The salesperson misrepresented the timeshare and the requirements to resell the unit after being required to hold onto it for two years.
--Owner number cvc4821- Payment method VisaMy Ex-husband and I were contacted by River point -NAPA where out timeshare was noting that they had been bought out by CV Club and that we were requested/requred to attend a presnetation about the new ownership. We attended on May 14, 2009 at that time the sales person Bob Condon explained that if we did not buy the upgrade to Reiverpoint we would not be able to us the various facilities in the Interval book because the Riverpoint location was not the same as the others in the Interval book. He said that in order to continue to use the Interval we needed to purchase the upgrade for 5, 094.00 this would allow us to use the Interval locations to do vacation exchanges. He also references the resale program where we just provide some names for potential buyers but that the resales would essentailly get into a "Q" so that they come up and the salespersons sell new units as well as resales for current owners.
AT NO POINT IN TIME DID THE SALES PERON STATE THAT WE HAVE TO FIND A BUYER FOR THE UNIT. NOW WHEN WE ARE TRYING TO DO A RESALE WE ARE BEING TOLD WE HAVE TO FIND A BUYER FOR IT. He also stated that we would be able to recoup the monies we spent for the unit origionaly- $9, 850.00 as well as the additional monies we were having to spent at that time for a total of $14, 944.00

I reviewed the PDF you forwarded me, but I have a question: at some recent point, did you fill out the referral form and send it to us here in Napa ? (I do not see anywhere that we have referrals from you ...).
Please let me know on this, and if you did, we'll conduct another search of our paper files.
Here are some items to consider:
a) the RiverPointe & West Coast Escapes Resale Assistance Program, is based on your referrals. As such, the price point for RiverPointe resales is predicated on market conditions and variables. As you know, the secondary market for timeshare resales in the US, is currently flooded with families wishing to sell their vacation interests - see E-bay 'timesharing' or Google 'Timeshare resales'.
b) please provide us with a price point that you're comfortable with, and we will attempt to sell your timeshare interest to your referrals, per the assistance program
c) list your week with a timeshare resale company (includes up front fees, not recommended). These companies generally resell timeshares for pennies on the dollar and keep the 'listing' fees.
d) walk away via a 'hardship' letter explaining your desire to dispose of your timeshare (as Mike and I discussed)
e) the West Coast Escapes license can be terminated in any year by simply not paying the annual license fee. I do not see in your documents whether you do the automatic annual payment, but if so, your West Coast Escapes annual fee is $169. This allows you access to condos, cruises and hotels worldwide.
May I suggest that you keep the West Coast Escapes, and allow us to solicit your referrals and attempt to sell at an acceptable price ?
