Business Response We have reached out to the customer upon receiving this complaint to assure them that we do still have open work orders to address the items described. Due to the current COVID-19 situation, to protect the health and safety of our customers and our employees, as well as maintain compliance, our warranty service team is only able to address emergency items and exterior work. We apologize if we did not effectively communicate this to these homeowners, but we have since conveyed that message and confirmed the work orders will be addressed as soon as conditions allow us to safely resume this type of warranty work.

Business Response This home was constructed in 2013 and the one-year builder's warranty concluded on 7/30/14. The homeowner contacted us first by phone and then by email on May 12, 2020 to report the situation and ask us to make repairs. The customer service representative who communicated with the homeowner explained that the home was out of warranty but forwarded the information for review by our management team, which is a customary part of our resolution process when a request falls outside of the warranty parameters. Following review by several members of our management team, we followed up via email on May 13th and provided a written response to the homeowner. We indicated that the appropriate management had reviewed his request. We noted again that the home was constructed in 2013 and the one-year warranty coverage on workmanship and materials had concluded on 07 /30/14. We explained that we understand that sometimes information arises outside the warranty period that causes a customer to bring a matter to our attention, but that time constraints and appropriate notifications are material conditions of the warranty. As a courtesy to the homeowner, we offered to help repair the hole in the pipe, but indicated that this was the extent that we would be able to get involved. The homeowner responded to our email with an angry phone call to the customer service representative, for which he did subsequently apologize, and left an additional frustrated voice mail for a member of our management team. In follow up, our Warranty Service Manager reached out to the homeowner by phone, ultimately suggesting that he consult with his homeowner's insurance about the damage to the interior of the home. It is our understanding that the homeowner was extremely vocal in his anger and verbally abusive with that person as well. We realize that with people under stress disagreements may become somewhat heated. However, we fully expect and hope that our personnel will interact with customers in a polite and respectful manner, and if we fell short of that we apologize. We do ask that the respect and courtesy be mutual. We believe that we have provided a clear response, as well as an explanation, and we understand the homeowner does not agree with our response. The offer to help repair the hole in the pipe is still available at this time, if the homeowner would like to accept it, but we have nothing further to offer with respect to the rest of the repairs. It took 7 years for the pipe to fill up with enough of a root system to flood my house with sewer. The worst part of it is that they didn't even come by to for me to show them how it was damaged. Negligence is much different than a warranty issue. I would not be able to live with myself if I caused a customers house to flood with sewer from the actions of my crew. It is clear that Ball Homes only wants your money and gets out of the customer service end as soon as the warranty expires. I am dumbfounded that the BBB lets them have an A+ rating when there are websites dedicated to how horrible customers have been treated by Ball Homes. Google, has horrible reviews. Yelp has horrible reviews, yet the BBB allows their best rating. I repaired the pipe myself and will hire someone for the flooring, but I will make sure this story gets out to the public ASAP. No one should have to live in a house that has a distinct sewer odor and every piece of flooring warped. We have shampooed the carpet numerous times and can't get the smell out. We have been stuck in this house at a time where we are being told not to leave. We have taken a hit with our normal pay, and now we have to pay for this out of pocket. So in no way, shape or form do I accept this useless, thoughtless response. People need to know what they are really getting when they purchase a Ball Home. The pain and suffering we have never happened if they would have checked the subs work before moving us into the home. No one should ever have to go through this again. Again, your response is just as expected. You are an embarrassment to this community and this is a perfect example of when a company gets too big to care about their customers. Business Response We have reviewed our customer service records and confirmed that the home is currently under warranty and that we have received the customer's 6-month review list of 50 items on 3/4/20. Due to the COVID-19 restrictions and health and safety concerns we have not been scheduling non-emergency work in occupied homes, so we have been unable to review the list with the customer. We have spoken with the customer several times since receiving the 6-month list letting them know that we do have the list, we do have work orders and we will schedule them once the restrictions have lifted. At this time we simply have not addressed most of their concerns yet. As restrictions are being lifted, we are about to begin scheduling in-home work again with appointments beginning June 1, and prioritizing those customers who have been waiting during the period of restrictions. Customer satisfaction is very important to us. We are committed to resolving customer concerns whenever possible, and to addressing items according to the parameters of the written warranty. It is our hope that being able to review the list