company after 3 payments when he refinance to prepare home for sale and replace 20yr boilers and 32yr underground tank. Before he knew he would probably get behind, I called and requesting loan modification papers and never received them til 3 months and 6 phone calls later. they could never fax them claiming papers are sent from another department... what BS. Well by the time I got papers my dads house sold 16 days on market... oh and within the time because he was about 2400 + fees total short for the 3 months he received foreclosure papers...
Well I just returned loan modification papers and told them this is what I had and this is all your getting... they wanted $264,000 from foreclosure of which they claim $18500 was mortgage payments,fees,& drastic attorney fees. Well I did not pay ###...
I also think our Realtor was a scam because he did ### to sell house... just want the $14000 in commission in which i can say the buyers agent earn their half... Well he got screwed too... because ASC allowed shoftfall and paid realtor after payments... I told ASC they better take this offer from buyers because if my father died in the next coming months they will never get anything and this is what they get taking advantage of a senior citizen on ssi disability after his stroke. I informed them the jerks they brought the loan from lied to an elderly man telling him his payment would be well below his income of only $2400 a month.
ASC finally approval mortgage shortfall which took over 2 months for an approval and i told them i was not paying anything for the 2 months they waited and Judge agreed. SO the $268,000 they was seeking was cut to about 200K , and I am laughing my ### off... scored 1 for the consumer

My dad only had 110K left on orig loan & and was living on SSI after my mom died in 2017... Shysters loan originators came i told him he could refinance... creating false house appraisal and get a loan of 150K in which he could not afford because of how originators hide numbers on papers... and his credit score b4 loan was 724 above average.
I have read all the complaint and i have to say that it made me feel better to know that i am not alone. It will do you no good to waste your time trying to find out info on asc. Try wells fargo that may help u better because i keep getting envelopes with wells fargo home mortgage printed on them and i am financed through asc. On my good days i gather my friends over and we get out my paper work from asc (that is all the stuff they have messed up like my escrow account, how much i do or don't owe for that month, my canceled insurance paper for my insurance company because they didn't pay, but i was paying 451.00 to much in escrow a month for over six months) and i call every department just to see how much more stuff they can screw up. They have put my family in such financial hardship that know every payment is late and not only theirs. So life goes on my family is still together we are in ruin but alive. We have know other option but to let the house go and find a rent to own somewhere; so for now i am staying here rent free. So long to asc!
For everyone who complains about ASC, think before you make your post. I understand people's frustration with the process of doing loan modifications but you are dealing with money and this process is still a business. Everyone thinks that they are going to qualify for loan mod or the new plan because the economy is bad. However, how are we going to modify loans if there is no income or your debt exceeds your income by over $1, 000? Some people don't want to hear that they spend too much or make enough to keep their homes. I understand the importance of homeownership but the truth is, some people just can't afford to keep their home. If a loan is modified with little or no income, we are doing a disservice to the people who are really having a difficult time because those people will almost certainly call in 6 months to say that they need another loan modification. Also, people seem to think that machines are infallible. If we ask you to resend your info because we didn't get it and you got a confirmation number that your fax went through, why do people assume that reps are lying? People have to remember that ASC services millions, millions! of loans and with the number of modifications being done and paperwork being sent via fax, its quite possible that your info did not come through. if you are really serious about saving your home as you say you are, then how hard is it to fax it again? People, understand that its a business, a process to get loans modified and lastly, we are dealing with money..
This stupid company paid somebody else's taxes with our escrow acct. It took me 3 months to get it through their dumb heads we didn't own that property.They went up on our payment because of course there wasn't enough money in our escrow acct. to pay both our taxes & Ins. What dummies. It still isn't completely fixed because on our statement it says suspense. They are trying to collect from the other party before they put our money back into our escrow. It was their mistake, but in the meantime we have to pay more monthly. Our payment went up 300.00 extra. The webpage is a joke! I haven't yet been able to view my acct. online.
