This is Theodhor Duka. Property Corporation of America specifically Howard B. Silver the president, messed up my assessment account and he personally forced me to pay the late fees for the mistake he created in the first place. I’ll start off by mentioning I own 2 units in the Saratoga condominium association in Rolling Meadows for almost 20 years. Since I bought the units I had paid the association through automatic payments (which means that I signed a paper giving the association the right to collect the money from my bank account). I never had a problem until December 5th 2022 I got a letter in the mail saying that I didn’t pay the assessment on one of my units for the full year of 2022 and that I owed not only the money for the assessment but also late fees and other charges (the letter is attached below). I was shocked from the letter and I immediately opened my bank statements. Fair enough it was a big mess. This was exactly during the time when Property Corporation of America took over management of Saratoga condominium association. Both of the units are on the same account and the bank statements show that on the last transaction before they stopped collecting the assessment for one of the units was on January 2022. I got all the bank statements and I went to the Saratoga office in Rolling Meadows. I tried to show to the property manager all my bank statements and explain that this is a big mistake on their end. She called Howard B. Silver(president of Property Corporation of America)and put him on speaker, I explained to him that I never signed a paper to stop the auto payment and this is a mistake on their end. I told him that anyway I will pay the assessment but I am not paying for the late fees and other charges because that isn’t my mistake. Not only did he not accept his mistake but he went on the offense to tell me that its my mistake that I didn’t check my bank statements. I told him that I don’t have to check my bank statement every month for something I signed up to be automatically paid which includes his salary. I said I am ready to pay the assessment but not the late fees. He insisted that I have to pay the full amount. The next day I went to the same office with the check for the assessment and the property manager couldn’t accept my check without the late fees because Howard B. Silver(president) ordered her not to accept my check without all the fees and other charges (attached below is his email) I left the check on her desk and I tried to have a hearing with the Saratoga Condominium Board of Directors. I wrote a email to them and I requested for an in person hearing so I can bring all my paperwork(bank statements) and I asked them that Property Corporation of America has to show on their side my written statement that I authorized them to stop collecting the assessment (which doesn’t exist because I never signed for them to stop automatically collecting the money). And to show what happened with my previous statement that I authorized them for auto payments from the start. That email was on Thursday that week and the next day I got an email back from the Board of directors and they said that they will get to the bottom of this as soon as possible. I waited until next week and on Tuesday I went back to the office in Rolling Meadows to ask what happened with my hearing request because I didn’t get an email or notification about the hearing I requested. The property manager told me that the board of directors had a meeting on Saturday for the election and that they were aware with my situation and that they decided to remove 3 months of the late fees. I told her that I asked for the hearing to show to them all my evidence and for them to bring to the table whatever evidence Property Corporation of America has. I also asked her if she sent the check I left on her desk and she showed me the check was still sitting on her desk because her boss Howard B. Silver didn’t want to accept it. I left again and I wrote another email to the board of directors. I told them that I requested a hearing and asked why they had a meeting 2 days later without informing me. I asked them why do I have to pay for Howard B. Silver’s mistakes? Why do I have to pay extra for something that I signed and why I am paying the assessment for somebody to not do their job right? What took him almost a year to figure out I wasn’t paying the assessment? And why do I have to pay him extra for his mistake? I told them If they don’t have any answers for these “Why’s” they shouldn’t be able to make decisions like this. I never got any emails back. The time was running out because on the letter(attached below) is a deadline so I went back to the office and I asked the property manager about the amount that I have to pay after the 3 months reduction. She couldn’t get in touch with Howard B. Silver because he was out for Holiday vacation. I told her that I am paying the full amount as he was asking but I want the 3 months money reduction back. Its already been 12 days since then and I didn’t get anything yet. I am asking from you guys to help me get through this process. Common sense is not common to people like Howard B. Silver and the company he runs. I want from you guys to get the correct answers and get back to me with the full late fees and other charges that Howard Silver stole from me refunded to me. I paid him $4,270.25 (I’m including the copy of the check). From this amount $3,852.00 is the assessment amount for the unit and $418.25 is the late fees and other charges that id like refunded.
