*** was contacted by a 3rd *** center on December 15th, 2021. The call center offered her premiums to attend a sales presentation with Vacations 4 You on December 16th, 2021. During her presentation, *** decided to become a Member with Vacations 4 You based on the value of the deals that she could get on Vacations.
*** set her purchase up through a 3rd *** on equal monthly payments for 48 months. Upon choosing this finance company, the documents are signed digitally and all copies of the documents are sent immediately via email to the consumer. The *** sends out text reminders each month notifying the Member that the payment is due. It also provides a link to review the payment. This was gone over with here not only in the conversation about how the contract would be paid for, but also in the contract that was signed by the consumer that day. (Membership Agreement attached)
In April we started receiving calls from the Member asking if there was any way we would buy back her Membership. Our Member Engagement team explained that this was not an option that Vacations 4 You offers. Furthermore, we have received no coorispondence from *** regarding her claim. We have had many Members throughout 2021 that have used Hilton properties through our reservation platform including employees. We would love to assist *** in booking any specific reservation that she would like assistance with.
It is just now, in July that we are receiving the communication that somehow our website is not real and that our pictures are not accurate. To provide clarity on our website and the database that is used to produce reservations please see below:
Vacations 4 You Memberships are fulfilled through Arrivia, Formerly SOR Technology, which is a very credible vacation fulfilment organization that has been in the vacation wholesale industry for nearly 2 decades. The Wholesale Travel Database is the same fulfillment database for most popular discount from retail websites that are widely popular on the internet for travel. The exact same pictures for our reservations are the same that you would find on the popular websites like Travelocity, Expedia, etc.

We at Vacations 4 You will continue to provide an over the top experience for our Members and guests. *** may contact our team at any point to provide clarity on reservations, assist in making reservations and ensure that she receives the best experience when taking vacations through our platform. Also, she may reach out to us directly to find a resolution for the $100 food voucher in which she received from the call center.

Listed below contains details with for the purchase from Mr. *** and Mrs. ***. Review was performed by Vice President of Sales, Marketing & Operations for Vacations 4 You, Nashville, . Upon review of the complaint from Mr. ***, I have attached the Signed Membership Agreement with Vacations 4 You. This Membership Agreement was signed by Mr. *** and Mrs. *** on Sunday, January 31st, 2021 during a scheduled, in-person meeting, at our offices at 401 Church St. Suite ***. Nashville, *** XXXXX. During the in-person meeting Mr. and Mrs. attended a group presentation that gives an overview of the product that we offer to our clients. This workshop goes through the many details of our program, its benefits and features including any and all fees that a Member may pay during the course of their Membership, if they choose to become one. After the Workshop, Mr. and Mrs. met with a Member Specialist, one-on-one, to further discuss options and pricing of purchasing a membership with Vacations 4 You. This is where our specialist goes through our product in more specific detail, including going over the $*** Annual Renewal for the second (2nd) time during the presentation. To provide the BBB as well as the Member more clarity on the Annual Membership Renewal: This is a $*** Renewal fee that gives assurance to our Members that the Technology in which they are using to book their reservations, exists during the entire course of their Membership. This fee is the only additional fee that is paid on any and all Memberships with Vacations 4 You and every Member using our program, must pay it. However, this Annual Renewal is only paid on years in which the Member actually uses the Membership and the charge is paid by the company, for all Members, on the first year. Attached, we have provided the signed Membership Agreement for Mr. and Mrs.. Please note on page 6 of the Membership Agreement the highlighted areas (Noted Below): 1. Statement regarding the annual $*** renewal. 2. First year renewal waived. 3. Renewal can be paid for with reward credits. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) Many issues are being brought up with this response. First, you have the incorrect people you are speaking of. As my name is *** and my wife is ***. Second, my wife is the only one who signed the contract. Third, even with your long-drawn-out response and incorrect customer information, there is STILL NO MENTION OF RENEWAL FEE on this customer's signed contract or my wife's signed contract. You state that a large amount of time was allowed to discuss the agreement as well is "Its benefits and features including any and all fees that a Member may pay during the course of their Membership, if they choose to become one" yes you do not have that listed anywhere on the signed agreement. At this time you have provided no proof that this information was given to us. We have recorded conversation asking the rep if there are any other costs or fees, in reply we were told no this amount you are charging today is the complete total. So if you always tell everyone about these annual fees, wouldn't you have reminded the customer about those fees? As we did not see them anymore on our signed contract.

