Nissan - seaside ca, 93955

This is my formal complaint against Cardinale Nissan only.
The "On August 30th 2019 I called Cardinale Nissan. This all begins with my purchasing a car from Prunedale Motors owner operator Martin Shoppe in April 2019 Who operated and conducted business on the upmost levels of integrity. I paid a fair price of $9500.00 for my 09 Nissan maxima fully loaded luxury model. I love the car that I purchased from Prunedale Motors. Prunedale Motors gave me a 30 day or 1000 mile warranty.
My contact with Cardinale Nissan began with troubles that I had with my car losing power and shutting down. I had three or four other instances where this happened  leaving me stranded in dangerous locations like side of the highway at night Etc. Prunedale Motors gladly honored their warranty, my car was towed back to the dealership where we attempted to diagnose the problem. The car had no engine lights no maintenence indicator lights. The carfax on it was good and clear of any issues. Unable to diagnose the problem at Prunedale Motors we then decided to take it to MyNissan in Salinas California in hopes that they could diagnose a problem while also handling a Nissan recall appointment. MyNissan in Salinas California was also unable to determine any problem with the car. Martin Shoppe and myself decided that we would keep our fingers crossed in hopes that this car would give me no more problems with the correction made by Nissan through the recall. Martin Shoppe offered me a full trade in value of the car if i felt it nessessary. A great deal of time had gone by and I had no issues with the car. I was happy and the car was great until the holiday weekend beginning August 30th 2019. When the car lost power again and I was stuck at laureles grade and hiway 68. This as well is a dangerous spot to be broke down on the side of the road as it is a fast-moving Highway.
I was realizing without power I could not charge my phone it was almost completely out of battery. Extremely stressed I decided to call a couple of friends, a tow truck, and Martin shoppe at Prunedale Motors. Remembering that it was a holiday weekend I could not reach Martin shoppe so I left message for him to call me and explained the situation i was currently in. It was verbally arranged with prunedale motors that I would bring the car in and martin shoppe offered me a full value trade in option upon his return from the holiday weekend.
Still stranded, I could not wait 3 hours for a tow truck to come when I found out the dispatch at AAA sent them to the wrong location, I was completely frantic.
I decided to call Cardinale Nissan because it was the closest Nissan dealership to the location my car was broke down, the other Nissan dealership had already declared they could not figure out what was wrong with the car. I left one message on the phone with the people down at Cardinale Nissan when they called me back at home they promised me and assured me that since they were Nissan that they could fix my car that they were the best place to take my car and then gave a poor review of prunedale motors, stating matter of factly the best to have it towed was down @cardinale nissan. The man on the phone said hed be waiting for me. He was very attentive. I felt that my beautiful perfect car may be a lemon. My car stranded at park n ride, and AAA not showing up, I was completely stressed and exhausted. I was unsure of whether I was going to have a car by the end of the day to get home in or have one at all, but I still had the agreement with martin shoppe to bring the car in and get a full value trade in. I really did want to keep this car so I explained to Cardinale nissan that I was already taken care of with the dealership that I got the car from. I also stated that I just bought the car and did not want nor could I spend any more money. Cardinale nissan called me 3 more times at home persistantly and agressivly stating that my car is a nissan and they would take care of me that my car would be fixed because they are nissan most qualified for the job. I was shocked at how many times they called me at home and how pushy he was about my car coming in to cardinale nissan only. I was so stressed and desperate to have my car for my doctors appointments and many other tasks I cant attend to with out a dependable car. I am elderly and I live alone with disabilities so its very important that I have a good safe & reliable car.
The issue not being resolved after many attempts I considered it no harm in allowing nissan to help me fix it before I give up and and chose to trade it in with Prunedale motors. After calling AAA and having them tow my car down to cardinalle Nissan I had my friend Gayle Winfield Drive me to the dealership to meet the man that told me on the phone he be waiting for me.
Upon arriving at cardinale Nissan he was waiting for me & he introduced himself as Irwin. I felt relieved & I was feeling like Id finally have my new car and how nice if I could depend on it to go to the many Appointments that I have on a weekly basis. I really was very desperate to have this car issue resolved. There are many details to the way I was mislead by cardinale nissan, I have provided documents that will show the sloppy attention to details and how the handling of the documents by the crew at cardinale nissan plays a key part in the way that I was lead to believe things were much different.The documentation would lead you to believe that I signed my car away and agreed to take a loan for another car. that simply isnt the case. when my car arrived to the cardinale repair shop and they looked it over, irwin comes running in and loudly declairs my car "JUNK!" that its been in a collision. Then state that they will give me $1500.00 for my car thats it and the car was going to go to the auction as a parts car. I was stunned having driven the car and it being looked over by other dealership mechanics including MyNissan. All of which claim the car is perfect in fact cant even figure out what problem is leaving me stranded so many times at random.
