Two years back I have paid advance for booking a villa in MTech Developers Beach Village Project in Goa, I visited the place few months back, there seems to be progress and many thing that was told while booking is not accurate, they seems have no mood start construction work. I decided to cancel my booking and the whole game started there after, they took 3 months to give a post dated check, once I deposited after waiting for 2 more months, the check returned back.

I am not sure what I can do get my money from this so called reputed (they get reputed by paying big money to TV ads and then suck money from people like me) fraud builder.

If you are thinking about any project that has been listed in their wen site (http://mtechdevelopers.com/home.html) I would suggest not to waste your hard earn money, don't get fool by their commercials.

M Tech developers are now offering 3 BHK flats instead of 2 BHK flat that I booked in Beech Village Goa project. However they have increased the cost significantly by putting in all kinds of extra charges like road facing PLC, corner etc etc. Moreover, this promise seems empty as they keep giving new dates if you show interest in buying 3BHK. They refuse to give back money (that I had given way back in 2006), let alone interest on the principal amount, if you don't want to upgrade to 3 BHK. Who would want to upgrade with fraudsters afterall!
Has anyone on this forum been successful in getting the refunds? I am planning to file complain in consumer court as well as EOW. I see lot of aggrieved customers on this forum that took action. However it has been long since anyone posted here. Please let me know if there is someone having pending issues with this fraud developer. I would like to form a team to fight them systematically.

The MTECH company should be taken to task by law enforcing agencies. Even after applying for refund more than 8 months back, not a single penny has been returned back to me. The story is the same with all customers who had booked in the Camelia GARGEN II project at Bhiwadi.

We need to take this company to court, is anybody listening

M-Tech developers booked a plot in 2006 and LDA give licence to launch 23.08.2006 and canceled and again give licence 16.02.2010 but the company again summit DPR . and froaud to all 1500 costemer who booked their plot after five years they did not give the plot to the costemer because the rate of the land is higher so they deley their project and did not summit their DPR I asked to LDA its region they told me they are not summit their DPR they refund public money without intrest I want to plot but they give not answers me when we will launch my project they published notice to the news paper and tell about we refund the amount but did not say why we refund the money when he booked the plot they said it i did not launch the project in Lucknow we will refund the money with 12 percent interest i want to say you this company do same in goa. bhiwari rajasthan and now in lucknow i also inform all indians kindly know this froaud companies name and remember donot invest your money in this company . save yourself.

I had brought aplot in camelia garden 2 (pre launch).I kept waiting but there was no news of launching. The company kept sending some letters after every 6 months but it is now understood that there is no land only. Can somebody advice me what legal action should I take

Dear all,

Due to the impact of the News channels asking M-Tech developers for comments / interviews, the M-tech developers are now under great pressure and have started to refund money to some of the investors alongwith interest / compensation ( in cash of course) .They have already given such payments to some of the M.A.V.G members.

Their liason officers / legal advisors / settlement agents are now very
helpful and humble to the investors ; the settlement process is being looked after

They are very co-operative and humble people who duly acknowlege the pain of the aggrieved investors who have trusted this builder for

Dear All
Our group of around 50 people have come together and planning a protest march against the fraud committed by MTech developers. Our last meeting was duly attended by the media and we are expecting some stories in the media.
Some news channels are going to cover the story in the next two days.
We are also in touch with other media houses and will take this issue forward with the media on the inaction of the authorities against the developer.