We do have record of this guest coming into our office on July 23, 2021. The guests received their trolley tour tickets as promised. The consumer mentions hearing ***, but the consumer doesn't explain the claim so we have no ability to address the concerns that the members have about their experience. The only records we have to refute these claims is the audio and video recording of the contract signing that clearly states that there is no cancellation period with the contract as well as a section that clearly explains that any oral representations are not able to override the signed contract. We have no records or documentation that this consumer was promised 48 hours to cancel, nor did the guest bring that up during the contract signing when we discussed the no cancellation policy. Due to the change in the contracting, the member didn't complete their signed paper work so they are not active members in our system. If there is any good faith measures that we can make with this consumer we would welcome that dialogue.

We have emailed the *** and never got an answer. Letter to *** was what he said to write so we did and he would present it to ***, ***. I did not trust him so I sent letter myself. We called *** yesterday since he did not get back with us and he said he would get back with us. Has not as of yet, we will probably have yo call him like before. Thank you. *** and

Business Response Our Vice President has been trying to get in touch with this client for the past week. He had a scheduled call with her and she never answered our responded. We are looking for a way to work it our with this client. Is there any way you can communicate with them before we go through the whole response process? I called back and left a message about what I wanted to do ( close my acct) ( return my deposit). As of today I have not heard back from them. Business Response We would love to reconnect with this consumer. We have tried multiple times to reach the consumer with no luck. We can schedule a day and time again that fits her schedule and timeline.

All proof sources are attached that are referenced in the complaint. I would like to address Mr. complaints one at a time. 1. "The company used my credit to try their web page and services." a. This is an incorrect statement. Mr. came to our office on and became a member with us on October 1, 2020. While here he filled out a credit application to finance his transaction with us. The credit application is attached and was filled out by the client, signed initialed by the client, and a full signature from the client. At this time, he also gave us his driver's license as proof of identity. It is very clear; Vacations 4 You only used the consumers credit with his full knowledge and consent. Copy of credit authorization and copy of driver's license is attached. 2. We sold the clients information a. We have never and will never sell our clients information. 3. "I decided to cancel." a. This is another incorrect statement. Here is the evidence to support: i. Our memberships do not have a cancellation period. The consumer signed and was made aware of this in multiple sections of our agreement. In Section 4 of the membership agreement, it clearly states in BIG BOLD FONT, THIS AGREEMNT CANNOT BE CANNCELLED OR TERMINATED BY THE MEMBERS, THE MEMBERS WILL NOT RECEIVE A REFUND AFTER EXECUTING THIS AGREEMENT AND MAKING PAYMENT PURSUANT TO ARTICLE 2. ii. Also, in Section 4 it states that if the loan is financed through a third party, and the loan is defaulted... it does not void the amount owed on the contract. b. So for the client to say "He cancelled" the agreement is false as he was made well aware in writing before executing the contract that he couldn't as well as making financial payments towards the purchase. In this very BBB complaint, He also states over a month later, he didn't want to cancel the account, and again in January over 3 months laterhe was still a member with us and not cancelled. We received zero communication from Mr. until January 4, 2021. This is when we received the BBB complaint just days later. 4. Client was "SHOCKED" when *** Financial Services informed him, they were his finance company. a. Please see the signed and attached financing paperwork from the consumer. *** Financial Services was his finance company from day 1. He signed a *** Financial credit application, and *** Financial financing paperwork. Vacations 4 You was very clear and transparent that *** Financial Services was his finance company for the transaction. i. Client placed, signed, and authorized *** Financial Services to charge him his monthly payments. b. To be even more clear and transparent, right next to the consumers final signature of his finance paperwork, it even has a NOTICE TO ASSIGN, where not only does it give *** Financial Services full name but even their address for any questions and concerns. 5. Consumer mentions the new company- a. We are not sure what the consumer means by this. There is no new company that the client is associated with. 6. Consumer mentions a Reservation number: a. The consumer not only has not cancelled the agreement, but he is also in fact using the product and has multiple points of engagement using the product. 