My wife goes to Chicken Express here in Huntsville Texas [protected] at about 5pm to get us supper for her, I and 2 grandkids. $50 bucks... gets home and the extra rolls she "Paid" for wasn't in the bags. Then see a 3.5% non cash adjustment. I drive back up there, get the rolls and asked about this 3.5% charge... just like the gas stations if you don't pay cash they charge you. I thought it was against the law for them to pass their discount points to you, besides that it was a debt card and they aren't supposed to be charged for debit cards... I thought debit card was supposed to be like cash... What BS! Won't be going to hacken express again. On top of that, they didn't put the corn nuggets she "Paid" for in the bag also, I wasn't driving back up there again.
Tex. Business & Commerce Code Ann. §604A.001 et seq. (2015 Chapter 113)
(a) In a sale of goods or services, a merchant may not impose a surcharge on a buyer who uses a debit or stored value card instead of cash, a check, credit card, or a similar means of payment.
(b) This section does not apply to a state agency, county, local governmental entity, or other governmental entity that accepts a debit or stored value card for the payment of fees, taxes, or other charges.
Surcharges cannot be imposed on debit cards or prepaid debit transactions per Visa and Mastercard.
Can you apply surcharges to debit cards?
No. Surcharges can be added to credit cards only.
Chicken Express - Attitude
I spent over $50.00 bucks. I asked Rickey to separate the chicken because it was going to separate houses. He told me he wasn't gonna separate nothing. He told me I was gonna take it like he fix it.
