RE: FORMAL COMPLAINT

Dear Management:

I have a formal complaint against your company for an employee's reckless driving, violation of State Laws, and intentional emotional anxiety caused by his reckless driving.

On July 17, 2022 at around 1:07 PM I was leaving the Fair Land, Indiana exit in Shelby County, heading back to the City of Shelbyville, Indiana. Its approximately 5.3 miles from the Fairland, Indiana exit to the first Shelbyville, Indiana exit.

I entered the highway (I-74 eastbound), driving on the right side catching a speed of about 80MPH when I viewed a Blue Van riding the left (passing land) and would not get over. I proceed cautiously, passing the van from the right side as he maintained his speed of about 75MPH in the left lane. I looked over and noticed a white male, with blond hair and a light blue shirt looking down and texting on his phone. I got off the exit (Shelbyville, IN) as did the van. We met at the light, with him in the left lane and me in the right lane, waiting for the light to turn green, and he remained on the phone looking down and responding to his text. The light turned green, I noticed the number [134] on the van. As we proceeded to the inner town of Shelbyville, the van veered to his right, into my lane, causing me to swerve to avoid a collision, throwing my service dog on the floor and my being scared I felt as if I was going to vomit. I slowed my car down in pure fear of being hit by this van and drove the remaining way home slower than the van.

Having Stage-Four Multiple Myeloma Cancer, COPD, and Congestive Heart Failure, this near accident has caused me severe stress, anxiety, and emotional turmoil.

It’s not fair that a driver of Peterman Heating and Cooling feels its necessary to text and drive, violating State Laws, nearly crashing into my vehicle, causing my service animal to be thrown onto the floor, and being sick for the remainder of the day because of his poor choices while driving.

This driver violated Indiana State Law pursuant to: I.C. § 9-21-8-2(a) and (b). I.C. § 9-21-5-9. I.C. § [protected]:

A vehicle proceeding at less than the normal speed of traffic shall be driven in the right-hand lane except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn. Indiana requires vehicles traveling slower than the speed limit to travel in the right lane to provide for a better flow of traffic on the interstate.

This driver also violated Indiana State Law: Indiana Code Title 9. Motor Vehicles § [protected] Sec. 59 . (a);

A person may not use a communication device while driving.

Finally, not only is texting while driving dangerous, it is against the law. On July 1, 2011, it became unlawful to type, transmit, or read e-mail or text messages on a communication device while driving in Indiana. Violators may face fines of up to $500.

I am prepared to post this complaint online and every available media outlet, including the News Broadcasting Stations with a request to do a segment on unsafe driving by companies in Indiana. A copy to the Department of Insurance, and the Indiana Attorney General’s Office with a complaint.

This young man, driving your company vehicle and texting and driving while on the highway or any road violates the laws in the State of Indiana. His distracted driving nearly caused our vehicles to crash, causing severe injuries to me and my service dog. His untrained skills while driving a company vehicle warrant immediate disciplinary actions.

The Community needs to know that Peterman Brothers Heating and Cooling permits its company employees to text and drive in their vehicles, and the community should stop utilizing your services since this is happening.

No Indiana company should feel that it’s ok for an employee to text and drive, and nearly cause an accident because of his distracted driving.

I am demanding that Peterman Brothers Heating and Cooling compensate me for my fears, stress, and anxiety caused by this incident of its driver in exchange that this matter is closed here and without any further actions or activities with this complaint being released to the public. I am demanding a settlement in the amount of $3,500, a day's worth of feasible compensation for the torment caused by this driver.

This offer voids on July 25th, 2022.