My 3 year ARM was sold to ASC about a year and a half ago, and it just ran out 2 months ago. My interest rate rose from 5.5% to 7.35%, and was told it could increase another 1% next year. When i asked if there was a fee I could pay for an extension on my old loan, I was told NO. Because my rate payment increased by $355, I would send in two separate checks for my new payment because I already had automatic payment going for the old amount. For two months, they applied both separate payments to principle only, and filed late charges against me. It took an hour on the phone to get this corrected. I was told that if they did not receive the full amount in one payment, it's not considered a payment, and it just gets applied against principle. When I came online to look at my report, I found that there were many people with the same exact problems. I guess my biggest question and concern is, with these complaints people are filing, is anyone, or agency taken on the tasking of correcting this company for it's bad practices? Fortunately I will be selling my home in less than a year, so I won't see the high increase in my rate again, nor will I have to deal anymore with this company.
I am entering my 5th month in a fixed modification loan with ASC thru Wells Fargo. I have made my first three payments on time and to this day, they still have not applied my payments correctly. They are deducting late charges from my reversed payment sitting in their suspense account, reducing my cash on account which leads them to argue with me that I do not have a full payment that can be applied to the past due payment. They are reporting me LATE when I have been busting my A$$, cutting expenses EVERYWHERE possible to improve my credit after their pathetic excuse for falling one month behind pay back in six months option which digs you into a deep grave each month... Every time I call, I go from Customer Service to Loss Mitigation and then back and forth.. No body sees what the other sees, and no body knows where my money is, why it was reversed and how to get it applied properly. Not only do I have a life and have been hit by this slumping economy with RISING COSTS, I sure don't have hours to waste daily to avoid loosing my home and having my children and I without the home we have called together for 9 years... This was a loan sold to ASC and it scares me that more and more people are going through the same thing I am... I have to search tonight to see if there is a class action law suit. Also, I contacted HOPE and they actually called ASC with me on the phone.. I finally spoke with a supervisor who said he didn't get my two messages in the past week and then sent me to their retention dept/review dept and a woman’s name that is out of the office and two other people to contact... I have left the 800#, area code 515 and I am back at the "tag your it" game. I've documented every date, every name, what they said, every number, every message and I am ready to send a certified letter to the president/ceo/cfo/cfoo, who ever and document what has occurred.. Enough is enough. I’m paying now that I have a fixed amount and had a month or two to catch up after the holidays, so why all this extra drama...
I had a previous loan company who sold my loan to ASC. They do everything but help the homeowner try to keep their home! I became disabled in Aug, of 2017 I have had it hard with it being only me with a small disablity check coming into my home only once a month and also taking care of 3 children under the age of 18. They dont seem to understand that once a person becomes sick they no longer have the income they once had Lord knows SSI don't pay you what they claim that you are intitled to. They have no business lying to individuals the way they do. They told me that they would keep my interest rate low so that I could afford my payment and they the liars did exactly the opposite of what they said they were going to do to help me.I don't have anything nice to say about them except you are nothing but a bunch of rip off' liars that think of only yourselves to take advantage of a disabled person like they have done me is in my book only forgiveable by GOD! I hope he forgives them cause he knows that I can't!
ASC - Needs a wake up call. WE SHOULD FILE A CLASS ACTION LAWSUIT. My parents' loan was sold to them two years ago. They are hard to reach, one department doesnt know what the other is doing. The refuse to send you to a manager to lodge a complaint or say there isnt one available. My parents had great credit and was placed in a high interest rate (because of their age, so the broker told them), during a time when interest rate were between 5 - 6.5%. I have been trying to modify their loan by and/or requesting for a rate reduction refinance over the last year and denied three times!...Now my mother passed away, my father's income alone will not cover the high monthly payments. We placed the house for sale, received 13 offers. I am requesting a short pay on the loan since my parents put $230, 000 down on the home, now with the current home price drops my parents have lost that. So I think ASC taking a 88% as a pay off is a pretty good deal compared to what my parents lost. They have not called back and 4 weeks have gone by, we've had to fax all the paperwork twice. I call them everyday...when I ask to speak to the negotiator they tell me I cant but they can leave him a message to call me, still no call. We are most likely going to use the highest bid on the house which would have made it possible for my father to move to a senior park...
