Good Day,

I have two houses on a farm outside Fochville and used Remax as my agents on renting out both houses. The first house they found tenants and a contract was signed and a deposit was paid immediately on signing the contract and the agent told me that if they do change their minds they loose their deposit which is fine. Now the second house they signed a lease contract with one of their employees on 19 April after I turned down a tenant I found via my ad after Riette from Remax told me that she already confirmed with these people that they can sign the contract for the house. These people went to look at the house on the Thursday and Riette said she will let me know if they are interested. She never contacted me and then the Monday when I told her I found someone she was not happy because she already told this people they can sign…So I agreed to let the guy I found know that they already found some one that I didn’t know off. Then we received a message from the agent the end of April to say that they don’t feel save on the farm anymore so they are going to cancel the contract. The agent did not get payment for the deposit on 19 April as they did with the other tenants and now they don’t want to follow up for the deposit payment which should have been paid the day the contract was signed. I am loosing my rental income for May because of breach of contract and the principal of Fochville Remax said to me its one of his employees so he will not stand up against her. This is not acceptable they treat other clients according to the law and the wording of the contract but now that it is one of their employees its different. They did not give us notice in writing they only send a message to the agent and even she said they are dropping her now. This employee said that her husband had an arrangement with my husband Bennie to cancel the contract which is not true… My husband told him that the contract was done by remax so they will have to sort it out with them. I have the full whatsapp conversation with the agent as evidence and they made up their own story of what happened.. On the cancellation message they send to the agent they said they feel un save but the principal is using the state of the house as an excuse. My original rental amount was R7500 and because of the fact that the house is not up to standard after the previous tenants messed up my house and these people wanted the house as is for a lower rental amount we agreed on R4500 pm w&l included. So they new exactly what they signed for. That was the amount they agreed on. The Principal’s argument is that the house is not up to standard, I want to know so why did they sign the contract after seeing the place and make an offer of R4500 pm …. and that is not the same reason they gave for canceling the contract. Please advise me on what I can do to get my deposit from Remax as I lost a months income due to their employee signing a contract and then deciding two weeks after that, that they don’t want the place anymore. I can send you all the proof to state my case.

Desired outcome: I lost my rental income for May so I am claiming the deposit due to breach of contract two weeks after signing