in the home with the customer and make a determination on their requests will provide us with the next steps toward a resolution. Most of our issues were reported and noted LONG before Covid-19 (we knew they would try to use this excuse). Why do we have unpainted walls, stickers on our walls and tile since BEFORE moving in? These were all punch list items created 9/4/19. Ball didn't suspend INDOOR repairs until March 2020. The water issues were reported in November. The OUTDOOR water issues (one of our top issues) requires no INDOOR interaction with the homeowner(s). Meanwhile construction continues ALL around us while we live in a swamp and have to partially bathe our dogs multiple times a day due to our back yard swamp. They won't even replace my street light...it's been reported to them "4" times. Please leave this case open until they resolve ALL of the issues that THEY created. This has cost us so much additional time and money. We just ask that they do the right thing and honor their commitments and warranties. I'd like a completion commitment date or for them to allow us to take these issues into our own hands and hire folks to fix these issues at THEIR expense. Business Response While there is some information about our process and warranty intervals that can provide additional perspective on the complaint, we do feel that the best next step is review the items with the customer at the home, as suggested. We now have a meeting scheduled for June 1oth with the customer and we are happy to continue the conversation at that time. We still have water issues in our garage and in our yard. We extended the foundation drain to help stop our lawn from washing away and we expect FULL reimbursement for the tubing, rock and dirt (we are absorbing the labor, grass seed and water costs). We had no choice but to repair as we were loosing our yard and our dogs were able to escape under the fence. It's been almost "10" months and not one single thing has been done about our lawn. We still have the water issue in the side yard that has created a soggy trench that is destroying our fence. Water is now standing under our totes, file cabinet and freezer in our garage and when it turns cold our garage door will freeze to the floor again and we won't be able to lift the door again. We also have the eye sore I'm the brick at the front of our home where a large hole was filled and the mortar was not acid washed and the soffit was bent. Ball did send someone out to touch up the bad Sheetrock but simply left us with about 1/8th of a quart of ceiling and trim paint to repair our chair railing, ceiling and sloppy paint on our baseboards and cabinets ourselves! If they will fix the Garage and side yard water issues, Acid wash the mortar on our brick, replace the bent soffit and repair the hideous scratches in our guest bath we will be done. Like I said above, all of the big things have not been touched and no arrangement has been made to resolve those issues. Business Response We are currently working to address the water issues in the garage by drilling a hole in the foundation, which we believe to be the appropriate next step. Due to recent heavy rainfall we do not yet have any answers on the success of that approach. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) We still have MANY items on our list and now new items appear almost daily. This house is very poorly constructed and there was conversation with the engineer that our home is possibly built on top of a spring. We spent close to $600 (just in materials), to repair one of the two water issues in our back yard. We could no longer wait on Ball Homes as our entire yard was washing out, our dogs were escaping and our plants were being destroyed by wild animals accessing our yard via this huge hole. Additionally, we still have the brick repair that was never pressure washed, the rutted out side yard, our neighbors down spout is directed to have ALL of their run off run into our side yard, our guest bathtub has at least 1/3 of the glossy finish missing, our bathtub faucet is still not properly working, our master bedroom commode squelches through he entire house when flushed, the garage still has standing water (which will again cause our garage door to stick and break when it turns cold), we still have places in our kitchen granite that was to be sanded and smoothed. They finally left us with about 1/2 cup of ceiling and trim paint to fix their errors for ourselves. However, when we fixed the ceiling mistakes we discovered they had either tagged the paint wrong or gave us the wrong color because now we have shiny large blotches in our ceiling. I can not begin to tell you the incredibly horrible paint job on our home. We paid an additional $1975.00 for egg shell paint, but these folks didn't even sand anything, and if they did they didn't clean it up and painted over it. The tops of all surfaces include clumps of debris and junk caked in the paint. Our baseboards, trim, chair railing, bookcases, cabinet doors and walls are a mess. Every surface is very rutty and rough. Looks horrible with the naked eye. This home is almost 1/2 a million dollar home and looks like low income housing. It's truly humiliating and embarrassing. We can't enjoy our retirement for all of the issues. We just want what we more then paid them for. We paid them CASH and paid 4K extra for a flat lot that they then graded part into a hill and directed others water to flow into. I haven't even discussed the many broken and missing items we replaced and fixed on our own or the fact that they laid the wrong brick on our home and used brown grout instead or grey on our home AND on our fireplace. Our refrigerator is defective and our dishwasher leaks! Everything is out of warranty! We paid a premium for all of these things and they got a kick back on it all. We were forced to use one appliance company and what a racket! My list can go on