I contracted Rick Breese who is the owner of B & B Fence Stain to stain my new fence in 5/12. He did a very splotchy, incomplete job. He also left stain on my pool equipment. He promised to finish the job on several occassions, but he never returned. I took Mr. Breese to court and was awarded a Judgment in the amount of $175.00 plus $101.00 in court fees. Do not contract with Mr. Breese! He does terrible work and is very dishonest!
The complaint has been investigated and resolved to the customer’s satisfaction.
Same piece of trash did this to us. He is a crook, and a dumb one at that.
Perhaps “victims” of Breese may bring attention to his crime spree to any number of local TV investigative reporters I have contacts with and would be willing to share with any of you? Maybe best to get legal attention by sharing this sad drama that goes on and on and on. Without doubt any number of local “investigative reporters” probably would jump on this story with the past history of Breese being shared. Rick Breese must be stopped or he will continue it would appear as the victims keep coming. NOT in my neighborhood as the he knows better then to probably step foot in Frisco again to rob people after my dealings with him in 2012/2013.
The list continues and so far the ONLY winner here is the guy who robbed any of you Rick Breese. I realize some of you who recently contacted me may still be trying to get legal interaction involved but some of you I know did nothing to try to legally stop him. NO one likes to spend time on this BUT until some or all of you make some noise to the DA’s or local police OR NEWS…………this habitual repeat offender criminal will continue to make HIS living off of un suspecting people like each of you.
Breese took a plea deal in 2013 i think it was for his "theft of services" crime. we compiled victims list that stretched over 5-7 north texas counties same thing: Took your money promising fence/stain work he never completed or started thinking he was covered under veil of protection of it being civil not criminal. Well he was wrong. YOU have to file police report for the crime theft of services. Then get a DA on Board to get IMPACT statements from any/all victims to show the pattern of theft is repeated as it was when we went through it. NEVER seeing a dime back fyi! IN collin the DA I worked with to get Rick sent to jail was Dustin Johnson who is not there now. IF your in Castles Hills area its Denton DA. SO I'd call in to the Denton DA or call COLLIN DAs office ask for Lisa King or Thomas Ashworth and ask them who to call in Denton DA's office. IF you do not take steps to stop him sounds like has has continued I have the reports coming back in. SAD...
Perhaps some local media coverage is needed re how this guy is just allowed to go on and on and on and nothing gets done. Mmight motivate some needed legal interaction here? Some of you who may want to try to stop him having no luck with police may go media route.
In closing, I am NOT the bad guy. I am the guy who offered to help (spend more of my free time on Breese) and would like to think every new victim of Breese would follow my suggestions to help stop him legally OR bring some media attention to this situation so legal will hop on this. If police do not get it re this “theft of services” and you are NOT getting any help from the Denton Das office, I would be happy to share “my story” from years back along with any of your own if you care to reach out to or me reach out to any local news resource I have contacts with? It may prove to be the most effective way to draw attention to this situation and to hopefully put a start to an end to it.
OH several of us who were victims to Breese fence scam did testify against him years back in Dallas at his probation violations hearing. Got to hear about his "Hydrocodone" addiction etc etc. Much when he was submitting his replies years back. Its all part of a court record now.
Very sad to hear he has been back at his old theft of services game ...it can be stopped BUT it will take some effort.

