On [protected] my daughter, who is employed by Wendy's, called me to report a 25 year old Hispanic female was attempting to assault her. My daughter is 16 years old. Neither the manager or assistant manager attempted to defuse this situation. Neither would speak with me concerning this situation. I am filing a police report documenting this incident. This incident happened at 2077 E. Highland Avenue, San Bernardino, CA. I employee in question left the Wendy's and fled the scene.

Desired outcome: Both the Manager and Assistant manager should be fired, as well as the employee committing the assault.
Forgive me, but I have some questions regarding the complaint.
Does the 25yo Hispanic female work for Wendy's?
Were the manager and assistant manager aware of the incident?
I am not familiar with California law but, where I am, a 25 year old assaulting a 16 year old is a criminal offense. One is an adult and one is a minor. Attempting to assault may or may not be criminal, but it is a hostile work place. This would likely be a civil matter that you may be able to pursue.
One of the problems today is in racially charges incidents. The attacker can claim they are being harassed because they aren't white, which makes the management and the company unwilling to do anything. One argument is that management didn't know about the incident.
You might be able to contact an attorney and see if you have grounds for a civil case against Wendy's. At the very least, have your daughter change jobs, for her safety.
This is a while from when it happened, but it turns out my daughter was lying. She was written up and the Hispanic employee was the one who reported her because she broke the rules. So she lied and said he attacked her. I found out when she confessed to a friend.
She even made false claims of him sexually assaulting her.
