I will try to shorten this review in hopes that every would-be client reads this and has a much better experience than my family did.
We were referred to Burgos & Brein to help obtain VA A&A Spousal Benefits for my elderly mother. My sister and I had our initial Zoom with Gaberial Burgos back in Jan 2024 to go over the items on the check list and see if Mom qualified. Gaberial spent an enormous amount of time with GREAT detail on what actions needed to take place in order for Mom to qualify and still stay in her home and receive $1500 a month. In depth instructions were given on how to move money from her account to pay myself, make sure everything is kept separate in case of an audit, on and on... you get the instructions.. wink - wink). He continued through the checklist and said mom would definitely qualify. "Our fee is $2000, and we will walk you through the process."
After a family discussion we felt that we would have been deceitful and dishonest pursuing this aid, as we felt that Mom did not meet the criteria at this time and we would reach back out when the time came to file. FAST FORWARD TO APRIL 2025...
Mom has been diagnosed with Alzheimer's Disease and is in need of Memory Care. I reached back out to Gaberial and did another Zoom on 4/9/25. (A year and 4 months later). He again assured me that Mom was a qualifying recipient, and I paid him nearly $2000. He said a case manager would contact me and go over the paperwork via Zoom. 3 days later on 4/11/25 Grace and I had a Zoom call, and she discussed all the paperwork that needed to be submitted. We DID NOT get halfway through the list when she asked if Mom had ever been remarried. I answered yes and she immediately said I'm sorry, but she does NOT qualify. I was dumbfounded that this very important part of the initial checklist was NEVER asked nor discussed while I listened to Gaberial's lengthy requirements on 2 DIFFERENT Zoom calls.
Had I spent 15 minutes researching the 4 M's of receiving A&A spousal benefits I would have known that Mom did not meet those requirements. That was a very expensive mistake. My Dad died in the line of Duty in 1981 leaving 4 kids under the age of 6. My mom remarried nearly 15 years later for a short time. This disqualified her and we COMPLETLEY understand that. Case closed! Yet, Gaberial skipped over this required information twice!
3 days after paying nearly $2000 dollars and a heated exchange with Gaberial who did not want to admit any wrongdoing and only wanted to offer $1000 refund, we are more than disappointed with this firm. No refund was issued at all. We hope this review will help others. We will be filling additional complaints with appropriate parties as well to save another family from losing money that is much needed during this very sad chapter of life.
