In 2004 my now ex - husband had built a new home in Bethel N. Y for our family. His credit was maxed, as we were trying to sell our previous home, and that mortgage was in his name only, which prevented him from borrowing any more money.

I put a mortgage in my name November 2004, from Equity Now inc. that my husband had organized for $301,000. Part of that mortgage had to pay off a company that provided high interest money to build the home. Equity Now inc. transferred the mortgage to Fremont.

In November 2005 my husband organized a refinance with Sommerset Mortgage Bankers for $399,000, the mortgage was transferred to Chase Home Finance

In 2008 I called Chase inquiring about a modification, and was told that I had to stop making payments in order to qualify, and that an appointed manager would send a package to get the modification started.

I received the package in August 2008 and started the process, unfortunately there was always something missing, or incomplete that would cause the process to start over. In 2009 I received a foreclosure summons, and during a mandatory conference I produced a letter from U. S Bank National stating that they were the foreclosure bank. The Judge ordered a motion or a Stay for 1year, until the law firm could provide proof of who held the mortgage. I didn't get notified from the law firm or the courts in reference to the court ordered Stay.

In 2013 I received a letter from Chase stating they sold my mortgage to Select Portfolio Services, even though I was still providing all necessary documents trying to obtain a modification, within the letter there was accounting information in reference to a surplus escrow in the amount of $325,000. I called Chase to ask if the surplus could go against the mortgage, I was told that I would have to be current on payments first, and SPS would have answers to any questions.

In February 2018 I received a letter from SPS stating that my home was being sold at the courthouse in March, with know regards to all modification paperwork I was submitting to SPS. I was in shock, and was not aware of the foreclosure that had taken place in 2016.

While trying to find out what had taken place at the county register office I found a document dated 2010, and backdated to 2007 that Equity Now inc. sold my mortgage to the foreclosure law firm for $1.00, naming U. S Bank National as the note holder since 2007. With further investigation I found out that the document was Robo signed. I’m not sure how Equity Now inc. became involved in the mortgage, but I do know that my home was stolen, I can’t find legal help willing to get involved, nor do I have the money to pay for a lawyer. Seeking Justice and advice.

I’m not too sure how or why! But It appears that my complaint has been altered!

Chase Home Finance (whom I received the only foreclosure notice from in 2009 has been replaced in my complaint with Chase only)

I recently found out from a google search that Chase Home Finance is a mortgage broker, and according to a former attorney with Chase she was forced to turn a blind eye on the types of mortgages that Chase was bundling to be securitized. Not all of the mortgages were rated as described before being offered as investments.

If someone out there can explain why my complaint has been altered , and why.

Can a mortgage broker securitize a mortgage?

Sommerset (second refinance 11/2005)is listed with MERS, as representing Sommerset Mortgage Bankers,but on the title insurance documents it shows Equity Now inc,listed as the mortgage broker for the second refinance. It’s no wonder why I can’t find a lawyer to represent me! Is it the complexity or is it the emails sent? Documents found at the county registry shows 2 mortgages issued to me on the same day 12-26-06 by EQUITY NOW INC.Now that’s Bold, but the closing documents shows Equity Now inc. obtaining $18,000. And I received a check for $2.87/ now would anyone in there right MIND refinance a mortgage so that the mortgage brokers (EQUITY NOW INC.) can extract the last of the homes EQUITY for them selves.

EQUITY NOW INC. DESTROYED MY CREDIT, STOLE ALL OF THE EQUITY FROM MY HOME, AND THEN FALSELY FORECLOSED ON MY HOME WITHOUT MY KNOWLEDGE, now I no they could not have done this without help . Now I need help to bring these criminals to justice!
