DELUXXE AT GRAND MAYAN

Signed october 29 2022 at Vidanta Resort Nuevo Vallarta at Vida Vacation sales division office (our Sales agent, for the day, private office)... situated at the Grand Bliss complex on NV resortground (we have been there before 2019... first upgrade with another salesagent). It's hard to tell your story and issue in a short version. Sorry for any miss spelling.. We are a family from Sweden that found our vacation paradise in Vidanta resort NV 2017... We bought us a membership.

There and then we couldn't even believe that we in november 2022 would end up feeling devastated over being forced to upgrading our then current contract (upgraded in between in 2019).

The inforcement... Were told november 2022 that our then current membership contract as Grand Luxxe Deluxxe Level was no longer going to exist and our options were either had to pay them to cancle us/sign us out or we could do a significant upgrade into Deluxxe at Grand Mayan level (netvalue wich were shown to us on paper was 900.000 USD)... this level wasn't even built yet so we were regarded as significant investors to them at Vida Vacation Sales... that message they pointed out very clearly.

There skilled calculated ultimate goal was to make us feel very fortunate and important= get us to sign and pay them a significant amount of money as soon as possible. We ended up making a first downpayment at the sales meeting october 29 2022 (the meeting streched over 8 hours.. mentally exhausting.. you don't have any mental power left).

The payment= approx 8 595 USD.

We were then according to their calculation obligated to make a second down payment before november 29 2022 (after we got back home to Sweden) otherwise we had to get that second downpayment financed by the finance company VCM over a period over 6 month. They didn"t recommed this option for us... they sad because then we would end up with paying even more in total regarding the interest rate that was included in the VCM financing.

They Vida Sales agent told us very clearly to go back home to Sweden and take out another mortgage on our house... what would be the problem! he said.

We had 1 week left (out of our 2 weeks resort vacation) and I had to stressfully make several phonecalls to our bank in Sweden to apply for a motgage on our house (fue to that we ended up with a huge phonebill..200 USD)

Back home and 3 weeks later we ended up making the second down payment=27 578 USD.

Now we were entering the phase regarding auto monthly payments=1080 USD/ month =a payoff period streching over 60 months= 5 years (a longer pay off timeperiod doesn't exist).

The first monthly (regarding our new contract) started in december 29 2022.

(Our last monthly regarding our previous contract was withdrawn in october 29 2022).

MAIN ISSUES TO WANTING OUT OF CONTRACT=NOT PAYING ANYMOORE:

#We specifically did not want an upgrade in the first place and that we expressed.

#Skillfull from their point of view we were told that we had NO choice but to agree to this new upgrade if we wanted to keep our membership and our pieces of paradise. The other option would have been still paying them money to get out and end the then current contract maid in july 2019.

Mentally brainwashed after 8 hours in meeting (within their plan) you don't want to loose your vacation paradise and still have to pay for the los= you end up caving in and agree to their upgraded contract= they are skilled in knowing that people/members usually follow this mental path= Vida Vacation Sales end up cashing in.

#The sales agent playes nice guy by telling you that don't go with a finance plan by VCM... regarding paying high interest rate.

In every other sentence they say that they always have your best interest in mind and eill be there for you= all in their skillful plan to getting you to sign.

#NOT once during the hole length of the meeting they mentioned anything regarding the crucial contract recession time period streching over 5 days (the same scenario during our first uppgrade in 2019) = you could according to Mexican law within 5 days regret signing (.. don't personal know how smoothly that would be done).

You do end up reading about that option in the contract after you finished your vacation and have returned hlme.

The contract contains so many pages... feels like hundreds of them and the content is all written in tiny letters.

It mentally exaust you... also part of their skilled plan for the member not to have the strength/the need to read it within the period of their remaining vacation time= the 5 days goes by=the recession time expires= Profite gorVida Vacation.

#When told that our then current contract (from 2019) would not be valid anymore and an upgrade was the only option to still keep a membership... the sales agent very clearly told us that the new upgrade complex level (Deluxxe at Grand Mayan) wasn't built yet.

We were by Vida Vacation seen as very significant investors... highly valued in their eyes. It was going to be built down by the already exiting initial Grand Mayan complex... it was the LAST piece of WATERFRONT property he said.

Very exclusive oppertunity!

We could see it as an significant investmen for us that we even could sell later on and make money out of.