7. No savings or availability: a. We have remarkable savings up to 95% off other online, public access websites. We have several proof sources and available reservations that prove the opposite of what the consumer says. b. We have the same availability as all other public access websites. If it is not on our platform, it is not available anywhere else. c. The reservation that was completed for one of the members guests (***) was an 11% savings. 8. Fees: a. The only fee that was charged to the consumer was a cancellation fee. This cancellation fee is clearly stated before all reservations are booked. 9. 3-day Grace period a. After reaching out to ***, they are firm with no such comment was made to the consumer and they acknowledged they know we have a 0-day cancellation period. b. However, even if there was, the client adamantly agrees that he did not begin wanting to cancel his contract until January which is 3 months from transactions date. 10. Member stated he can't get in touch with anyone. a. We track and log all communications with all members into our office and into the reservation office. b. It looks like he has spoken to a representative on 6 different occasions. c. During these times, the client even added an additional member to the account and asked different usage questions. Ultimately, the consumer is in vast default of his contract and his agreement that he willingly made under no high pressure or coercion. Vacations 4 You has over 650 members and have over a 98% member approval rating. Vacations 4 You feels this member is simply experiencing feelings of buyer's remorse as many of the client's complaints fully contradict a previous one. Vacations 4 You would welcome the consumer into the office for a product review to get a better understanding on how to use the product and get the most out of what he purchased. My sister credit score was not up to par. *** had *** contact me because she informed my sister when she came back she could take over the payments. *** stated I had 3 days to cancel and the company provided the password days later. *** states I communicated with his company several times. False, when I purchased the password *** she stated we could cancel. She called me and asked what could be done, because she knew I never was in agreement to contracts. She told me its like a time share. *** is covering up because he told *** to charge the whole 7000 on my card day of sale and they knew my sister was going to the military so she was not able to cancel. As I stated soon my sister came in from training I told her this place had bad reviews there scammers, and the hotels never confirm if you get a room or not.the only communicated time took place the day I found this unknown on my credit report. I tried to reach vacation 4 u due to the party involved saying they can only be removed if there tell them to remove it. So *** sold my contract and my information to this company. *** has *** and *** confused with this purchase. I never said I was needing and item from the company. My sister said she wanted to check it out but had to go to basic training. *** and his team took advantage of her in the moment of dealing with leaving to the military. *** told me to put it on my card it would be 179 a month until my sister could figure out her finances from the government. I said I can give my sister the deposit and then cover the 179 till she returned. So *** and team stated keep this payment on the same card for 2 months before you switch it over to *** or another card. *** and company are trying to use my great credit because he never saw the credit card before. There cancelation period doesn't even allow you to check the web page out because once you purchase the password *** takes 7 or more days to get them. So how can you cancel in 3 days. I reached out and this office only called because they where informed by the ***. Of involvement. I myself never wanted there services, and like the lady stated it could be canceled. This company left out details of 3 days. They left out this will be my company and password *** able to switch and put *** name on this contract. *** is responding trying to make a profit with his documents saying I signed, but not once stste they verbally stated everything differently than there contracts. I didnt actually mean to say , use my credit card for there web page. I was referring to the company is selling me a password *** 7000 dollars saying there cheaper than other companies. They may be 3.00 cheaper and I informed them why would I pay 7000.00 just to save 3.00 on a trip. Why purchase into this company, when you book a trip they can't confirm your rental reservation until a week before. I can use other companies and get a confirmation say day of payment. These were things I recognized and then I waited on my sister to come in town to let *** know this was not going to be something she could use. Just to find out this was something I could not switch out of my name. Verbal communication can't be traced and the company they sold the contract to stated that. So *** should be honest as I am being completely honest. I provided my card and information to this company thinking my sister could sell vacations as a business. I was waiting on her to arrive to go to vacation 4 u to set her card for payments , but thats when all this became disruption. Business Response 1. I understand that it was your sister that was marketed in for a presentation and due to her credit worthiness, she asked you to put this financing in your name to which you agreed. Vacations 4 You had no stance in your decision to act on behalf of your sister. 