Home Builder, RW Hertel & Sons of san Luis Obispo, CA built our home in the rancho Obispo Development today I learned most the homes have massive defects with Leaks, and TOXIC MOLD, my neighbor at 1720 Singletree Ct has Smith & Sons MOLD people at her home all day I asked what for and the pace Suit guys said the Homes are FULL OF TOXIC MOLD the builder concealed it from us renters and that the State has told the builder to re-do all 53 roofs since the entire development if DEFECTIVE and has MOLD.

We have been cheated and lied too by RW Hertel & Sons.

    This builder is not to be trusted nor are his associates and those who conceal defects etc.. this Company is involved with Pacific Improvement, LLC, Santa Margarita Ranch, LLC Santa Margarita Farms, LLC Hertel Group, LLC Mission Lakes, LLC MAJOR DOMO, LLC Santa Margarita Cattle Company, LLC RW Hertel & Sons, Inc. LOVR-SLO,LLV FATICO, Santa Margarita, LTD and the evil likes of Robin Rossi, Rob Rossi, Ron Hertel, Robert JS Fowler, Karl & Cindy Wittstrom, Douglas and Kathleen Filipponi all and more due a serious check on all these people before you think of buying any homes, land or investing they also built the Defective Rancho Obispo, El Jardin at Las Lomas and are doing THE INN AT EAGLE POINT, Oregon so be watchful and use caution when doing ANY business with these crooks after all Hertel et al is still under a Criminal Probe and Rossi under a Federal investigation as well.. SCAM's Hertel has now sued some of his own buyers who are low income people so be warned

    Ron Hertel and his firm RW Hertel & Sons are doing a PONZI Con and Scam let alone his builder shoddy homes so do a search and learn of his cons and scams.

    This is not a Complaint against RW Hertel & Sons. This is a notice to let everyone know that there have been slanderous and FALSE accusations made against the company and the owners. The man responsible for ALL of these postings online and in the press is satisfying a personal agenda against this company. There are numerous lawsuits against him. Unfortunately he can write anything he wants online. So instead of believing his rhetoric, do your own investigation. Talk to actual homeowners. You will hear a completely different point of view.

    FYI: The Company Environmental Mold Sampling whom some of the Hertel project Rancho Obispo owners used to determine that they had "toxic mold" in their homes, was run by Phillip Fry who is now living overseas as a Fugitive and is being hunted by the FBI for convincing homeowners they had "toxic mold" then committing Insurance Fraud. Don Bagert,of Paso Robles,who did the tests in Rancho is also being sought by the FBI for Fraud, he worked with Fry. Also, all homes built with wood have a small amount of harmless mold in them because all natural wood has mold spores in it. When the wood gets wet, mold will grow. The true "toxic mold" is VERY rare. It takes a very long time to grow and must not only have water but a source of bacteria. "toxic mold" is usually the result of "waste water"(from a toilet or garbage disposal) leaking for an extended period of time.

    Just thought this was a useful piece of info since Hertel is getting slammed for "moldy homes".

    More HERTEL leaks I come home for a late lunch and see Hertel's at it again more leaking roofs both attached homes that leaked last year are once again leaking Andrea and Heidi of 1773 and 1775 Tonini Dr. San Luis Obispo the Defective development of Rancho Obispo. When will the Nightmare of poor building ever end.. I am told they are both affordable homes and Hertel's man Max Samson was told by Jim Joseph Burns the Hertel project manager to cover it up and even admitted he himself would NOT live in a Hertel home he bought a CENTEX home so that says it all.

    The real issue is according to the three super's who did RANCHO OBISPO is they (Hertel) took short cuts and allowed cheap materials, crack head employee's and x-con's some have big NCIC RECORDS AS WELL. Then the PI on the insurance matter investigating Hertel for FRAUD, has several phone recordings of HERTEL'S people including one LAWYER ADMITTING THE Fraud's and Scams against the owners. Concealing the Mold thus allowing people to get ill. HERTEL'S two brokers quit and would not cover up the mold or sexual harassment by JIM J. BURNS the project manager who swings both ways...

    You really expect anyone to believe that YOU know 3 ex-supers of Hertel and that YOU have met with a PI and that YOU have all of this top secret info and that YOU know all of the higher ups in the city....Well I don't believe a word of it anyone who does needs to do their own research ( including 920 KVEC Dave Congalton's blog, read most recent entries). Then they will have a clear picture of what and who is posting ALL of this negative (and FALSE) info regarding Hertel. If they read the most recent entries they will see that there is a single man behind 99% of this. Yes, he had people believing his lies for a while, but the truth is coming out-he is being seen for what he is-a liar.

    I agree Hertel is a con man and a fraud as the records show this yet Eugene told me he has a crew going back to Rancho Obispo this morning due to more leaks on Hertel's defective homes. Chris, Dave and Steve all former Super's have now on the record stated the problems with Hertel and his well known building standards. I noticed the first thing that pop's up on a search of Hertel is a Public Release on Hertel from the CSLB.. Ouch that hurts

    Thank you for this web site, here is our story of Deceit by RW Hertel & Sons dba as Atascadero Ventures as El Jardin at Las Lomas. Our daughter is getting married soon so we decided as a wedding gift to help her and Andrew with a down payment on a home. They search S & S Homes, Trimark at La Terraza, Dove Creek by Centex and finally El Jardin at Las Lomas. As the kids were told by one sales person before you buy no matter who the builder is do a check with the Dept. of Consumer Affairs, Local City or County Building Departments, the Better Business Bureau, Local Realty Board, Builder's Association, Local Courts and the title company the builder uses or others. Finally check the WEB.