Chidambaram’s AND Union minister for Corporate affairs Mr. Salman Khurshid to draw their attention towards indifferent, apethic attitude and rather colliusive attitude with M-tech Developers, ANS House Ashram New Delhi, the white collar criminals who had cheated hundreds of people by Ministery of Corporate Affiars and Delhi Police.
M-tech Developers Ltd. had launched and advertised vastly for dream homes, villas, Aparments at BHIWADI, GOA and other projects more than three years back but none of Construction plans are sanctioned and company have not refunding lifelong savings in tune of lakhs of rupees invested with them by each investor. There are still 38 cases pending Against them before Consumer Disputes Redressal Forum -X and a Complaint case is pending before State Consumer Disputes Rederessal Commission New Delhi.
It also become Known through RTI replies that a lone Complainant had lodged An F. I. R. No. 160/09 at P. S. Economic Offences wing against M- Tech Developers Ltd. for cheating him more than 60 lakhs. Apart of it a Number of other persons had given their written Complaints as well as P.S. New Friends Colony had transferred all the Complaints received by them against the said Company to Economic Offences Wing Delhi Police but follow up actions taken and present status is not Known. Even higher Delhi police authorities are sleeping over the first appeals under RTI ACT for directions to public information officer to provide Correct, Transparent Information. The Present status of Complaints received P. S. RoopNager is yet to be Known. The investors who attended meeting stated that the conduct of Delhi police is opaque and officers are not diligently discharging its duties and appears to be in collusion with White Collar Criminals.
A number of E-mails were also sent to investor Grievences Ministery Of Corporate Affiars but they even did not bother to acknowledge what to talk about appropriate action.
That a Series of meetings will be organized at various parts of Delhi and Gurgaon to mobilize each and every investor to participate in this proposed silent March.

I had booked a 2 BHK flat in Camellia Garden, Bhiwadi some 2 years back and have also paid one installment.I visited the site last month.Incidentally it was a holiday(Vishwakarma day) so no work was happening but I was told by someone atthesite that the speed of work has picked up in the last 10-15 days preceeding my visit.Roof slabs for 2 towers have been cast till the top floor and excavation and PCC for another two towers was completed.I spoke to some brokers in Bhiwadi who said to hold on as the Company's position seemed to be improving.The builder did have tie up with PNB but I'm not too sure if things worked out since I too had applied for a loan and I was told that since PNB was working very slowly they have moved the files to LIC Housing Finance Ltd. I am still waiting for LICHFL to approve my loan.I haqd invested with a long term horizon and do not mind if there is a delay in the handing over of the project but I certainly do not have the appetite to bear a loss. Can someone please advise me if my money with builder is safe or not because I know for sure that even if I go for a refund it will take at least 10 months before I get my money.

I have also booked one 2/bhk flat in Cammilia Garden-1 of M-Tech Developers at Bhiwadi Rajasthan about two years back.I have paid two installments and also got allocation of my flat.They have given allotement letter with flat number and tower description.But they have not mensioned any possession date and also other terms and conditions.During my visit to site in august/08, I have found two nos. of towers raised upto 8 storeys and foundation work for all other towers was also completed.They are pregressing but with too slow pace.If you observe construction speed of other builders they are too fast than M-Tech.Some projects which started later than M-Tech are at almost finishing condition.Everything is doutful but I have decided to stay with M-Tech for some more time.Let's watch the situation a little more and see what is going to happen in future.Kindly share if you have any latest information.One more thing, they have also anounced loan from pnb bank but I have not enquired about confirmation of this info.

The M-Tech is complete Fraud. I went personally to check the status of M-Tech Height and after 2 year of booking, they made a sample flat. I am having a serious doubt that they will start the full blown construction. They only did that to receive the 2nd installment.The other property developer in last 2 year already completed their 80% project. I got the confirmation from my agent that they are slow in getting anything moving and got the sugesation to apply for the refund.

I paid two installments through an agent in Delhi over a two year period. Even as late as May 2008 the M-Tech and the Agent sent a note saying -good news the construction has started and wanted 3rd payment. Now I understand that nothing is happening and my agent tells me the project is having problems and people will get their money back. I think all those who put the money should take joint ction directly or through their agent to demand money with compensation.

They have told about the possession in 09(Dec.) or in 2010(Feb. or March).

I am still trying to get my Goa Beach Village refund from Amit Jha of MTech Developers. I have not used my connections yet to put this developer in trouble but if need be, I will be able to take many serious actions against M-Tech Developers for fraud. Consumer Court, FIR with Police, Publishing in leading news papers about cheating customers are some of the immediate actions that I am going to take other than having my people find out where Amit Jha or Mehinder Sharma and his family are residing...

I will update you all about the progress...

