I was experiencing a hardship and my mortgage was behind in payments. I spoke with my FBC mortgage company and was granted a partial claim for the past due amount owed on the account. Two weeks later, I was notified by the state that I was approved for HAF to keep my home. I have been in constant contact with the Morgage company and their higher management team about my loan. I have asked on several occasion to back off the payments that were applied to the past due amounts from the funds received by the HAF, remove the late fees which should not be on account since I have accepted the loss mitigation options given, and apply to the loan. They filed the second loan with the local county on 11/15. Per Regulation X Real Estate Settlement Procedures Act, amounts that the borrower may delay paying as described in paragraph (c)(2)(v)(A)(1) of this section do not accrue interest; the servicer does not charge any fee in connection with the loss mitigation option; and the servicer waives all existing late charges, penalties, stop payment fees, or similar charges promptly upon the borrower’s acceptance of the loss mitigation option. (3) The borrower’s acceptance of an offer made pursuant to paragraph (c)(2)(v)(A) of this section ends any preexisting delinquency on the mortgage loan. Desired outcome: I would like for them to back off misapplied payments for months 06/2022 thru 09/2022, update the new mortgage payment to 1999.07 per partial claim terms, and remove fees since pc was accepted.