and on. None of these things were ever listed in my complaint so you can tell I AM NOT nitpicking. We are seriously so fed up! We just want what we were promised and what we paid them CASH for. We also want the items we paid to repair the one leak with reimbursed! We have ALL of the receipts. BTW...we found this week that our master shower head is not even connected to the wall! Can you imagine the water that has escaped behind our shower wall, and the potential damage? We have a huge hole in our wall where our light fixture has shifted in our guest bath too. It's truly every day! It's like the money pit! Business Response Due to the expanding nature of the customer's complaints and the fact that home is still under warranty, we will not be providing a detailed response but with continue to work within the parameters of the warranty and our internal process to identify and resolve any items that are covered by the warranty. With respect to the customer's general dissatisfaction, we always prefer to be able to satisfy a customer. We have well-defined processes during the homebuying and construction process that provide clear expectations and give the customer the opportunity to review the home during construction and satisfy themselves as to the quality and standards of completion. They have the opportunity to conduct third party home inspections. We also walk the home prior to closing and do a final review of the paint and drywall and identify identify any items that may have been scratched or damaged prior to move in. All this takes place prior to the customer closing on the home, which signifies their acceptance of the property. A moving in agreement is signed to identify any items that are not complete at closing. We then provide a written warranty and a six-month and one-year service interval to address any warranty items that may arise, as well as emergency service. When reviewing a six-month list or a one-year list we review each item submitted by the homeowner and provide a response and create a work order for those items that fall under the warranty parameters. Our process and our warranty are the same regardless of the price point of the home, as we believe all new home investments to be of equal value to the homeowner and importance. We do find on rare occasions that our process and new construction in general are not a good fit for every buyer. In the case of this customer, our records indicate we met with them early in the contract process to discuss expectations, as the customer had posted a negative online review before construction even began, based on her dissatisfaction with the sales and selections process. We explained our process and our role as a production builder and suggested that they reconsider whether our homes were the best fit for their needs. After discussion of our product and price point and the other options available to the customer, they indicated they wished to continue with the purchase. We are sorry that they are displeased with the outcome and with the home. We will continue to work directly with them to try to resolve any warranty work that is outstanding and see if we can improve their level of satisfaction. As usual Ball Homes is deflecting from the complaint AND the true issueS...they have sold and built a home that is subpar and has a gross amount of serious issues. Since they want to throw stones, I can do that too. I am far from being the only person that has issues with Ball Homes in "this development", alone. I have thread upon thread of post from other disgruntled homeowners on our neighborhood Facebook Page. Most everyone has some type of water and drainage issue as well as other serious service issues. Like stated before, even our common area has turned into a retention pond. Ball Homes resolution...when they complete Phase III they'll resolve the issue. Seriously?!?! Everyone is angry over this scape goat response as we ALL know they'll pack and run. The issue has been there for two years (SINCE PHASE I) began so WHY WAIT?! We can't even collect our mail or enjoy our pool for wading in contaminated mosquito ridden water. Our neighbors are calling the codes enforcement office and we are ALL going to let them know of ALL of our water issues. There are serious issues here. Our streets are lined in mud and water (even in 90 degree weather) from a lack of proper drainage. There is currently a brand new home (30 days or less owned) and heavy equipment has ripped their entire backyard apart because their home flooded. The guy next door to said home has the same issue and they won't even talk to him about it! I still have water coming up through my garage floor, water standing in my yard when it rains, sloppy brick repair on the FRONT of my home! It's humiliating and embarrassing for us to show our friends and family our NEW retirement home. It's a mess! If we have this many issues now what happens one to two years out when we have no warranty? Ball Homes is refusing to arbitrate because they honestly have no intentions of doing anything about my serious issues because they know they need to rip my garage out and install french drains in almost every yard in this development. Why are we "11" months into this and nothing in regards to the serious issues have been resolved and just keeps getting put off? Why do they try to deflect and stretch the truth and attempt to turn me into the bad guy? This is 100% their fault and they need to own it, fix it and do the right and honorable thing. They have ALL of my money, so give me what I paid for! 1. French drains need to be installed in the front, side and back of our yard. 2. Water Is still coming up through the garage floor 3. The large hole in our brick that was repaired still needs the mortar acid washed off 4. Soffit bent to repair #3 Is still not replaced. 5. Guest bath tub still has 1/3 of the finish missing. 