How to recover money from Developers,

Hope U are not an property agent rather a genuine investor. U can lodge your conplaint at Economic Offences Wing - Delhi Police, Malviya Nagar, (inside Police Training Acedmey). This is on the road from AIIMS to Kutub Minar on left. The PS is open 24x7 and U will be needing copy of reciept + cheque bounce evidence + Application in duplicate. Action will happen in 15 days. Hi,

I am also planning to ask for refund but still awaiting. The project is apparently going to delayed due to local opposition. Do you know if the NOC and licenses have been obtained ? Is everything clean legally? Do you know anybody who actually got a refund? Do we get any decent return on the 10% booking amount? It may be a good idea to ask for a Demand Draft rather than a cheque that can bounce.

CORTALIM, AUG 8 — The fortnightly meeting of Sancoale Panchayat passed off peacefully, with the panchayat body passing a resolution pertaining to the controversial housing project by Delhi-based M-Tech at Sancoale.

When the panchayat assembled, the resolution on the project was taken up first as per the demands of the villagers, which was passed unanimously.

The panchayat decided to place the file before a special gram sabha meeting, before the panchayat could accord any approvals to the project as per the villagers demand. The panchayat also agreed to inform the PDA of the villagers’ objections to the said project.

Deputy Sarpanch Ramakant Borkar and Panch Premanand Naik accused their opponents for misguiding the villagers, which led to the ugly incidents during the previous body meeting on July 31, which was adjourned due to chaotic situation.

Former panch and activist Simon Carvalho was arrested and three others were granted anticipatory bail, after Sancaole Sarpanch Sharda Rathod filed complaint of molestation among other charges.

Verna PI Nolasco Raposo, who was present at Panchayat office with a strong police force, faced accusations from Carvalho who accused him of registering false case against him and others with inquiring into the complaint. Executive Magistrate Sheru Shirodkar was also present.

Interestingly later, in a decision which could have widespread repercussions, the panchayat body in a split decision decided to hold gram sabha at Upasnagar near Zuari Nagar on August 26.

According to panch Tushidas Naik, 7 panchas — Premanand Naik, Deputy Sarpanch Ramakanth Borkar, Bhoj Naik, Girish Pillia, Nilesh Dalvi, Rocky Vales and Sarpanch Sharda Rathod — voted for gram sabha to be held at Upasnagar near Zuari Nagar, while Panchas Tulshidas Naik, Parvati Bingui, Antonette Carvalho and Jamina Pereira voted against the venue.

The demand for holding the gram sabha at Upasnagar ground was made by the crowd who are mostly migrants at a rally at Zuari Nagar to protest against the alleged assault on Sarpanch Sharda Rathod.

Most of the migrants are living illegally on Sancoale Communidade land and have been issued election cards on bogus house numbers. A memorandum to delete their names from the electoral roles was made to the deputy collector by Sancoale panch Premanand Naik and others about a couple of months back.

Meanwhile, former panch Simon Carvalho has termed the decision to hold the gram sabha at Upasnagar as illegal, since neither the sarpanch nor the panchayat body has the powers to convene the gram sabha.

“As per the Panchayati Raj Act, the gram sabha should have been convened in July. Since the sarpanch failed to hold the gram sabha in July, Section 5 (4) empowers the BDO to hold the gram sabha,” he said.

VASCO, JULY 31 – The Sancoale gram sabha witnessed noisy scenes on Tuesday as the panchayat members and villagers clashed over the controversial high profile real estate project of M-Tech Builders.

As soon as the gram sabha gathered, a group of villagers under the banner of Citizens Action Committee for Protection of Soncoale demanded the panchayat to pass a resolution opposing the real estate project of M-Tech Builders. The group, led by former sarpanch Simon Carvalho, alleged that if the project was allowed, it would change the demography of the village.

According to Deputy Sarpanch Ramakanth Borkar the citizens’ group was informed that their demand would be discussed after the agenda for the day, was dealt with. But the citizens group, which refused to wait until discussion on the agenda was over, began using abusive language against ruling members; and Sarpanch Sharda Rathod who feared unruly scenes adjourned the meeting to prevent the same, he added.

Sarpanch Rathod said Carvalho used uncivilized language against her and even threatened to outrage her modesty. “Carvalho and his group called me an outsider and I had no business to occupy the sarpanch post,” she said. However, opposition member Tulshidas Naik refuted charges made against Carvalho and others saying “it was a ploy to silence the voice of villagers against M-Tech Builders.” Naik said Carvalho neither threatened to outrage Ms Rathod’s modesty nor used uncivilized language against her.

