Consumer Response *** never did call me. He did address the driveway in another warranty issue email but there is still no resolve with the driveway. I would like this opened back up. It may have to remain unresolved. I asked for *** to split the cost of the driveway repair and he refused. Thank you *** Business Response As per the contract Woodland Homes has no control over a driveway issue. The city requires we install sidewalks according to ADA guidelines and that is what we did. Mr *** chose to purchase a lot that sits high on a hill. He did that knowing the driveway would be more inclined than had he chose a flat lot. Mr *** signed a contract acknowledging Woodland Homes is not responsible for cars that have issues making it up a steeper drive. I believe you have a copy of that contract. The lot we selected was not that steep when we purchased. I had a realtor during the selection of the lot and he can testify to that. The issue is not the ADA sidewalk. Woodland homes altered the Non-ADA sidewalk that comes from the front door of the house and empties on the driveway. From our understanding, The city of Madison only defines the sidewalk by the road as the ADA sidewalk. Woodland homes altered my Non-ADA sidewalk causing the driveway issue. Attached are pictures that addresses the issues and it is clear Woodland's Homes alteration of the Non-ADA sidewalk caused the issues. Picture 1 - Driveway Woodland Home poured. You can see how much higher the right side of the driveway is because of how they changed the Non-ADA sidewalk layout to empty on the side of the driveway. It is about 6-8 inches higher than the left side. That sidewalk should have curved up by the garage as noted on the signed plat that is in picture 5. This caused vehicles to drag on the left side because of the axle tilt. Picture 2 - Different angle of large hump on right side caused by Non-ADA sidewalk alteration. Picture 3 - damage from Woodland homes sub contractors because of hump of right side of driveway. Please note these contractors were in vans and trucks so it is not just small sedan cars dragging on the driveway. Woodland homes had to repour the driveway before closing but did not correct issue of right side of driveway being higher than the left. Picture 4 - We had the driveway corrected and did NOT alter the ADA sidewalk. We lowered the right side of the driveway approx. 8 inches. No cars/trucks/vans scrape anymore to our knowledge. This proves the Non-ADA sidewalk was the issue and not the ADA sidewalk addressed in the contract. Picture 5 - Signed plat showing how the Non-ADA sidewalk coming from the front door of house should have curved up by the garage door. Woodland Homes altered it without our permission to run straight into the side of the driveway causing the hump. This is a breach of contract unless *** can show me a clause in the contract that says Woodland Homes can alter the layout of the Non-ADA sidewalk coming from the front door of house to garage on the plat we signed. As you can see - Woodland homes altering the Non-ADA sidewalk caused these issues. Consumers need to be aware of these practices by Woodland Homes that can cause significant property issues. I would like the following questions answered: 1) Why was our Non-ADA sidewalk coming from the front door of house altered without our approval? Where in the contract does it say the Non-ADA sidewalk can be altered? 2) It is our understanding Lot 19 (house being built beside our house) was forced by Woodland Homes to flip their house plan after Woodland Homes realized how steep our driveway was going to be. If this is true, why did Woodland Homes do this if their representation of lots before build are accurate in steepness and slope? 3) Why did Woodland Homes draw our house plans with the driveway on the low side of the street instead of the high side? Lot 18 and Lot 19 have driveways on the right side of the house (high side of street) but our home's driveway was placed on the left side causing a higher elevation driveway. 4) Why did *** tell his employee to stop communicating with my realtor after we filed a BBB complaint in an attempt to resolve this issue? The cost to repair the driveway was $3,750. We asked to split the cost with Woodland Homes and *** refused. This is more than a fair request considering there is a breach of contract by Woodland Homes (unless he can show me otherwise). At a minimum we should have been advised the Non-ADA sidewalk was going to be altered and given options. We had the driveway corrected and the right side of the driveway was lowered and resolved the issue. The ADA sidewalk *** keeps addressing was not altered in slope during repair. The Non-ADA sidewalk Woodland Homes altered without our permission was the issue. We feel deceived. Our signed contract (plat) was altered without our permission and the steepness of our lot and driveway was not accurate upon purchase. Woodland homes advertises "luxury," "customer service," and "quality." How is a consumer supposed to feel confident in a BBB company when they feel a company such as Woodland Homes can do whatever they want outside the contract and with willful disregard to the consumer's concerns? We are asking the questions above be answered and that Woodland Homes pay $1,875 as a split cost for repair of the driveway we had to repair. If this cannot be agreed upon then this issue will be unresolved from this consumer. It is obvious Woodland Homes did us wrong in this instance. Where in the contract does it say the Non-ADA sidewalk can be altered? I'm not sure what he is talking about. However, when he closed he accepted the home as is. I have sent you that documentation in a previous email. 2) It is our understanding Lot 19 (house being built beside our house) was forced by Woodland Homes to flip their house plan after Woodland Homes realized how steep our driveway was going to be. The lot that Mr. Murry chose has a drain basin that the city built on one side of the lot. We only had one option on where to put his driveway location. The city drain basin was there when he purchased the lot before building. 3) Why did Woodland Homes draw our house plans with the driveway on the low side of the street instead of the high side? Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) I would like to respond to ***'s latest response. I would advise him to do more research before he responds because he is not providing accurate information as noted in attached emails that were sent to him. Attached is an email sent to Tyler Payne, *** and had my realtor on the correspondence. I requested an onsite meeting to look at the driveway, to include *** but they refused to meet. I highlighted Tyler's response noting Woodland home's refusal. That email response was sent by Tyler on 1/3/2020. On 1/4/2020 (see attached document) I sent an email specifically addressing my concern of the Non-ADA sidewalk being altered without our knowledge or permission. *** was on that email as well. For him to say "Mr. did not send one email or text to them about the change." is false information. We "closed" on our home on 2/24/20 so Woodland homes had plenty of time to meet with me but refused.
