Crescent cove at coral Springs. Located at 8300 coral lake lane coral springs, fl 33065 www.crescentcovecondo.com.

On feb 12, 20007 My wife and I went to this community to buy a condo conversion where they offer 5%incentive for closing, 6 months of maintenance and other benefits. We picked a unit of 1 bedroom, purchase price $137,900. The Sale person told us that they required $3000 dollars to hold this unit. We give a check for this amount. I signed a sale agreement to buy the above unit. In the same office was National City Mortgage officer Julian Perez to whom we spoke about the requirement for qualification I let know him that I don’t have enough money for closing or Down payment, the reason that I was interested was because all the incentive, at that moment I gave him all the information require for a mortgage, I came back to the sale person John Rotger and ask if all this incentive were only If we go along with National City Mortgage, he told as that wasn’t necessary that we can go any where to get this mortgage. Then I went back to the loan officer Mr Perez I told him that I was going to try with citi bank where I’m banking.

From this time it took 2 or 3 week to get an answer where I was declined. I went back to city Mortgage to speak to Mr Perez he start processing this loan. It took some time to let me Know the I Don’t qualify, then he suggest to try with my wife credit, we go ahead and provide all the information, then the nightmare
started to slow the process the loan officer give me hard time to get in touch with him, when I had a chance to talk to him, was a different excuse.

At the same time I received a certified letter on april 03, 2007 where they notified me That I failed to perform 45 days under the terms of my agreement to purchase pursuant to paragraph 9 of the agreement the seller hereby deems you in default end retains my deposit of $3000. I went back with this letter to the sale office, I spoke with John Rotger he told me disregard the letter I’m going to give you another extension and I’m going to email the mortgage office. Finally after 2 months the city Mortgage comeback telling us that we need 10% down payment to qualify.

When from the beginning I told them That I don’t have enough money. So I request the letters where they declined the mortgage on the terms that we request at the end they told me that is nothing That I can do, they are entitled of retains my deposit.

Please tell me there are something That I can do to get back my money, I think this is not fear. Help on this regard if you need more detail I will be happy.