2. Mr. references *** numerous times in this complaint, we don't have any associates nor have ever had any by that name. I do not understand who he is referring to. 3. Mr. claims that myself, ***, stated he had 3 days to cancel. I have never met or communicated with Mr. in any capacity, except for these *** correspondence. 4. Mr. mentions "She" said its like a timeshare, we are nothing like a timeshare, so I am struggling who he is referring to with "she" as all of our associates no we are not like a timeshare. 5. Mr. is stating myself, ***, told them to pay the entire balance on that day I have never met or had any interactions with Mr. except these *** communications. 6. Mr. again mentions when his sister returned and mentions reviews This is nearly 3 months after the transaction and we have a *** star review on *** with over *** reviews. 7. Mr. again mentions we sold his information as mentioned in the previous response we have never sold his information to anyone. The financing is set up the same way it was on the date of purchase and the product is the same as the date of purchase. The contract that was attached to the previous response validates that both of those partners were clearly made aware with Mr. upon signing and NO information has been sold. 8. The statement regarding taking advantage of her with leaving for the military will not be addressed as it is extremely false. Due to your sisters credit worthiness, we were actually not going to contract with her as a member, that is when she go you involved to out the financing in your name versus hers. However you handled the repayment of her using your credit for the financing until she returned is a conversation between you and your sister and should not involve Vacations 4 You. 9. Mr. again mentions 7 days before receiving login to "cancel"... we do not have a cancellation policy and that was signed by the client. Even if there was a cancellation period, Mr. admits on multiple occasions throughout this complaint, there wasn't "concern" regarding the transaction until months later. 10. Mr. states, "the lady said it could be canceled". All of our signed contracts state the complete opposite of this claim. If it was promised at that time why did Mr. sign the contract? 11. I have no reason to state anything other than what information has been communicated to me by the sales team involved in his transaction and the signed legal binding contract executed by Mr.. As a signed document supersedes all and we have them for manners just like this to protect the consumer as well as the organization. 12. Mr *** states he did this so his sister can sell vacations as a business, when in fact our contract clearly states in Section 6. Miscellaneous, that the consumer is purchasing this for their own personal use and enjoyment and not for commercial purposes. Vacations 4 You stands by our program, our contract, and our commitment to allowing the *** family to benefit from their 3 main reasons for joining from Schedule 2 of their contract, which is to save money, take trips, and spend time with family. Our program will accomplish those things. For Mr. to use terms like covering up is not close to what are principles are as an organization. We will continue to honor the contractual obligation signed by Mr..

Business Response I am writing pursuant to the above referenced complaint filed with your office. I am the *** of Vacations 4 You, LLC ("V4U") for business and other matters. The following will be a concise response to Ms. ***-*** ("***-***") complaint. Brief background information will help you understand the issue. V4U provides its members with cheaper, wholesale prices to vacations. Membership packages vary in price but generally cost between $5,000 and $10,000. Members will receive access to the discounted vacation prices for 10 years as long as they pay a yearly renewal fee of $199. To access the discounted vacations, the members simply login to the V4U's portal and shop online for the perfect vacation, which can be discounted as much as 95%. Like most of its competitors, V4U does in person sales and offers financing. ***-*** requests that her contract be cancelled. Initially, the point of a contract is that you can't cancel them at will. ***-*** is a competent adult and is assumed to read all contracts that she signs. Most importantly, the contract provides in several locations that it is not eligible for cancellation. The contract at issue is only five (5) pages long, and at the top of page three (3) in all caps, bold and underlined font it provides "NO CANCELLATIONS." Right below that, in bold 'small caps' font it reads: "THIS AGREEMENT CANNOT BE CANCELLED OR TERMINATED BY THE MEMBERS. THE MEMBERS WILL NOT RECEIVE A REFUND . . . ." Schedule 3 to the contract is one (1) page with one (1) paragraph, which provides in pertinent part, "any cancellation will not be eligible for a refund . . . I have not been the subject of any coercion, high pressure sales . . . ." Jones-*** signed this single page along with the contract, making it an enforceable and binding contract. In conclusion, V4U believes it has an ethical, valid and enforceable contract with ***-***. Despite this, V4U has agreed to cancel her contract if she signs the mutual release of future claims enclosed herein. By doing so, V4U is releasing itself of its right to collect its profits it is entitled to from ***-***.

