I ordered a shipment of CBD oil in October, 2021, in response to an ad from a company going by the name of Green Labs, stating I just had to pay shipping charges of about $8.00, and I could decide whether to proceed. I received a package, tried it, didn't like it, but then they started sending me two unsolicited packages and charging $88.80 and $89.90 per month. I wrote "rejected" on the package, and returned them unopened to the seller. I complained to Capital One that it was fraud, a position that the Better Business Bureau had concluded on numerous other complaints from that company. I agreed to pay the shipping charges, but disputed the other charges that came to a total of $623.00.

Capital One first opened an investigation, but after a few months concluded that they found insufficient evidence of fraud, because "information we discovered leads us to believe you or another account user benefitted from the transactions". I did not benefit from the transaction, and Capital One refused to tell me what the information they allegedly relied upon. They then concluded I was responsible for the full amount in a letter dated April 7, 2022. In a second letter dated the same date, Capital One stated that "We're happy tell you that our fraud investigation with Capital One is now resolved". It's impossible to understand their position, much less agree with their reasoning.

I intend to make a claim against Capital One based on their guaranty of full protection of all fraudulent transactions by customers, and go to Small Claims court if necessary. I cannot recommend that other cardholders rely on this guaranty.

Desired outcome: sustain my complaint and reverse charges made against my account by the company.