asc has screwed with my mortgage payment for almost a year before i got through they said they never received two back to back payments we got a knock on the door in december of 07 it was a lady wanting to help us with getting us out of fourclosure we looked at her and said what are you talking about called them that is when we were toldd we had were 2 payments behind from aug, sept of 07 they said to send them 3384.00 and they would do and loan mod. for us but in the mean time they said not to send in any money it would not going to go against my credit it not only went against my credit they told me 4 month later when i had been calling every month at least 2 or more times they keep telling me nothing had been done yet finally i got a answer in late april I had been denied. I then spent 1300.00 on a loan modifacation company that went to bat for us they got our loan through it went up 500.00 a month because of the month I didnt make those payments for all those months our payments are up to 2500.00 a month we have 7 kids plus another 17 year old we are helping out I am the only one in the house that works now the company is slow and I might get laid off I hope to get refianced before all this happens
I got approved for the home loan modification trial plan in September 2017 and paid my new payment with no problems once the tree month mark came I called Asc to find out when my paperwork would be in the mail and they stated that they are still going over the paper work to see if I qualify and to just keep making the payments until they reach a decision so I did then I got a phone call and a letter stating that I would be getting agreement package in the mail two days later I get another phone call from asc stating they don't have all documents in to resend every thing I set them 3 month before so I did and waited and this proses went on and on saying they didn't have all the paperwork the needed up in till a hole year now I get a letter stated due to not sending all documents in my House is to be sold at action September 21 2017 I currently trying to work with the wells forgo president line to get help this is my first houe I bought 10 years ago when I was 20 years old but I only have about another week before the sell if there is any class action suits I need to get on board pls. I'm currently disabled and now my soon to bee wife is trying to make ends meet with 6 children in the home and my credit score is down in the dirt I cant even get a rental I don't know what to do
America's Servicing Company (ASC) bought my loan October 2017. Since, in less than six months as of March 23rd, 2017 (the date of last phone call I have received from them) they made three big mistakes! Each time, they clear my monthly mortgage payment, apply it the wrong way, apply the whole amount to the principal, then call me requesting to collect a debt saying my account is delinquent, that I didn't pay my monthly mortgage. They are applying my payments incorrectly and charging me a late fee of $49 each time. (sure I made them remove the charges after I found out how they are making these mistakes but still ever month or so they call and bother me at work and give me hard time.
When ASC notified me that they bought my loan, I signed a document giving them authorization for automatic withdrawal, but I had to withdrew the authorization of automatic withdrawal from them the very next month because they tried to sell me, by force and intimidation, a home insurance even though I told them that my home insurance is covered by the Home Owners Association (HOA), and that none of the previous lenders requested it directly from me, as they get it automatically when they buy the loan!
I felt that they were trying to trick me, intimidate me in case I do not get the documents they requested on time that they would have to withdraw the insurance coverage fee directly from my account. For that reason I had to withdrew my authorization and stopped them at once from touching my bank account.
I am not sure, I cannot prove it but since I withdrew the authorization and gave it to my bank to send them a monthly payment, since that day they keep making mistakes when it comes to my account. I wonder why in less then six months why it happened that they would apply my monthly payment incorrectly?
I tried to find an e-mail address for ASC in order for me to send them an e-mail, for my surprise they do not have one. They have a website where I can only check my account, make a payment but they do not have "Contact us" nor an e-mail address where I can write them directly.
Also when I checked ASC on the Internet this is when I found out that there are too many people complaining about ASC for years now! I am wondering why till nothing was done about them ?