6. Guest bath still has faucet issues where water does not flow smoothly and the Shower head leaks. 7. Master commode still squelches loudly through the house when flushed. Ball installed the cheapest builder grade commodes on the mrkt. We've had multiple issues with these commodes. 8. A large hole is in the wall beside the vanity lights in the guest bathroom, 9. The shower ring that is at the shower head and wall in the master shower has NEVER been sealed and water has been leaking behind the wall for 11 months! 10. ALL sinks have damaged drain covers 11. Granite in kitchen sink has crack and broken place at sink basin. 12. Extremely sloppy trim work, bookcases, baseboards and chair railing. It appears the wood was never sanded or was sanded and then painted over without cleaning first. 13. Crooked windows in the front of the house (plantation shutter installers had a horrible time upon installation). 14. Gutters are too small and creating poor drainage. Installed 4" gutters and requirements are 6". 15. Our home is disgustingly filthy outside due to the construction and the contractors dropping debris, hunks of rock and dirt clods all over our streets and driveways and no one ever cleans it up. It's a muddy, filthy mess all day every day! Trash is thrown in our yards EVERY day! There is no on site management or concern for the safety, well being or and respect or regard for the residents property. Once they get our money they could care less about service after the sale or keeping or neighborhood clean and safe. Cars race up and down our streets all hours of the day and night blaring loud Hispanic music and loud vehicles. It starts as early as 5:30 AM even on the weekends. 16. Water and mud stand along our curb and driveway from lack of a proper drainage system. This gets tracked into our driveways, garages and homes via our vehicles that must drive thru the mess. 17. No water pressure in any of our bathrooms or the kitchen. It takes forever to rinse shampoo out of your hair. There are many other smaller issues but you get the jest. As we explained previously due to Ball Homes lack of concern or follow up we were forced to repair the foundation drain they cut short on the left side of our home because our yard completely washed out and our dogs were escaping under the fence. We want a refund for the cost of materials. It was approximately $600. We have the receipts! We also want the rest of the items on our list resolved. Please keep this complaint on file to protect other potential buyers and homeowners. Business Response We will be reaching out to the customer directly to provide a written response to all of the items that have been submitted to us through the six-month warranty list, so that the disposition of each item is clear. A copy of that correspondence will be added to this complaint file as well. With respect to the customer's most recent response and the seventeen items listed, we would like to provide the following reply: 1. Request for French drains to be installed in front, back and side yards was presented as item #5 on the 6-month review list and was declined. All swales are intended to be within the easement and can not always be a perfect dissection of two adjoining properties. When our Warranty Service Manager walked with the co-owner, no standing water or remnants of standing water was noticed. We do not account for future fences in our grading of lots. Any fence installed properly should be held up off the ground per our recommendation and any standard fence building practice to allow that water to flow underneath. 2.Regarding the question of water coming through the garage floor (item#10 on the 6-month review list), this item was initially declined as items stored directly on the concrete floor can cause a wet area of condensation to appear underneath as a basic reaction to temperature changes and lack of air circulation. We suggested this as the reason because of the 100 odd plastic tubs on concrete floor. In an effort to resolve the concern, we since drilled a hole in the garage floor and found no water beneath, and then installed a foundation drain from the garage to the outside which is an additional step not normally required during construction. Any remaining moisture on the surface of the floor is believed to be condensation related to the way items are being stored in the garage. 3. Request to acid wash brick adjacent to brick repair, which is item #4 on the 6-month warranty review list, was declined. All houses are pressure washed prior to closing including all brick. The workmanship was up to our standard. 4. Soffit bent to repair hole in brick (item #3 on six-month review) was declined because no action was possible under the circumstances that would have improved it enough to meet the customer's expectation of being completely resistant to possible pest intrusion. 5. Guest Bath tub missing finish (item #5 on the six-month review list) was declined because it was not listed on the Move-In Agreement. As previously explained, the appropriate time to examine finishes and report defect/damages is before move-in, as afterwards such damages are not distinguishable from wear and tear on a lived-in home. 6. The issues described here with the guest bath faucet and shower head do not appear to have been reported to us in any prior communication that we can find, but can be submitted for review on the upcoming one-year warranty review list. 7. The issue described here with noise from the commode does not appear to have been reported to us in any prior communication that we can find, although we do show complaints of clogged toilets. The new item can be submitted for review on the upcoming one-year warranty review list. 8. The issue with a hole in the wall in the guest bath described here does not appear to have been reported to us in any prior communication that we can find, but can be submitted for review on the upcoming one-year warranty review list. However, holes in the wall that appear to be damage after move-in will not be a warranty item. 9. The issues described here with the shower head in the primary bath do not appear to have been reported to us in any prior communication that we can find, but can be submitted for review on the upcoming one-year warranty review list. 10. Damaged drain covers--this was item #46 on the six-month review and was approved. The work was completed by Superior Plumbing and the work order signed by the co-owner is attached. 