Business Response I would like to address this complaint in sections to ensure each of the consumers concerns are addressed: 1. Guest feels misrepresented and the validity of our business and product is in question- Based on the consumers response, I am not aware of what part of our product or services she feels are not valid. None of our presentation is based off of forecasting or examples. We are 100% live on our website throughout the presentation and we show exactly what they get if they were to join. Everything they see is 100% live availability and able to be booked by our members. As the moment of this response, since June 1, our 502 members have logged on our service 2,902 times and have booked 278 reservations. If our product didn't work, that member activity, nor their reservations would be possible. (all proof sources directly from our control panel is attached.) 2. *** told her memberships are between $12,000- $15,000. Was shown $24k and then fast talked" down to $5500- We begin our time slots with a small group presentation. In that presentation, our presenter discusses that we have different memberships for all types of travelers. We have expensive packages, and we have very small packages, and the AVERAGE COST is between $12-$15k. The first package we show our clients is our largest package. We are fully transparent with our guests about the ability to change, adjust, and custom build packages based on their individual needs. With the changes to the membership, based on her needs, and a military discount, her package did indeed total $5,549. As far as being "fast talked", our records indicate the consumers credit card was charged for her down payment at 11:12 am. With the clients interaction with us beginning at 09:30, that means she was with her sales agent discussing our membership, packages, offerings, and our product for nearly 2 hours. I would not consider that "fast talked". This member then went through an entire paperwork signing, that detailed the transaction. In this signing, on "Schedule 2" client signs and agrees in her own handwriting and signature, that all of her questions were answered and we exceeded expectations. This contract is attached. 3. Client states she had to decide today- Like many retailers around our country, we offer sales and incentives for guests to do business with us while they are here. They can join with us today, tomorrow, next week, next year, and forever. We do offer extra incentives for our guests to do business with us on their first visit, however, it is not mandatory or forced. If the guest wishes to have the extra benefits and discounts, we encourage them to join. 4. Scam- Please see the statistics from our members that are actively using their memberships above. We are not a scam. We are a locally owned and operated business that promotes family values and enjoying life through travel. The fact that this client is struggling internally with buyer's remorse, or her own self-proclaimed ability to change her mind later after research, directly from her complaint, simply does not give this client permission to call my staff, product, or organization a scam because we are standing by the signed contract she agreed to when becoming a member. We pride ourselves in being a valuable resource for people to travel reasonably and responsibly. 5. No cancellation and the client thought it was referring to cancelling a reservation In our contract, we specifically address the members ability to not cancel their agreement 2 different times. Once on Schedule 3, it clearly states the cancellation clause. It also requires the new member to sign that they understand it and were NOT subject of any coercion, high pressure sales, or other misrepresentations associated with the transaction. It states it for the second time on Section 4, of the Membership Agreement. Nothing regarding vacations or reservations is in either of these sections. This makes her claim of what she thought the cancellation policy was, simply not possible. We have it in our agreement in 2 separate places to ensure there is no confusion. We have verified with numerous agencies throughout Tennessee and attorneys that we are not required to have a cancellation period as we do not fall under section ***. § XX-XX-XXX because Vacations 4 You doesn't operate nor negotiate their agreements as a buyers club and are not a buyers club in any capacity. Nor, ***. § XX-XX-XXX as we are not a timeshare, which we specifically discuss on the presentation. As to the guest's phone calls placed into the office, it specifically states in the agreement how all notices and disputes should be handled. The way in which this client handled her concerns, doesn't follow any contractually obligated procedure in which the client agreed to. Between ignoring cancellation clause twice, and the notice and disputes, it simply appears the member feeling that the contract is not to be followed or honored, which is why the member is resulting in trying to be released from her agreement in this matter. As on organization, again, for the second time, we get confirmation from the client in the final paragraph in our contract, in ALL CAPITAL LETTERS and it again confirms, there has been no coercion, high pressure, or other misrepresentation. The client signing this for the second time simply means she was not coerced, high pressured, or misrepresented. 