Fees to Pay Loan
I agree with the complaint that ASC's fees are unreasonable. I also beg to differ with Eric Lopez's argument that all mortgages serviced by ASC are low quality loans made to borrowers with poor credit. My credit score is in excess of 750 and I have never made a late mortgage payment in my life. GMAC sold my loan last year to ASC. When asked, the GMAC representative said that they were selling off packages of loans to ASC to increase available capital. I was told that my high credit scores and on-time payment history made my loan easy to sell. I was furious with GMAC, because I was being penalized for "good behavior". I make all my payments on-line and hated the fact that ASC didn't offer that option. However, I do get the most out of my service fee by making three to five monthly payments at a time. If I didn't have such a low interest rate, I would refinance my mortgage with Chase. I have my investment property loans with Chase. I love their easy and FREE on-line payments. Just transfer from checking to mortgage loan and go. If Wells Fargo were smart, they would stop trying to nickel and dime their solid borrowers. Based on my experience with ASC, I have refused to deal with Wells Fargo on business loans, credit card offers, etc. I deserve better and can get it elsewhere.

No, I do not work for America's Servicing nor for Wells Fargo, I am just an everyday ordinary citizen going about her personal business. I will say this for the company when we had problems with out payments or questions, the customer service was excellent and they explained everything patiently and thoroughly.
Withdrawing money from account for their made up fees!
This is the second time ASC has tried to foreclose on my house. I'm fighting back with a lawsuit and have filed a complaint with attorney general. There is something we can do about them. A class action law suit was filed last year. If you have had trouble with ASC, please contact Douglas Mcloskey @ [protected] and attorney general J.W. Nixon @ [protected].it is a federal law to take money out of your escrow account. The only time money can be taken out of that account is for taxes and insurance. (unless you pay your homeowners out of your own pocket, as we do) please call so they won't take your house. They need to be shut down. We looked over the paper's they sent us and they were missing originals and our initials was forged. Please call these attorney's and another class action suit will b filed!
Made payments, forclosed 10/07 for non payment, notified in 2/08 we were in forcloser, have 4 forbarence agreements new loans have made all payments early, still 2 days before payment due they charge late fee reported to credit bureu we are 31 payments bedhind but each year we have recieved 1098 for interest payed on mortgage over 10000.00 now they want to do a new modification with payments 3@ 1100.00 and 1 @ 41000.00
and then will look over payments and refinace 121000.00 all together 165300. 10years ago we paid 76000.00 we have no equity and never took out a second but we 97500.00. the judge dismissed the forcloser each party pay there own fees and he told asc they need to learn how add and the lates charges he did believe in them. I have faught for three years alot of money and stree and time I am tired. i dint think any of us can win.
Hostile foreclosure
My home recently was foreclosed on by ASC, due to what they call NON-PAYMENT. I was 1 month behind on a payment due to financial difficulties. I contacted this company to make a partial payment, which they would not receive. The very next month my financial situation returned to normal, and now I was able to make a full payment. This company demanded full payment and blocked me from the payment log-in on companies website. This behavior continued for 3 months despite me trying to make all of my payments, less that 1 payment. They started charging several unknown fees along with interest. I contacted them at least 4, sometimes 5 times a month, speaking with everyone from customer service to loss litigation. I was given every excuse from "just send in what you have", to "we'll put the missed payment on the end of the loan and you will be current Mr. Ramsey". Nevertheless I sent in all late payments that they would not take, including the missed payment. They still foreclosed on my home stating that they didn't receive my check. I had to cancel my check after mailing it to them 4 weeks later. Its ironic that the parent company of ASC is Wells Fargo Mortgage and Wells Fargo bought my home at the foreclosure sale and re-sold it to ASC. It is also ironic that a vehicle displaying the Wells Fargo sticker on the side was seen riding by my home on several occasions by me, after I missed 1 payment. And last but not least, it is extremely ironic that all of these aforementioned activities took place after my property value skyrocketed $20,000 in one year and is on a continual rise due to it's location. I am not accusing this company of anything, but my case is just IRONIC! Now my credit is destroyed to the point that I can't even rent an apartment. I am a police officer with 5 kids and a wife and a victim of underground, loophole jumping, non governmental enforcing MORTGAGE COMPANY HOME JACKING!
