Stacks Nursery Delivery Gone Wrong

As a lawn care and landscaping company, we purchased 15 yards of mulch and had it delivered to our client's house. We had used Stacks many times in the past and never had an issue. The delivery guy called to get directions to the property, and we didn't hear anything else, so we assumed everything went fine, as it always has in the past. That afternoon, we got an email from our client telling us the mulch had been dropped up against the vinyl siding of the house, so we immediately went to move it. When we got there, we discovered they not only delivered it against the house- leading to staining that we will have to pressure wash in hopes of removing, but the truck had cracked the driveway, and they had damaged a 20 ft palm tree in the yard. The client has painters working at her house, and they explained to us that the guy delivering the mulch got the bucket of the dump truck STUCK in the tree, which resulted in the top of the tree being BENT. We took photos and went this morning to talk to John, the owner of Stacks, about the problem. After giving us the run around for a good half hour, he told us they can't be held responsible and tried to tell us that something must be wrong with the TREE. Needless to say, we won't be using them ever again, and may have to take legal action if the trees die. DON'T USE THEM. They will NOT accept responsibility for their mistakes!

Stacks Nursery Failed to Honor Warranty

In Sept 2009, we purchased 3 palm trees from Stacks Nursery. We paid to have Stacks Nursery plant them so that it would be done right. We had a warranty on the trees. In April, 2010, the palm trees came out with green growth and were doing well. The first of May, we noticed that one of the trees started to turn brown; subsequently it died. We called Stacks to ask about our warranty to replace the tree; after multiple phone calls, we were finally able to talk to John (the owner). He told us the tree died because of the bad winter ("winter kill") and the warranty was no good. We discussed our concerns with a couple other companies that sell palm trees and received confirmation that if trees come out green after the winter, it was not due to winter kill. We have given John Stack the opportunity to come look at the tree and to at least talk to us about our options, but he has not done that. He was at two of our neighbors homes recently, and he would not walk the few feet over to see our tree. Our neighbor even mentioned that he should at least look at the tree; he didn't. We spent a good amount of money at Stacks and planned to spend more, but we will not spend another penny at his business. In fact, we are telling our story to others and warning them not to use Stacks. After a few conversations with others who have done business with Stacks, we are not the only ones with problems with Stacks Nursery and will not be using them either (I wish we knew this before we bought the trees from him).

After our experience with them today, this doesn't surprise me.
