Dongguan Fanyu Hardware Machinery Co., Ltd review: Bushing special cold forming machine

We are an American Company, North American Trade, LLC. I would like to tell you about the serious breach by a Chinese company Dongguan Fanyu Hardware Machinery Co., Ltd. (Chinese name: 东莞市繁宇五金机械有限公司).

On June 3, 2021, our company entered into a Sales Contract numbered SC-FY20210603-CF (hereinafter referred to as the "Contract") with Fanyu Company. The main contents of the Contract are as follows: our company would purchase a BUSHING SPECIAL COLD FORMING MACHINE WITH MOLD TOOLING of model FY-CF-S9 (hereinafter referred to as the "Goods") from Fanyu Company for a total contract value of USD 189,500; The terms of payment are 40% deposit and 60% balance to be paid one week before delivery. The trade term of the Contract shall be FOB and the loading port shall be Shenzhen port. The contracted delivery date is August 15, 2021.

On June 24, 2021, our company has remitted USD 75,800 to the bank account designated by Fanyu Company (Beneficiary: DONGGUAN FANYU HARDWARE MACHINERY CO., LTD.; Bank: THE INDUSTRIAL & COMMERCIAL BANK OF CHINA, DONGGUAN BRANCH; Account No.: [protected]). That is, our company has fulfilled the deposit payment obligation under the Contract as agreed.

According to the Contract, Fanyu Company should deliver the Goods to our company before August 15, 2021. However, Fanyu Company failed to deliver the Goods on time. Our company requested a refund and compensation for the corresponding losses via WhatsApp on January 2, 2023, but Fanyu Company refused to refund any money. Our company has made several attempts to communicate with Fanyu Company on this issue, but Fanyu Company has refused to respond. To date, our company has not received any refund due from Fanyu Company.

We know that you may a client of Fanyu Company and have worked with this company before. We understand that other companies may have also encountered similar issues in their dealings with this company.