I WILL CHAIN SAW MY HOUSE DOWN TO THE FLOOR LEVEL BEFORE I LEAVE THE HOUSE BECAUSE OF FORECLOSURE, I WILL PUT LIQUID CEMENT IN EVERY TOILET, SINK AND HOLE I CAN FIND, SEE IF THE CAN MAKE ANY PROFIT OUT OF ALL THE SWEAT I INVESTED FOR SO MANY YEARS OF HARD WORK.
There is no way that a mortgage company is going to foreclose if you are one month late. In fact, Wells Fargo gives you a 30 day grace period to pay your mortgage payment, as do most other mortgage companies. And most companies (Wells Fargo included) will bend over backward if you call them if you are going to be late. You could have worked out a payment arrangement, gotten a forbearance, or in worst case scenario filed for bankruptcy. But they never would have foreclosed after one month. Foreclosure is a complicated procedure and by law they have to give you options. Sounds like you are in a bit of denial and unwilling to accept the responsibility for your own actions.
What does being a cop with kids and a wife have anything to do with this? What scares me is you are a cop, are you as bad a cop as you are in home finances? Just like you say to your suspects, there’s more here than you are telling. Oh and read you contract, you will find that just one payment missed is reason to foreclose or demanding full payment of the total loan. You could have easily worked out a forbearance agreement when the problem first happened. I do not know of a single mortgage contract that will accept a partial payment. The very seconded you get in trouble, what is anyone advised to do? Call your creditors! Even ASC will work with you.

Illegal escrow impound
ASC is charging me $57.84 as a monthly impound account they created out of thin air! I pay ins & tax myself & require no impound account to pay for me. They began a fee per above dated 4/13/2007 saying the house was uninsured from Dec 11 /2005 to January 4, 2006=28 days in 2005. Now they are feeing me %57.84 to payoff a insurance fee of $694 for the 28 days-that is a high rate! It's a fly by night operation-they apparently believe they can charge whatever they want. My loan was transferred to them and i want it transferred away from them-anybody know how? What/who do i complain to.
I'm ready for a class action suit too. I think we should get all our stories together and go to our congress people first. I can set up a Facebook page that we can all write up our complaints or something. We are doing a short sale on our home because we no longer want anything to do with ASC and we have to move for my job anyway. They have been jerking us around since last August on a loan modification. First they didn't get the paperwork, then they find it, but we have to redo it because their imaging dept can't scan anything in blue ink. We had to redo in black ink. Can you believe that? There's more but it makes me sick to my stomach when I think about them.

I have read all the complaint and i have to say that it made me feel better to know that i am not alone. It will do you no good to waste your time trying to find out info on asc. Try wells fargo that may help u better because i keep getting envelopes with wells fargo home mortgage printed on them and i am financed through asc. On my good days i gather my friends over and we get out my paper work from asc (that is all the stuff they have messed up like my escrow account, how much i do or dont owe for that month, my canceled insurance paper for my insurance company because they didnt pay, but i was paying 451.00 to much in escrow a month for over six months) and i call every department just to see how much more stuff they can screw up. They have put my family in such financial hardship that know every payment is late and not only theirs. So life goes on my family is still together we are in ruin but alive. We have know other option but to let the house go and find a rent to own somewhere; so for now i am staying here rent free. so long to asc!
Trying to get modification of loan
I was sold to this company in August 2006 from Fremont Investment & Loan (who are no longer in the mortgage business as of February 2007). I made my scheduled payment in September to Fremont because I was not aware I had been sold, I never received a letter from Fremont until I had made my September payment.