Very clearly that was pointed out to us during the salesmeeting.

We later own found out (past the recession time) that the new built that they sold us... Deluxxe by Grand Mayan... last waterfront property wasn't a new built but instead they are just remodeling some of the already existing top unitsfloor of the old Grand Mayan buildning.

FALSE MARKETING EVER.

We were also within the contract guaranteed seaview when ever we made a booking.

We have learned that there are a lot of members that have the same upgrade as ours...containing the same promises and has also learned that this specific type of contract has been oversold by times 52=Impossible to make a booking that fits you and there is noway everybody can get the guaranteed seaview=what a lie.

#First of all Vida Vacation doesn't own any of the resort buildings within the Vidanta resort grounds and has there for no mandat to guarantee any physically specific complex unit that you end up buying into... neither they do not have any mandat to promise/guarantee what is going to be built/developed.

In the contract it is stated that you as an vacation club member are not allowed to use the nembership in the intention to have a sell/resale/investment purpose

You are only allowed to use your membership strictly as for vacation reason.

Vida Vacation sales are not allowed to market it to you as your oppertunity to buy into an investment... but still they do.

It's among their new mentally market pitches/angles=to make the member wanting to buy/upgrade in beliefe that they can make some profit on it futher on within their membership.

#Not ethical by Vida Vacation Sales to take advantage of the members state of mind which during the (as usually extremly long) salesmeeting tend to degenerate over time=mental brainwash/mental exhaustment.

You don't want to loose your vacation paradise so they get to you and they push your most vulnerable buttons/week spots to make you cave on and loose your ability to think rational.

#The contract has No identifiable signature made by our Vida Vacation salesagent.

#The only value you get out of the vacation membership is you not owning nothing but AIR (you own NOTHING) and a right to make phonecall when makeing a vacation reservation/booking within your membership level.

Most commonly in recent years is the fact that it is almost impossible to be able to get the room/unit you are entitle to within your contract and evenmore so difficult to get the reservation fitting in to your timeframe when you can go on vacation and what is stated in your contract.

What has made this scenario to make your rightfully vacation reservation so difficult/almost impossible is that all membershiplevels/units has been oversold=more memberships then there is units to book and use.

Our loses/Vida vacation profit upon us as members:

We already lost approx in total [protected]=85 000 USD (This is up until the day we had to upgrade in oct 2022)

Vida Vacation= upon october 29 2022 had made a Profite out of us by 85.000 USD

LOS SUMMARY

*Membership first purchase

June of 2017=35 000 USD

*First upgrade in july 26 2019 and then 40 monthly payoffs until our latest forced upon us upgrade 29 of october 2022

=50 000 USD

*Herebuy Vida Vacation has profit from us= 85 000 USD.

SUMMARY OF THE LATEST LOS FOR US BY THE UPPGRADE 29 october 2022:

*October 29 2022 downpayment during the salesmeeting=8 595 USD

(Our Swedish bankreciept is registered and dated the 30 of october 2022)

November 18 2022

I made the second downpayment by phone to Vida Account and they withdrew as planned=27 578 USD

Writing this and leave yourself out there feels right now just so mentally exhausting as our latest by Vida Vacation manipulativ salesmeeting.

Want ever not to go trough it again.

OUR DEMAND OF REFUND regarding many unethical and false marketing details which occured during our upgrade Vida Vacation Sales meeting

No rightful or ethical choice were given to us, just a mental demand from Vida Vacation to make us upgrade.

Not on equals terms.

We want a full REFUND of our 2 downpayments

October 29 2022= 8 595 USD

November 18 2022= 27 578 USD

There are a massive awareness out there regarding the scamscenario that is ongoing when it comes to

Club Vacation memberships buisness.

*We are prepared to make our case as public as we can, hopefuly save somebodyelse from being decieved into a membership...in our case Vidanta by Vida Vacation.

The list of membership clubs that eorks this way are long so..

*We are even prepared to take legal actions to get our refund... already in the beginning of that.

*Have also names to go public with even if that is not our way to go.

Just the REFUND specified above... Vida Vacation still already have gained approx 70 000 on us since the beginning of our membership with Vidanta Nuevo Vallarta Vida Vacation.

Desired outcome: Leaving our membership hereby!Total Refund regarding our 2 latest Upgrade Downpayments made:October of 29 in 2022=8 595 USDNovember of 18 in 2022= 27 678 USD