Later, Ms Rathod’s lodged a complaint against Carvalho at the Verna police station, following which he was arrested under sections 354 (outraging modesty of women), 506(2) (threat with dire consequence), 143 (unlawful assembly), 504 (abusive language), 332 (obstructing public servant from discharging lawful duty). A case has also been registered against Peter Dias, Theresa Pereira, Chetan Dourado and Ramakanth Naik under various section of IPC.

Four Sancoale panchas deny allegations

CORTALIM, AUG 1 - Four panchas of Sancoale panchayat have denied allegations levelled by Sancoale Sarpanch Sharada Rathod against former panch Simon Carvalho, which led to Carvalho’s arrest on Tuesday.

In a letter to the Verna police, the panchas Tulshidas D Naik, Jamina Periera, Antonetta Carvalho and Parvati Bingui contended no one was physically assaulted and that no books were torn. They alleged that it was Carvalho who was dragged by the police downstairs and made to sit in the jeep.
They claimed that the police jeep was immediately followed by the ruling panchas, including the Sarpanch, and the panchayat secretary, who locked his chamber before leaving.

Earlier on Tuesday, the news of Carvalho’s arrest spread like wildfire and about 200 villagers assembled in the panchayat and refused to leave till late evening, demanding the immediate release of Carvalho and an apology from the sarpanch for making false allegations of molestation against Carvalho.
As PSI J Dalvi failed to convince the agitated crowd, Mormugao SDM Levinson Martins along with Verna PI Nolasco Raposo and SDPO Deu Banualikar tried to pacify the crowd.

Later, the crowd dispersed after Martins informed that the villagers are also at liberty to file compliant and informed that Carvalho could be released if any bail application was moved in the court. He said the present issue of M-Tech developers could be resolved by a special gram sabha meeting.

He requested that an application be moved by villagers to the sarpanch, failing which the BDO would direct the panchayat to hold the grama sabha and also expressed his help to convene the gram sabha.

The villagers fear that the proposed site for housing complex will have an adverse consequences to wild life, which provides shelter to thousands of monkeys and the other animals.

Meanwhile, the villagers have dismissed as rubbish the proposed Zuari Nagar bandh on August 2 and reminded that the most of the migrants are living free of cost and illegally on Sancoale communidade land.

Sancoale deputy sarpanch resigns.

VASCO, AUG 13 – Sancoale Deputy Sarpanch Ramakant Borkar resigned on Monday morning, after accusing some vested interests in the village of creating hurdles in the development of village.

In his resignation letter submitted to Sarpanch Sharda Rathod, with a copy to the Mormugao Block Development office, Borkar claimed that the vested interests do not have any knowledge of the issues in the village and have been highlighting the M-Tech developer issue, which had been initiated before his ruling panel could take over the panchayat.

“The M-tech builder issue is now being turned into a communal issue. This project was opposed by the panchayat body and was marked for a special gram sabha to discuss the issue. However, the vested elements in Sancoale are not ready to solve the issue in an amicable manner,” said Borkar. He claimed that constant criticism by villagers had forced him to resign from his post.

It may be recalled that the M-tech developers have acquired an area of about 35,000 sq mtrs of land in the hilly area of Sancoale for constructions of luxurious bungalows. Villagers fears that the ecology of the village would be adversely affected, if the project goes ahead.

Sancoale dy takes back resignation

CORTALIM, AUG 16 - Sancoale panch Ramakanth Borkar on Thursday withdrew his resignation from the post of deputy sarpanch. The withdrawal or resignation comes following pressures from ruling panchas and his voters.

Mr Borkar had sent his resignation letter to the Sarpanch Sharada Rathod on August 13 accusing vested interests of creating hurdles in the development of the village.

Sancoale village is presently going through bad times over the controversial housing M-Tech project which is coming up in the thick forest area and also the decision of the panchayat body in a split decision for holding the gram sabha at Upasnagar near the migrant dominated area of Zuari Nagar for the first time.

Meanwhile, it is now revealed that the change in zoning on which the controversial housing project is to come up was done in 2001 and the conversion sanad was obtained in July 20th, 2007.
