I got my puppy last December. Since then, I have been requesting my dog's parent lineage information to prove my dog was F1. I wanted to breed my dog, and I asked about it to salesperson. The salesperson said I could breed my dog and she would get me the parent documentation before I made decision. After I requested again about the documentation, the salesperson sent me two pictures of dog.

My Dog was advertised as F1 and I verified with the salesperson that my dog was F1 (I have her email as well). If my dog was F1 as the salesperson explained to me, my dog's parents should be 100% Bernese mountain dog and 100% Poodle, and they should be AKC registered dogs (as they described in Q & A). If my dog is F1, she should be 50% Bernese and 50% Poodle and I could register her to several Hybrid organizations such as www.nationalhybridregistry.com. I requested several times for documentation, but Happytail did not provide any documentation. They did not even reply to my emails after they said they could not provide those documentations because my dog was mix (hybrid). Per UCC regulation, I understood the seller need to show proof what they are selling if the buyer asked.

Since they did not provide me any documentation, I had to do my dog's DNA test to prove she was F1. The result was she was NOT even F1 (Hybrid) dog.
A different breed was found in her DNA. Obviously, this is a breach of contract and breach of the implied warranty of merchantability. I went to Happytail because registration or parent lineage is important to me. I went to Happytail because they are the retail pet store with a Secretary of State ID. I thought the registered pet store sold only pure AKC dogs and Hybrid dogs whose background were traceable. If they are selling mixed dog of more than two breeds, they need to let customers know that their dogs are mixed breeds BEFORE purchasers make decision. They cannot put a deceitful advertisement on their website. If they advertise their dogs are Hybrid, F1, F1b, F2 etc., they should have a valid evidence to provide truth.
