Business and Professions Code Section 725 (a) – Repeated acts of clearly excessive prescribing, furnishing, dispensing, or administering of drugs or treatments, repeated acts of clearly excessive use of diagnostic procedures, or repeated acts of clearly excessive use of diagnostic or treatment facilities as determined by the standard of the community of licensees is unprofessional conduct for a physical therapist.

a. Patient was treated for 127 visits of physical therapy without a re-evaluation to support the continuation of manual therapy and daily exercise for three years

b. Patient’s lack of progress of her chronic neuromuscular problems which were not taken into account when the same physical therapy treatment was continued. Specific examples where the same treatments were continued when no longer appropriate can be found in daily notes and exercise logs for patient from April 2, 2004 through June 18, 2004.

c. Patient record indicated there is no evidence to support the continuation of physical therapy care beyond 29 visits during July 30, 2001 through March 8, 2002.

California Code of Regulations Section 1399.85
A physical therapist shall document in the patient record the following:
Examination and re-examination
Evaluation, when the patient is to be reevaluated and the reevaluation
Diagnosis
Prognosis and intervention
Treatment plan and modification of the plan of care
Each treatment provided
Discharge Summary

Business and Professions Code Section 2620.7
A physical therapist shall document his or her evaluation, goals, treatment plan, and summary of treatment in the patient record
A physical therapist shall document the care actually provided to a patient in the patient record.
A physical therapist shall sign the patient record legibly
This is a perfect example of why you need to investigate a health care provider.

These claims are totally unfounded. I have been seeing Poly off and on for years...She is absolutely the best!...I know many others who would say the same...Diane Shields

Medical Malpractice & Negligence Lawsuit against Body Rehab Center, Polly Badt & Sanjay Bardwaj

A medical malpractice lawsuit was filed against Body Rehab Center & Polly Badt on November 15, 2011 and was recently settled during mediation for an undisclosed amount. The former patient claimed therapists negligently treated her knee thereby causing pain and suffering, additional medical costs with physicians and surgeons, loss of earnings/income and related damages.

This is truly another reason to always research any and all medical providers as to their Board Violations and Malpractice Lawsuits. Medical Providers are legally bound to disclose Violations and Lawsuits if you submit an inquiry to them. Always do a search on Google and the California Medical/Physical Therapy Board websites.