That payment was never applied to my loan with ASC and since then ASC has been saying that I never paid for September. However I managed to catch up the loan but late fees were assessed regardless. I applied for a loan modification in December 2006 with them to try and bring my account completely up to date.
They told me it would take 30-45 days before making a decision. I called to make an over the phone payment in January and they told me to abstain from making the payment until they notify me of the loan modification decision. In February I got the same answer.
Finally on March 19th I was served with foreclosure papers. I am required now to come up with a lot more money to reinstate my loan or lose my home. I have been given until the end of April to reinstate my loan or they will proceed with the foreclosure. I have been very dissatisfied with them from the beginning and when I did a Google Search on the Internet this morning to find their website, I found all these complaints and negative reports about ASC. I was stunned! I thought I was the only one! How can these people get away with this? They are ripping people off and no one seems to be able to do anything about it!
If anyone reading this knows what can be done or who we can go to, please post it on this site... Let's pull together and fight back!
The same thing happen to me with them. I now how a payment that is way to high for the house I live in! What can we do?
My dealings with ASC have been horendous also. I was sold to them by Fremont investment. Shortly after that I had some taxes due, and ASC paid them with out my consent. They then tacted the amount onto my ever rising mortgage. When I could not pay all at once, I began to make 2 payments within the same month. That tacted on a late fee. Then ASC would send out appraisers to my home for which they charged me for. Not once, or twice but several times a month. When I asked for restructuring or loan modification, they gave me a plan that was $1000. more than what I had been paying a month. When I could not pay that they set it back to the original ridiculous amount, that I had trouble with and then stated over the phone that it would be that amount for 4 months, then the 5th month (July) they were not sure what it would be. When I got the agreement in the mail it said I will owe $14, 456.00 for the month of July. Boy! am I screwed. If the $2, 558. was hard, then the$3, 558. was way to hard, then back to $2, 558., hard a again. What makes them think I have $15, 000.00 stashed some where. My orignal payment was $1, 500.
We are also victims of the Horrible company ASC. We have had our home for 7years and they took over the loan originally from WAMU. What a diffrence we fell behind in payments and I madecontact with them and wired them 1575.00 to start my loan MOD and I just found out that they are foreclosing my home whikle I am still paying them all of thast money. I could have kept that in my pocket and moved.
These Vulchers need to be stopped someone need to contact the Governor or President someone with power to help us the people of the Inited States. HELP! Lets all class action this place

I have been going through the same thing with ASC. I applied for a loan modification in December and was told that it would be at least 45 days before a decision would be made. 3months later I get a letter telling me I was denied. Now sitting in full forclosure procedures. I reach out to some companies for assistance. I was told to get the pa 91 notice but ASC refuses to give this document to me. I can only pray to come up with the money and REFINANCE out from ASC... Horrible Company.
I am also getting screwed by ASC. When my mortgage was sold to them, nobody sent a letter or called, so I sent my regular payment to my old mortgage company. The check was cashed by the old company, but was never applied to ASC. So from day one with this company they have said I am a payment behind. So I finally just paid an extra payment to get them off my back, which put me behind on everything else. Then they messed with my Escrow account, and put me in the negative which in turn raised my mortgage payment It's been one thing after another with this company. I fell behind 2 payments, and now I just recieved forclosure papers. I have until April 21st to pay to reinstate, which is an ungodly number. I want to pay, but am scared to death I will pay and it will just be something else. I can't keep digging myself out with them, when in all actuality they are the ones scamming me.
OMG, I thought it was only me! I am totally screwed byASC. There modification dept totally misinforms!