11. With respect to the granite being cracked and chipped at the kitchen sink, we reviewed this as item #8 on the six month list and it was declined because it was not listed on the Move-In Agreement. As previously explained, the appropriate time to examine finishes and report defect/damages is before move-in, as afterwards such damages are not distinguishable from wear and tear on a lived-in home. 12. This item is a general workmanship concern. As previously stated, the appropriate time to address this kind of concern is during the walk-throughs of the home prior to taking possession of the home, which indicates acceptance of general workmanship unless specific repairs are agreed to on the Move-In Agreement. 13. The issue with the windows was reported as item #43 on the six-month review list but as the house passed all inspections, and shutters are installed, this is not an actionable observation. 14. The issue described here with the gutters does not appear to have been reported to us in any prior communication that we can find, but can be submitted for review on the upcoming one-year warranty review list. 15. We recognize that a subdivision under construction presents certain noise, traffic, and cleanliness challenges. This county is very strict about enforcement of road maintenance and street cleanliness and we have not received a notice of violation in as long as two years. We did perform cleanup promptly following last month's torrential rainfall that sent mud into the streets. Our standard working hours for crews are from 7am to 5pm in this community, although some framing crews may start a little earlier and are more likely to work on a Saturday. We recognize the construction activity is often inconvenient, but it is essential to the completion of every home, and we value the long hours and considerable efforts these crews put in under all kinds of weather conditions to meet our schedules. Should the customer feel that ANY music or speed from cars passing is excessive, the appropriate step would be to contact local law enforcement about the possible violation of noise ordinances or speed laws. 16. Please see above. 17. The issue described here with the water pressure does not appear to have been reported to us in any prior communication that we can find, but can be submitted for review on the upcoming one-year warranty review list. As indicated in #1 above, we decline the request for reimbursements of customer's expenses for electing to make drainage improvements after installing the fence directly against the ground and inhibiting the intended flow of water in the swales. As indicated, we are preparing a written summary of the six-month review and will follow up with a copy for the BBB's files.

Business Response We have reviewed the customer's complaint and researched our customer records and warranty history for the property. Our records indicate that we have communicated extensively with the customer and offered solutions to resolve concerns, but have not been successful in reaching a mutual agreement. It is always our preference to be able to satisfactorily resolve a customer concern if one does arise, and we are sorry that has not been the case. With respect to some of the specifics of the complaint, we would like to provide a summary of the resolutions offered to the customer during the warranty process and also provide some additional perspective on the situation. First, in regard to the complaints made about the quality of the paint job, we would point out that the husband of the customer who filed the complaint, the co-owner, painted the house himself and supplied the materials in exchange for a work equity credit and therefore that work was specifically excluded from our warranty. We have attached for reference a copy of the work equity agreement regarding the paint. Second, with respect to the customer's position that she was uniformed about the potential preference for a larger water heater in the home, we would like to clarify that we do offer an optional upgrade to the water heater during selections, at the customer's expense, and when the home has a garden tub or whirlpool we recommend it. However, hot water use varies widely by household and individual preferences and we do not require it. Because it is important to note when the customer does not opt for that upgrade, it is noted in contract to document the choice. Attached for reference is a copy of the contract addendum initialed and signed by the customer stating that the recommended upgrade for the water heater was declined. Third, we understand that there have been issues with the compatibility of the range purchased and installed by the customer after closing with the wiring provided. The customer opted to take a credit for the range included with the home and purchased a range after closing. The electrician has been to the house on multiple visits and confirmed that house is wired in a way that meets electrical code. The range the customer purchased pulls a higher draw than the standard range (it has a convection oven) which causes the breaker to flip. The way the microwave and range are wired does meet code and works for the vast majority of ranges. We have offered to run an additional line for her stove as a courtesy but it would require a small line on the outside of home, which we offered to paint to match the siding, but she declined. Fourth, with respect to laundry room, the customer has asked after closing for a separate breaker for washer and dryer, which our local or state code do not require, and we have declined. Fifth and finally, the drainage concern has a work order in our system to be reviewed after rain. At this point we have not witnessed water standing 48 hours after rain, which is the applicable warranty standard for deficiency. We will continue to monitor the drainage and if a deficiency is observed we will take appropriate corrective action. We understand that the customer disagrees with some of the resolutions we have provided and we regret that we have been unable to reach a greater level of satisfaction. We will continue to work with the customer to review and address any issues that may arise that are covered by warranty during the balance of the warranty period. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) First I will say yes we have communicated extensively and that's not the problem. The problem is we have communicated extensively about problem after problem in this brand new home. The issues are either not getting fixed in a timely manner or they attempt to fix and it's not fixed and these are big problems. They cut corners and the quality is terrible and honestly I don't know how Ball Homes gets away with this. Ball Homes has completely ignored and manipulated the fact I said I was not properly informed about our hot water tank to question it so the contract was innocently signed.So once again this is how your tricked when you don't know any different to question it.This contract is irrelevant based on my complaint. Ball Homes had also lied in response to my complaint. They stated I declined a separate line to be ran for my microwave and stove. Actually a separate line was ran and the problem was never resolved. The breaker flips when I heat up a biscuit in my standard microwave. The stove is worse now and will not work in wall outlet at all, I have to plug it into the counter outlet to work. Ball Homes stated they do not have to put the laundry room on it's on breaker. I'm trying to figure out how this is ok. Who in they right mind would think it's ok to just not do something like this not do it the right way because they don't have to .This is a 323,000 house and it's not right or fair that we are left with these problems. We have paid more then enough for our house to be wired appropriately to work with any standard appliance. Ball Homes also lied about the standing water in our yard, I did report it once before the 48 hours after rain but then I also called again some time later on to report the problem so they were also well aware and notified again after the 48 hours. To this day we still have a pond in our yard and it has never left. The only solution for this problem right now is that we get put on a list to get it fixed, how ridiculous is that.We have 3 kids and they can't even play in the yard.My next step is to report it to the water company. Not only are we dealing with these big problems in our new house but now Ball Homes is discriminating against my husband. My husband was a contractor with Ball Homes at a few rental properties but when I complained to BBB Ball Homes retaliated against my husband. It's my right to reach out to the BBB if I feel it's needed and honestly my husband new nothing about this. He is not tired and frustrated like I am dealing with this so he is not in this. So *** from Ball Home management called my husband one week after my complaint to the BBB questioning my husband. After that a week later Ball Home had a meeting to discuss their dirty work on what to do with my husband. *** from management then called the rental properties my husband paints at and told the property managers we are no longer using my husband anymore and to hire a new painter. This is a discriminatory act and this is illegal and unfair.I think everyone should know how crooked and cruel Ball Homes is. My husband worked for Ball Homes for 5 years and he was very loyal. The properties loved his work. And the only excuse *** has is that they switch contractors often. That's a lie and I have proof they usually only switch contractors if they are in need of a good painter. The only one not upset or bothered by this is ***, everyone else such as property managers and coworkers at the properties are upset by the fact that *** is doing my husband like this. God don't like ugly and these people are supposed to be church people.I honestly never thought these Ball Home people could be so cruel and discriminate against my husband like this. Business Response We will continue to work with the customer to resolve any issues in the complaint that are determined to be covered by warranty. Specifically, the reported drainage concern which we previously agreed to review, and the operation of the range circuit. Customer service has clarified that our electrician has a work order to further evaluate the range circuit operation, and will contact the customer to schedule that directly. Non-emergency work orders in occupied homes were temporarily suspended due to COVID-19 restrictions and health and safety concerns, but have now resumed. With respect to other, new statements made by the customer here and on social media, which we dispute, our legal counsel has contacted them directly regarding the inaccuracy and false nature of these claims. Again like I said before we have communicated and communicated about problems in our house and the point of me complaining to the BBB is because we are not getting anywhere with it. And it's not because of Corona. Yes, they have attempted to fix the microwave but it's not fixed and they said they wasn't going to do anything more with it, I have proof in my email from customer service. The whole point of me complaining to the BBB is due to the poor quality of our Ball Home and the unresolved consistent ongoing problems with our home. Yes, Ball Homes