A lawsuit was filed against me for foreclosure, and I have been in my house for 2 years and 8 mos since then. I have tried numerous times to get my loan modified. My documents were lost. I called many, many times. I faxed documents over and over. AHMSI accused me of abandoning my home. I have never left. Now, I have sued them in Federal Court in South Carolina. Now, their attorney wants to settle as soon as possible. Let me know if you are interested in suing them. I am aware that fraud has been committed. My attorney and I are both aware of that. My closing had so many violations that it is not even funny including fraud and the closing attorney went to the federal pen for wire fraud, illegal fees and flipping houses. My title is a mess as well. In the meantime, we have sued AHMSI for violation of my Fourteenth Amenment rights. On top of that, we have filed in the Les Pendens action for a Motion to Dismiss based on the fact that the Assignment was not recorded at the time of the filing of the Les Pendens and several other issues such as Lack of Standing for MERS. The banks did predatory lending all over the place, because they knew they could sell the "bad" loan to some poor other investor. They also separated the note and the mortgage when they sold it as a "securitized bundle" (whatever the hell that is) A note and mortgage must be kept together, otherwise it is AN UNSECURED DEBT. Once they sold it, they made their profit. So, when they come back to foreclosure on someone's home, they are making profit No. 2. AND The federal gov't is paying them money for the default--payment no. 3.

I am also a victim of AHMSI. I have been in foreclosure for 2 years and 10 months and still hanging in there trying to get a loan mod. You will find third parties to help you with a loan mod, but beware of up front fee scammers. I have also tried some of the "free" help in loan mods--not so good! I finally did what I should have done in the first place Sue the Rats!

Your loan has been sold to a debt collector who ALWAYS operates outside the law. Send them a certified letter registered return receipt and tell them you need to know where to send your mortgage payment. If they do not comply, sue them.
