I am appealing to you to help me recover $1,500 from the Hair Club for a hair growth device that I had to purchase even though I never used, opened, or requested it. Like lots of people, I joined the club out of desperation because I was told that I was losing my hair and had scheduled an appointment for my first treatment. However, on February 15, about three weeks after I joined, I learned that as a Federal new hire employee, I was about to lose my job due to downsizing. That same day, I contacted the Hair Club and requested that my membership be cancelled.
On February 22, Erica, an expert from the Hair Club who diagnosed my hair issue and signed me up called and said the appointment was cancelled, and I was released from the membership contract. Then she added, “But you still need to pay for the device.” “What device,” I thought. Then I remembered this had to be what was in the bag she gave me when I joined the club. Sadly, when I opened the bag, she had given me, I saw the device and the “no return” message printed on the label. However, because of how my membership was obtained, please waive the charges and let me return it for a refund. PLEASE READ MY EXPLANATION BELOW:
Last December, after I moved to Virginia for the new job with the Internal Revenue Department, a cosmetologist told me that I was losing my almost waist-length hair due to alopecia that was enhanced by extreme overprocessing from my previous cosmetologist. She said the overprocessing was also leading to alopecia. On Saturday, January 25, out of desperation, I drove 200 miles to get a second opinion from the Hair Club.
Erica, the Club’s expert, confirmed the diagnosis, and said my hair condition was worse than I had imagined, and permanent hair loss would result if I did not let them begin treatments immediately. Hearing that, I pretty much “lost it. A few minutes later, I was signing a bunch of papers. Despite being extremely upset while signing, I recall her telling me that my payment was confined to one bill and I was getting a federal government employee discount. Then she handed me a bag with something in it and said I could use it right away or wait until I returned on Saturday, February 22 for my first treatment
Two hours later, I arrived home, I put the bag on the dresser as I had less than two hours to pack and join my co-workers on a flight for a three-week new-hire training in Texas.
When I returned from training on February 15, I called the Hair Club to get a PDF document of everything I signed. Later, that same day, my supervisor met with us new hires to inform us of the orders she received from the Trump administration to lay us off by sections. After the meeting, I informed the Hair Club about this and was successful in ending the membership.
While I am extremely grateful to Erica and the Hair Club for releasing me from my contract, I am asking that they allow me to return the hair device for these reasons:
1. Even though the Hair Club was honest about the contract facts, it should consider my emotional state when I was signing the membership documents. I was crying so hard, I could barely see what I was writing.
2. None of these documents were explained to me. While signing, I also remember that Erica was constantly talking to me about the bad condition of my hair and how they could help.
3. As an African American woman, who does not have “good” hair like a lot of black women, or those who have a non-black parent, my mother taught me how to take care of my hair, as I got older. So up to now, I have managed to keep it at near waist length. That was until I moved to Utah, and was so exhausted from work, I trusted a hairdresser at a J.C. Pennys. I moved from Utah to Virginia. I said this to let you see how upset I was when I signed this document.
4. I was unaware of President Trump’s lay off strategy at the time as I was preparing for training, and didn’t know how quickly my life would change.
5. I am single, and I left my family to move 500 miles away to get this government job. Also, unlike the IRS employees who volunteered to resign or retire, I will not receive any severance pay, extended salary, or extended health benefits because I am new.
6. My finances are crucial. There is no future job lined up yet.
7. While I was still trying to get the Hair Club to let me return the device, I was audited by my boss and ordered to pay the $1,500, or I would not qualify for any future government jobs.
I know that I most likely cannot prove anything about the emotional stress I was under or any other details when I was signing the contract. I also thank the Hair Club for the compassion they showed for cancelling my membership. However, please help me in persuading them to go the extra mile and let me refund the hair device. I am in dire need and don’t know where I will end up before I find another job.
