Peroutka & Peroutka, PA / refused to accept monthly payments

A part of me believes this web site was set up by the attorney's office themselves trying to obtain information on each of their cases. But, I wll still pass on my complaint, someone in their organization will get this information again.

I responded to correspondence sent from Peroutka & Peroutka with the same letter over and over again. I explained that first, the balance was not $1602. Second, the balance was a dispute that was more than proven by me to Capital One that I returned all items purchased to Chadwick's (women's apparrel) via their return policy. As we are all aware, it is very easy to track UPS packages to see they were returned and received. My opinion is that Capital One contacted Chadwicks, who denied to credit the items, so Capital One held me responsible. I used the enclosed return forms per their policy. Therefore, since I followed their policy, I should not be held responsible for items lost in transit or in their warehouse. I spoke with Chadwick representatives that informed me the items had been received, but not logged back into the inventory. Does this mean that a Chadwick employee has found a new way to get clothing free. This should not be my responsibility. I followed the rules and now get stuck with this horrendous bill becuase Capital One does not want to battle this out with Chadwicks. The credit card company should be behind their card holder.

Third, I agreed to pay $15/month if they would reduce the balance to the actual balance due. I enclosed a check in the same amount along with two additional checks representing payment for the next two months. I have children in college and I am not in a position to pay money that I do not owe. I never received a response.

Now, I just received (2/19/10) a Wage Garnishment form in the mail (unsigned by a judge), that was sent to my employer over a month ago. This is the last thing I wanted. I do not want my wages garnished, not do I want this adversely effecting my credit. I have worked very hard to re-establish myself after a nasty divorce and trying to raise two children on my own.

This goes above and beyond what the normal middle class family can withstand. I have a credit card company that is looking out for the merchant and a lawyer that ignores all offers trying ot settle the claim. The more they collect, the more fee they collect.

    I got the same thing from Peroutka & Peroutka... an unsigned garnishment form.

    This simply tells me that they are trying to scare us- you and me- into exceeding our limits in the ability to repay.

    The garnishment form that is sent to you doesn't have to be signed by a judge. The garnishment form sent to your job has to be signed by a judge. The form sent to you in the envelope is just a copy of the original garnishment they are sending to the district court in order to be signed.

    I have been through hell and back with this lawfirm. But one thing I know for certain. Capital one is behind all this. They are actually clients of peroutka lawfirm and the lawfirm is simply hired for captial one to collect as much money as possible WITH INTEREST. Mine was Sears card however. But it's the same ballgame pretty much. Peroutka will take almost any small payment, problem is capital one (or sears in my case) wants their money and will only accept a certian amount for payments. Capital one will say they've washed their hands of this but the fact is they are still making a profit off of the debt that peroutka is working for them.

    i'm also dealing with these [censor] .i was sent court notice for a garnishment notice that was sent to the court and now they have a wage garnishment on me taking my money, i tryed to deal with peroutka law firm . i was making payments until the irs levyed my accounts i even sent them a check which they sent t back to me. so is there anybody out there that can help me solve this problem .thanks ps by the way a judge never signed the form .

    I AGREE, AGREE, AGREE with everything said about Peroutka & Perouka and Capital One. I always paid all my credit cards on time for over 20+ years that I have had credit cards. I was never ever late but approximately 2 years ago, Iwas forced to choose between paying my mortgage/daughter's tution payment or the credit cards.
    This was due to circumstances that was totally beyond my control.Capital One and Peroutka & Peroutka came after me like a pack of rabid wolves. I originally made arrangements with them but could no longer afford to pay them after my house went into forclosure. My mortgage comapny was very willing to work with me and offer me a MOD on my 1st and a generous settlement offer on my 2nd(both with same mortgage co) offering to take approximately $7, 800 on a $28, 000 balance. I was never made any offer of a settlement by Capital One or Petroutka and Perouka. I guess it easier to go after you with a wage garnishment and they also tacked on over $3000 in attorney fees when no other creditor or attorney's office handling for cerditor has done that. I also rec'd a wage garnishment writ without mine being signed by the courts, only the copy from my employer was signed.
    This firm and Capital One needs to be investigated. They also increase the amount due on their statements sent even though it will say total balance due but it keeps going up and up.

    Just fell upon this compliant board about Peroutka & Peroutka and Capital One. Fully agree with all arguments made about these two entities. Wont' call them companies or businesses because this is not how you treat responsible people when all they are trying to do is correct the financial shortfalls we're all experiencing.

    Does anyone know whether or not some sort of class action type suit exists for these two entities -- Peroutka/Cap. 1?

    I received the same writ of wage garnishment not signed by the judge recently. Sent a stern letter after they called my place of employment, but never provided work # or any details about employment. I got blindsided after I made an agreement with them for the first judgment (Cap. 1 Visa) with a second one (MC) days later. Complaint to them in a letter explained how I would make payments for that point forward "All accounts/files you are collecting a debt for". After paying for a year plus (doubled up on payments to save on checks/postages and the like) received the garnishment threat.

    I need help in dealing with these folks (thugs) any suggestions are much appreciated.

    I would advised you to call them back ASAP, otherwise they're likely to proceed with with a judgement. They're abrasive at times but if you let them know that you are well-versed on your consumer rights they seem to ease up a little. But, still very difficult to deal with. Good luck!