Hello, My name is David Snell and I wanted to update MY original post against Rick Swaynee Breese who I helped PUT IN COLLIN COUNTY JAIL IN 2013 after he took a plea deal when being charged with "theft of services". Over the past year, I have heard from NUMEROUS new victims from the Carrollton Castle Hills area who sadly have fallen prey to the BREESE FENCE scam again! (Rick hope YOU are reading too). Long story short Breese knows that what he is doing and has done is typically passed off by the police as a "civil issue" and it is the way he scammed people back in 2012/2013. Takes deposit money and end of the day you never get the work done and the excuses start blah blah blahhhhhh. Its called THEFT OF SERVICES and it is what he went to jail for already BUT clearly cheesy breesy is back at it. I have over 10 different reports from people he has scammed who reached out to me. As long as I know he is back at it I would gladly help help any new victim to try to get him arrested again. However please do NOT contact me unless you are willing to spend some time and get involved just as we did in 2012 to put a end to his crime spree then. HE ran his mouth and stole from me and as a business owner and President of a 600 home Frisco based HOA i do not take too kindly too scummy crooks like Breese ripping me or others off period and he knows it. To start you have to get the police to file a CRIMINAL REPORT and tell them of his history and if he has taken money BUT not done work and wont give it back its "theft of services". You may want to call up a few levels in your local police dept BEFORE they send some random patrol officer out. Tell them the story pull his history so they know what they are coming to do when they meet with you. THEN depending on what county you are in...you have to make some NOISE to the DAs office and any/all victims need to call in if scammed by him to share their story. Have to submit a 1-2 page Impact statement I think its called like an affidavit. Once the DA sees enough of these outlining this is a PRE mediated pattern of theft...they can go before grand jury and determine to "tru bill" it (bring charges) or not, Well in 2012 he was "true billed" and arrested. He took a plea deal and got I think a year? OH NONE OF US who lost money to BREESE ever got a DIME BACK so it makes me ever so motivated to help any of you legally stop him again and ASAP. IF needed I have a trunk full of local TV news media contacts I can provide any of you if you care to take this situation to the news to seek legal help if no ones helping. As for Breese and his JIBBERISH rants and delusional stories re me etc etc I am sure it had something to do with the Hydrocodone addiction we got to hear about in one Dallas court when he was brought in on past probation violations in Dallas years back. YES about 6 of us victims from fence scam testified against Breese in a Dallas courtroom where he was brought in for probation violations. WE never got the luxury to see him in Court in Collin as he took a plea deal. Smart he did as he didn't stand a chance against those of us who made sure to have our legal system deal with him the way they should have in 2012/2013. SO do you think it should take many of these reports to any DA to see he is back at his old tricks? NO should only take a handful and sorry to those burned BY him again. DA in Collin who went after him is now gone but latest reports I got were he was oozing through castle Hills neighborhoods which is denton DA. You can call Collin DA Lisa Milsky King or Thomas Ashworth mention Rick Breese and ask who to call DA wise in Denton as I have made both these DAs aware of Breese scams again. Breese used to get deposit checks from his victims ( OH clients!) and drive straight to the bank to cash them as fast as he could. NOT for supplies... just so he had our money and then the rant of excuses started. Breese blowing in the wind. His past list of victims stretched over 6 or 7 north Texas counties fact NOT fiction as I made the list and collected the stories. Sad it continues hope he is stopped soon. Now he is double cashing checks made out to what he said was his company, Bauer Contracting. Anyone who has given this man checks made payable to Bauer should check their bank account immediately! This is happening this week.
For a guy who can't spell worth a damn, he sure can figure out how to try and cash the same check three times. Found his mugshot online. Just search his name, Collin County, theft, mug shot and there ya go! Such an upstanding individual. His parents must be so proud.
Rick...for a guy who just got (arrested) for theft in Collin County it would seem as though some of these complaints posted by people including me may hold some truth! So smart as to go post bogus things re factual things re me/my businesses and sign your name to it! yet sue me thinking you have anything valid to dispute our on line complaints...sure explain why you just got arrested for theft re the fence/stain scams!

For anyone that may read these comments, hopefully you found this before hiring/paying Rick. My wife and I paid $500 as a deposit for a stain job that Rick never came out to do. After two weeks of Rick missing work dates, I asked for our deposit back. When Rick explained he had been busy with other projects and asked for a second chance (he was apparently all caught up at this point), I reluctantly granted him the opportunity. It took me another week to get Rick to return a phone call/email to set up a new work date, at which point he claimed he would need $150 more to do two sides of our fence that he apparently did not originally take in to account. The original agreement I sent him clearly laid out all portions of fence which were to be stained. I then, for a second time, asked for the deposit money back. This last request took place on 5 August, 2012, and as of today (23 January, 2013) Rick has made no attempt to pay us back.
My wife and I sued in Collin County small claims court and default judgment was awarded in our favor, but Rick has claimed he doesn't care what the court says. David, the individual Rick claims has "slandered" him, is simply another victim, just as my wife and I are. David and I have been able to track down 20+ other victims throughout DFW, so this is not an isolated incident.

Giving this a shot... David’s e-mail is blocked on here, but we are very recent victims of Rick. $600 paid in full up front he has gone MIA. We have been I. Communication with his Dad who hasn’t been any help either.
8 civil suits...multiple default judgments...victims over 5 counties...and BREESE does not like anyone coming after him but he will not stop it. Multiple victims are sick of his SCAM and getting away with it. He is under legal investigation and like most everything else that oozes out of his mouth...he would like to sway anyone from reading these post or believing them!

I contracted Rick Breese, the owner of B & B Fence and Stain in Leonard, TX to stain my new fence and swing set back in May of 2012. I made the mistake of paying Mr. Breese in full before he completed the job. He promised to come back within a couple of days to finish the job, notably to stain my swing set and touch up some areas of the fence. After promising to come on numerous occasions to finish the job (which he never did), I took Mr. Breese to court and was awarded a Judgment on 10-31-12 for $400.00 plus court costs from the JP of Denton County Precinct 2. The docket # is SC12-109J2. I have spoken with several neighbors who used Mr. Breese to stain their fence around the same time he stained mine (many of us put up new fences at the same time), and none of them have been satisfied. Mr. Breese has lied on several occasions and promised a 5-yr warranty which he later would not put in writing. Do not under any circumstances use Rick Breese or B & B Fence and Stain for any work whatsoever. He will tell you anything to get your business and won't keep his word.

Never been arrested yet i told you when you started our work...do well I can shower you in referrals/screw me over you will wish you never showed up here. Yea dude, I grew up with you. We played football together and I referred you to a friend of mine when she needed help with her fence. Not going to drop any names her but you know who I am. You are a scam artist, and you know it you try to skirt the edge of the law to avoid criminal charges. I ended up paying her back out of my pocket because I referred you. Is this still relevant 6.5 years later because Rick Breese is still at it. We were just scammed out of $600!
This POS got several of us in the North Carrollton area this spring. How is this not a criminal matter by this point?!?! SMH
We are working on filing criminal charges again. We need as many people as we can to help make it stick!