6. We gave the client our attorneys information- This is a correct statement. When the client was speaking to our receptionist regarding her membership, her direct supervisor instructed her to share with her our organizations attorneys name and information, as the member had a question regarding her contract. During these phone calls, she said she was going to come to the office and meet with one of our sales leaders, however, she never showed up. She instead, decided to post false inaccuracies about our organization on *** and BBB. 7. Our business is a fraud and misrepresentation- I hate that the client feels this way regarding her transaction. She is wrongly accusing us of misrepresentations and using slanderous terms and words like Fraud are simply not true, or appropriate. The attached contract and agreement lays out everything multiple times, line by line that supports 100% against those statements. The Vacations 4 You staff is full of amazing people who love their clients and help the city of *** get on vacation! It is unfortunate that with the over 1,600 guests that have come in for a presentation, the 4.6-4.9 ratings on multiple online review sites with hundreds of positive reviews, sponsorships of numerous youth and initiatives around our community, over 10,000 website logins, and the over 500 families that have joined, that this guest would use words like fraud, scam, and more over simple buyers remorse is disappointing. I was completely misrepresented, we obviously have different versions of how this played out and if the business is that concerned with their rating why not just let me out of the contract? I am not going to use the service that they are trying to hold me to for the NEXT 10 YEARS. I did not say I was coming to the office to speak to a sales leader I said I would be by the office to tell the next customers for their presentation what has happened to me so they don't fall for it. I chose to use *** and BBB (for now) instead. We DID NOT discuss zero chance of getting out of this during the meeting. I have been trying to get out of this since day TWO of signing. There are WAY BETTER deals online than your website offers. I plead to you again, to let me out of this contract as this marriage is not happy for either of us. Business Response Once again I will address these concerns one by one. 1. We have different versions of how this played out: I am simply going by the signed contract from the client with clear and specific information on the uses of our product. 2. Trying to hold you to for 10 years: We have multiple package offerings. The 10 year membership is the one you chose to join. 3. So other people don't fall for it: I am not sure what you are referring as people "don't fall for it". We are an amazing organization that gets families on vacations daily! Since you slanderously called our organization a fraud through BBB, we have had our members book another 46 reservations. Your claims are simply not justified or appreciated. Attacking and threatening a company that has signed documentation for everything we are discussing, simply isn't the answer. Threatening your way to get what you want will not be accepted. 4. We DID NOT discuss zero chance of getting out: We have your signed signature on two different documents that say it was discussed and you understand. Please check your paperwork, or the verified documentation that we uploaded with our response. 5. Let you out of this contract: If you would like to reach out to ***.com we can discuss possible resolution options. I was lured in under the pretense that I would win a one of three prizes. When I mentioned the (alleged) Ford *** the presentation briefer laughed at me and told me "yeah sure we keep those on the roof" Then to discover the free trip is actually $350 to get to use is just the beginning of their crimes against innocent consumers. They have said that the company that lured me in was a third party entity and they had no control over that. If Vaca4You hired this company and they are using their name it most certainly is a reflection of Vaca4You. I have no desire to maintain in this contract. The service is not worth the $5500 they convinced me was a great deal let alone if someone was to pay the $24k they originally offered. I have never heard of a deal you do not have a grace period to get out of. I have since received a copy of everything I signed (after multiple requests). I get it, I was taken advantage of and I have learned a lot about contracts and reading everything. EVEN PAGES YOU NEVER SEEN. The "no Cancellation" clause was well hidden on page 3 of a 5 page contract filled with legal jargon. This entire business is a scam and I will continue to tell everyone and use every virtual means possible to expand my reach in an effort to prevent this from happening to anyone else. I have been trying to get out of this since day 2. In their last response they said to contact them via email for a resolution - I did that day and have yet to hear back.