    We did and were shocked and were lied too by Las Lomas El Jardin the real builder is RW Hertel & Sons, the sales person lied and tried to get us to buy theirs we learned from all the above agencies and web etc.. RW Hertel attempted to lie conceal and cover up so thank you for this site and exposing them. My daughter bought in Dove Creek.

    My husband and I are recently retired and were looking at the Las Lomas Development for a new home. We asked the sales lady who the builder was and with great hesitation she answered Hertel. We got a weird feeling and decided to do our usual google search. We were appalled by all the complaints we found. We would like to thank all the people who took the time to tell there past experiences with this builders homes. We will definitely stay clear of any homes built by these guys.

    This is an article from a Local paper that was published last year. The man responsible for ALL of the outrageous accusations(named in blog above)didn't just want his roof fixed he wanted $$$ he brainwashed some of our neighbors into thinking they deserved $$$ too. The article is as follows:

    'One of the county’s largest home builders has offered to replace the roofs on all homes in a two-year-old San Luis Obispo subdivision in response to an inspection that followed owner complaints.

    R.W. Hertel & Sons sent a letter offering new roofs to homeowners in the 53-unit Rancho Obispo neighborhood after an independent inspector reviewing the properties raised questions about the long-term viability of the roofs.

    Hertel hired the inspector as part of an agreement reached with the Contractors State License Board last fall.

    'We stand by our product and want to assure the satisfaction of our homebuyers - today and 10 years from now,' said Hertel vice president Bob Fowler .

    According to contractors board spokesman Rick Lopes , the independent inspector found evidence of leaks in seven out of 49 homes but raised questions about the viability of the other 42 roofs that were checked, saying they might leak in the future.

    Hertel said it would remove the old roofs and replace them with entirely new ones, contracting the work out. If all homeowners accepted the offer, it would cost the company between $1.6 million and $4.8 million, according to its estimates.

    'We have built several hundred homes on the Central Coast,' Fowler said. 'We want every buyer to be happy with their Hertel home. We regret that this situation has developed and we are eager to help resolve it once and for all.'

    The board opened its investigation into Hertel, the first investigation the board has ever opened into the company, after homeowners complained that 27 of the homes leaked. That investigation was closed when Hertel and the board reached the agreement to inspect and repair the homes.

    The agreement between Hertel and the state also calls for the company to submit a repair plan addressing the complaints in the development, Lopes said. The board has yet to see the plan, which is due Friday.

    That plan may include some windows, Fowler said. Windows that are replaced will have an additional two-year warranty on them.

    Lopes noted that it is not unusual for a problem with one home to be repeated throughout a subdivision because builders will use the same design and subcontractors throughout a development. He added that he was pleased everyone in the project would have the opportunity to get a new roof.

    'They all paid to have a new home with a sound roof,' he said. 'We want them to have what they paid for.'

    The roof offer is voluntary, according to Hertel officials, who added there is no indication that every house in the development leaks but said they preferred to handle the situation proactively.

    A representative for the homeowners association could not be reached Tuesday'

    Hertel handled a bad situation thoroughly and professionally they do not deserve the bad rep. We are HAPPY with our home!!

I'm doing a story on the many RW Hertel Homes that are defective and his numerous defective Lawsuits.     I must say i do agree Hertel is a very troubled one all over the State and now i see he is suing his insurance company since they too realize he is a fraud and con man, in Federal Court Eastern District of California in San Joaquin file # 2007 CV-01054 Judge Lew i checked and found he lost if state courts so he is trying to file a case which is fraudulent but the good news is they are watching his every move this builder is horrible all over the State just do a check with State officials, City, County and even AP Wire did stories on his shoddy builder and scams to cheat home buyers. RW Hertel & Sons is nothing but a FRAUD and SCAM Artist Justice is coming his way.

    I was looking for a home with option to lease to buy, I found a few in Atascadero, CA named El Jardin at Las Lomas and others. Regina or Gina I don't recall the correct name was the leasing person after careful consideration she finally revealed to us the Homes have " Issues" when we asked about warranty options at the end of a lease to buy. She informed us the Builder RW Hertel & Sons has a History of building poor quality homes and has some legal problems. I asked if she was a Licensed Realtor she admitted NO, we did a BBB, CNN, Google and finally a due diligence search and well enough we learned the Builder has defrauded many home owners and is facing numerous State Investigations for building substandard homes and that his last big project in San Luis Obispo namely Rancho Obispo was inspected by CSLB investigators and Independent inspectors and that ALL the homes inspected were Defective and many have MOLD where the builder tried to paint over and conceal the defects so Thank you Board for your help. I hope any buyer of any homes will first check out the builder.

    RW Hertel & Sons PAY YOUR BILLS? Another sub contractor has another Lien against you and your projects so pay Petersen-Dean roofing the work they did just like Apodoca paving pay your bills no wonder why your name is in the pit.

    Not surprised RW Hertel Bob Fowler and there wacko Atty. Adam Daner have been lying for years. Look at the legal issues now coming up in another Hertel project which is defective as well. The Fairways at Sterling Hills they are going after Hertel as well so join the club of those who have been cheated by Hertel and Sons.