has communicated but that's it, we are not getting anywhere with taking care of the problem in a timely manner. MY yard is still not fixed and we have been communicating for over a month through the BBB and not only that this was mentioned when we closed on the house almost 6 months ago now.So this proves how Ball Homes is not loyal to there home buyers And the fact that Ball Homes makes too many attempts to fix something and it's not fixed. And actually we shouldn't even be having these big problems from the get go.So the fact that you say you are working with me is irrelevant, it does not fix the ongoing problems. How about making sure your new home buyers get the respect they deserve and stop cutting corners when there home is built.So Just do the right thing, instead of not doing the right because you don't have to because honestly I think it's hurting Ball Homes more then helping.Ball Homes gets more bad reviews then good and there star rating is very poor. You may dispute the fact that I said Ball Homes illegally discriminated against my husband because at the time, I innocently thought my husband had more rights if we could prove Ball Homes retaliated against him. Once I talked to my attorney, I learned differently and that was my mistake. But what I will say is everything I said about what *** did is true and I will not change my word on that and Ball Homes will not manipulate me into changing the truth in my complaint. I have contacted the BBB to delete the term Ball Homes illegally discriminated and that's it.And even though what Ball Homes/*** did isn't illegally discriminating, it is inhumane, cruel and very unprofessional. Business Response At this time the two remaining items from the initial complaint that we determined to be actionable are the range circuit and the review of the yard, as indicated in our prior response. Since that reply, we would like to offer the following updates: Our electrician made a courtesy visit to the home on June 3rd. He reports that he spent 1 hour checking both the range and MW circuit, wiring, outlets, breakers and could not find any problems. He could not duplicate the problem when using both products. The only thing he found was on the range, the Neutral was coming back with a reading on the meter of 14 amps and the hot was reading 11amps. He advised her to call for service by a Samsung rep. A supervisor has inspected yard and spoken with the husband. There is one small spot that we advised him we would address and we will be changing out the catch basin lid that was damaged when the neighbor constructed their fence. Any other issue would have been caused by them removing some of their sod, pouring a walkway all the way from the front around to the back of the house (on the left hand side) and adding on to the patio. All of this will and does effect the way the water flows and moves. Upon completion of the above, it is our view that we have made more than reasonable and effective efforts to resolve concerns that are covered by warranty. While we always prefer to reach a mutual agreement, we understand that it in some circumstances it will not be possible. We remain committed to fulfilling any legitimate obligation that may arise during the remainder of the warranty term, but we have nothing further to offer with respect to this complaint. It is true the electrician came by again for like the third time and spent quite some time looking at my range and I have yet to see what they are saying is correct. This does not excuse your negligence. If a thorough check was done previously like they did this time, before running a line outside of my home for no reason we wouldn't be having this discussion. And if it's that simple to say it's my stove why did it take so many attempts to figure it out.There has been nothing but negligence that has led us to this point. Once again *** you have lied again, you said the catch basin lid was damaged when the neighbor constructed their fence. Honey the sewage was buried deep into the ground due to Ball Homes negligence and I have pictures from when they came to fix it, so lie again. 2nd of all you said we poured concrete and this is the cause of our drainage issue, you have failed to realize I stated we have had the same drainage issues since we closed on the house, it has nothing to do with what we did. If we didn't have drainage issues before we poured concrete it would be our fault, these drainage issues were reported before we ever did concrete. I would be happy to pull my receipts and pictures to add proof to your negligence. A guy came buy and spoke with my husband and I the other day and he said he would be back to put a drainage pipe on the left side of our backyard and he never came back. Also all these houses in Sanders Garden are having drainage issues and Ball Homes is looking for any excuse so it doesn't look like Ball Homes neglected the situation. So yes Ball Homes has yet to come fix my yard. The grass is missing around the sewage from where it was dug out of the ground and brought to ground level. Secondly I'm still waiting on the guy to come back and put a drainage pipe on the left side of the backyard, he told me that a week ago. Business Response With respect to the yard item that was determined to be a warranty item, we have now raised the manhole and our contractor is scheduled for 7/2 to complete the remaining yard work that we agreed to perform. In your last response you disputed fixing our yard due to grass removal and now your saying you agreed to perform the yard work needed. Every time you respond you prove yourself to be a manipulative liar. Yes they came and worked on one side of our yard and I have yet to see if the job has been done sufficiently. Ball Homes cuts too many corners so I can't trust that it's actually fixed until I see our yard not holding a lot of water. I'm still waiting for the other side of our yard to be worked on.