I started my modification in Nov 2007 and was told the same thing it would take 30-60 days and would be assigned to a negoitator within two weeks, oh yes and not to submit payments to either put them in a suspense account or a savings acct until the modification is done, because investors will not help if there is not a need. They assured me the payments would remain the old amount until the mod. was complete . I was not convinced this was correct so I asked to speak to a supervisor who advised me the same, I took down names and employee numbers and reasked the question everytime I called which ended up being a spreadsheet because they would not return calls. Needless to say it took 6 months and refaxing the same info 3-4 times for them to say they denied me because I did not meet the new Debt to Income guidelines. They told me to redo the modification. Now I find out that as soon as they denied me the sent my loan to there attorneys for foreclosure. Oh it gets better, I now have 6 months of late payments on my credit even though I made a big payment upon finding out what was going on, and come to find out they did not offer locking in my old payment amount because being I was denied they claim it is all invalid. This loan I was a co-signer with my mom on it is her home, I have my own home with an adjustable that expires in Nov and now I will not qualify because my credit is totally shot! Thank ASC! I have tried everything and still at a dead end with no help in sight! How sad that nothing can be done about ASC, I am a single parent for the past 12 years and everything that I have worked hard and sacrificed for so my children can have a headstart in life is now GONE!
This is a comment for HOWARD! Like ADA I did not get a letter saying we were being sold we have NO PAPER WORK FROM ASC ... How how the hell can we "put on our underware" and grow up, And further more because of your ignorance I hope your mort gets sold them them! You'll see! BTW Happy Easter!
I have been approved for a Loan modification and they are taking much longer than the 45-60 days..however..the incorrect info they gave you was you must continue to pay..even if it increased...which is what I have done..not easy, but no way did I want to go to foreclosure.
I started with Freemont as well...no one really cares and there is no one to escalate to.
Read your letter of loan transfer. You are told that any payment made to the old loan company will be applied to the new loan holder with out any fees or penalties. This of course do not go on forever, there is usually a 30 or 60 day period for the transfer. That letter spells it all out. Put on your underwear and grow up. “These people” are not “getting away” with anything. They are doing what is legal, and what is spelled out in the contract YOU signed, read it.
7 month missing pmt investigation/derogatory credit reported
My loan was transferred from gmac to asc last october. Auto pmts were made two months in advance to gmac - pmts returned to me and gmac. Asc states 10/06 pmt missing so investigation opened in 1/07 to be completed by 2/6/07 and then by 2/28/07. Dozens of call to asc by me and dozens more of auto collection calls to me. With every call i reconfirmed no late charges or derrog. Credit reporting, even if missing pmt was my error. I did all the research work for asc even though they said they would do so. Now asc states pmt 'is' outstanding and reported 60-30-30 late to credit agencies. Refuses to remove or give me accounting from gmac transfer. No late charges due - but credit reporting has stopped me from financial aid for my son to go to college. Single mom. Terrible bureaucracy and no cooperation or communication from asc from anyone other than customer service and collection dept. Ready to hire legal counsel or change my identity at this point. 7 months correspondence and calls on file with asc. Outright refusal to comply with employees' representations to me re: credit reporting even when given the scenario of this possibility that my accounting was wrong. Assured over and over that due to debt collection act, credit was safe because of missing pmt investigation.
Property taxes scam!
My mortgage was sold to ASC from First Franklin in August 2006. Instead of First Franklin paying my summer taxes, they sent all my escrow to ASC along with the mortgage. Instead of ASC paying my taxes, they applied it to my mortgage like it was a house payment -- they say they paid $2,086.00 in summer taxes but the city shows no payment. (Mine were only $1,164.00) When winter taxes came due ASC said they paid $813.00 -- but the city never got it -- (mine were only $454.00) -- come to find out, ASC has been paying the taxes for the condo above me! ASC's records show her property address and her parcel number, not mine! ASC insists I have no homeowners insurance no matter how many times I've sent them proof, they've lost payments, are ruining my credit, and when I requested copies of signed documents, they sent me the closing documents for six different people in six different states -- this includes identifying information I have no legal right to -- so if I have their documents, who has mine?
