Westwood Apartments is suing me to force me to move out. I've lived here since October 2020 my lease renewed into a month to month lease beginning October 1st 2023.

In August I received notice for recertification with Westwood Apartments and on August 22nd 2023 I received email confirmation that my recertification was accepted.

Also in August I informed the leasing office of a sexual harassment incident that occured at my place of employment on 7/31/23 and that I had been suspended on 8/4/23 and fired on 8/15/23 as a result of reporting it. I also explained that I was currently applying for unemployment, seeking employment and diligently seeking financial assistance from charities and programs to cover the rent.

In September I received correspondence from the United Way regarding my application approval. A letter of intent to pay the rent for September was sent out to Westwood Apartments via the United Way.

On September 12th I received a 30 day notice for payment due $1190.20 by October 12th 2023.

The United Way informed me that they tried mailing the check to Westwood Apartments (September 15th) as well as bringing it in person by way of Keila (Friday September 29th @3:30pm) to no avail. Each time Westwood Apartments would reject the payment from the United Way and each time presented a different reason as to why.

"He owes a late that must be paid first"

"We don't accept partial payments"

"The lease is expired"

Following this I requested via email for Westwood Apartments staff member Nilda to please correspondence with me only via email due to miscues in communication until clarity and consistency can be reached.

On October 2nd I attempted to tender the money order that covers $108.20 late fee for September's rent to Westwood Apartments staff member Nilda. I was told by Nilda that they have never received a check from United Way. My recertification was not complete and my lease expired on September 30th 2023. I informed Nilda I have email confirmation from August 22nd of completion she informed me that they don't take partial payments and September rent and late fee has to be paid at the same time.

On October 5th I received a voicemail from United Way letting me know they spoke with Westwood Apartments and was informed that "until he pays October we can't accept September's rent" United Way let know me know they would hold the check. Whenever I procure the funds for October let them know and they'll meet with me to pay them both at the same time.

Sometime before 5:42pm Westwood Apartments staff members Yadira and Nilda showed up to my unit for nearly 15min and proceeded to harass me and asking me:

"Why won't you speak to us? We're right here"

"Why do we have to email we can speak face to face"

"I don't understand you're refusing to speak to us"

I informed Yadira that prior to this moment I did not know who she was I was told by Nilda to await a call from Gina in the front office. I also corrected Yadira and let her know I was not refusing to speak to her but if she would refer to the email Nilda received from and provide her contact information she would have my contact information and we can correspond that way. Yadira continued for several more minutes telling me my lease is expired since September 30th 2023.

After the incident Yadira emailed me @ 9:12pm and stated the following "Please note that our community does not do month to month lease agreement terms. Moving forward our office will no longer entertain any further back and forth emails on any matter."

On October 5th I completed a online HUD 903 housing discrimination complaint.

On October 6th I received correspondence back from Lee County Code Enforcement regarding a complaint and inspection request of the unit.

On October 22nd I received official court notice of a court filing from Westwood Apartments suing to evict me for not paying September rent and for having an expired lease that is now month to month.

Desired outcome: I want all my money back starting from October 2020