I informed Irwin that my car is not junk I paid almost $10, 000.00 and it ran and drove perfectly set aside this phantom power failure issue. I explained that as for the collision on his carfax it was not a collision it was a parked fender bender that had already been deemed no damage other than very little cosmetic damage and did not effect the cars safety or running ability.
With all of this very vey fast paced whirlwind of events and surpizing information it looked to be a long evening. I sent my friend Gail home and thanked her for the ride down to the dealership.
After a very stresfull and long couple of days I just wanted to get in my car and drive home but couldnt. I had no ride home my car was not fixed and Cardinale is now declairing my car Junk. They made me an offer of $1500.00 for my car that I just spent $9500.00 on. I was so confused, I only called looking for my car to be fixed which they assured me they could do before I came in with the car. They assured me that I wouldnt be looking at a bill to get my car back. They assured me Id be taken Care of.
Next thing I know Im Signing Paperwork that I believe is for a loaner car to drive home while my car is in the shop. Its not long before I realize I'm signing loan paperwork for a car I would never buy if I actually was shopping for a car. It had no options nothing about it was similar to my car and it came with a loan payment that would cost over $250.00 per month when I stated clearly I was not looking to spend any money I just bought my car. I only wanted my car fixed. The hustle and over rushing around all the details confused me a great deal I still wasnt sure if this was just formality mumbo jumbo to work out the loaner car. I understand that the purchase of an automobile especially financed takes quite a long time. Sometimes over 2 or 3 hours and my deal was done and out the door in 35 minutes just to give you an idea of how fast this was going. When the man came with papers to sign he never made clear what I was signing and the paperwork was always folded over in a way that I couldnt see the document title or would over lap another making it barely visible. The salesman rushed and pushed me all while telling me things and making me feel as though I Had no choice but to take this car and leave mine. improtant note as to my signed car return contract with purchase price of $250.00 if I chose to purchse the option I could bring the car back. The documents were folded in a way that it appeared I was signing the agreement to purchase the option but it infact was not that document at all the opt out title was hidden. just like many of the others in the large stack of contracts that all had my name spelled wrong, dates wrong and many other details that were over looked by all parties involved. I sadly left in this very cheap uncomfortable tin can of a car thats price was much higher than the sporty luxury car I had just purchased and should have been getting fixed so I could be taken care of like they promised. I was very confused exsauseted and depressed at this point. When I got home I called the cardinale dealership and at this time was closed for the night but I left a message stating I didnt want the car I wanted my car and Id deal with it at prunedale motors as originaly planned and explained to cardinale nissan before I had my car brought in to the repair shop at cardinale nissan. Since then I have made numerous attempts to work our a resolution with Cardinale nissan on the return of the unwanted loan and vehicle they put me in to when I only asked them to fix my 09 Maxima. to my dispare I couldnt get a positive response. I was told by Eric a used car manager that my car was sold to a wholesaler and its location was unknown. I have been working day and night since then to find a way to reverse this action.. curiosity had my friend and I search the vin number of the maxima they claimed was junk and going to be sold as a parts car. Attached is the vin report I purchased online and a copy of my complaint thats being to sent to DMV. The repport clearly states that the car was in perfect condition with no history of collision or salvage . Theres no sales slip that says my car was sold as junked or a parts car to any wholesaler. It does state that approx 1 month after Cardinalle nissan took my car from me it was sold in Sacramento for $7995.00 Which is very close to what I paid for the car. How can they sell junk parts cars for $7995.00? The only thing I am hoping to gain from this complaint is I want Cardinale Nissan to take back this unwanted car and loan they tricked me in to leaving me with a balance due $0 and I know its not likely to get the exact car but to replace my Black 09 Nissan Maxima 4 door v-6 fully loaded luxury car with sunroof.

Theres got to be some kind of protection for the elderly disabled, or low income people in need of certain services being mislead in to a no choice situation that ultimatley creates a hardship in their lives.
