Business Response This correspondence is in response to the BBB review. Upon receipt, a review of the merchant account was performed. This merchant account was opened March 2, 2020. The terms and conditions of the parties' commercial relationship are contained in the Merchant Agreement entered into between the parties. In order to obtain a merchant account from Merchants Bancard Network (MBN), *** indicated acceptance of the terms and conditions of the Merchant Processing Agreement (MPA) by signing our agreement and his continuance to process credit card transactions. All applicable rates & fees are disclosed in the MPA in which we receive. The agreement was signed via Docusign. We set up the merchant account as per the MPA that *** signed. We do not change rates on any applications after approval without notice to the merchant. In reference to the complaint statements about the Sales Representative, they are an Independent Sales Representative (reseller) for MBN. When a merchant enters into a contract from one of our agents that contract is binding. We cannot account for the sales representative actions and therefore cannot determine what happened between the sales agent and ***. The equipment was purchased between the merchant and the sales office directly so any refunds with regards to equipment must be resolved with them directly. With regards to the merchant's request to refund the monthly fees, *** began processing in March, May and June. Due to Covid 19 business closure, we will refund the month of April in the amount of $183.00 which will be sent by separate cover by ACH to the bank account on file. Our records indicate that we have assisted this merchant with concerns and as well attempted to call her to resolve this complaint since last week. There is merchant processing in June so we will proceed to close the account in July. Per the merchant's MPA there is a 3 year contract term along with an Early Termination Fee in which we will waive all applicable fees and close. In summary, MBN has acted, and continues to act, pursuant to the commercial agreement entered into between the parties. In reference to the complaint statements from the merchant regarding the Sales Representative, they are an Independent Sales Representative (reseller) for MBN. We cannot account for the sales representative actions and therefore cannot determine what happened between the sales agent and Mr. with regards to the loan and the purchase of their equipment and therefore the loan and equipment must be resolved with them directly. Your account was closed in April, and your contractual and termination fees were a total of $*** for the remaining months of your contract. We reduced the fees to $***. As a courtesy to the merchant, we have waived the contractual fees and ETF. In summary, MBN has acted, and continues to act, pursuant to the commercial agreement entered into between the parties. In order to obtain a merchant account from Merchants Bancard Network (MBN), Mr. indicated acceptance of the terms and conditions of the Merchant Processing Agreement (MPA) by signing our agreement and processing credit card transactions. All equipment purchased, as the merchant indicated and the attachments provided by the merchant, reflect were paid directly to Payment Lynx. Any equipment refund inquiries must be resolved with Payment Lynx directly as we did not sell the equipment to the merchant. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) I totally disagree with the response from MBN. I have been reading all the reviews on BBB and Google. Hence, their response did not make me a surprise. MBN always responses to customers by saying that they cannot account for the sales representative actions and therefore cannot determine what happened between the sales agents which making no sense. Followings are reasons why their response making NO SENSE: On one hand, according to their email sending over to me at 6:43 pm on Aug 06, 2020, MBN asked me to return the Mini Clover and the Flex Clover which I bought and paid everything for Payment *** already. They mentioned that the equipment needs to be return as the agreement. (I will attach the advertise from Payment *** showing the *** package that included free equipment) (I also attach the email from MBN sending to me by *** asking for equipment to be returned) On the other hand, MBN responded to me through BBB saying differently. According to MBN's response:"In reference to the complaint statements from the merchant regarding the Sales Representative, they are an Independent Sales Representative (reseller) for MBN. MBN even admitted that all equipment were purchased and paid directly to Payment *** Now, why MBN requested me to return the equipment? It does not make NO SENSEN. Why I have to return for what fully paid for already? With that being said, the 2 clover are belonging to me and I have the right to own/use/control it. BBB, please make further investigation to help victims like us. BBB please reread all the complaint and review so you will see how this company has been scam businesses around the country. As a big company, MBN has to hold accountable for their sale representative action because their sales representative are represent their business. If MBN say that MBN cannot account for its sales representative actions, then BBB should not have MBN on Accredited List. For your reference, I also enclose some copies of the review showing that how Payment Lynx and MBN are run by same people/organization. They work together so they have to give each other a fake good review. I also need MBN to refund me $ *** for their processing fee. I do not receive the equipment until Jun 30, 2020 and I did not even start having MBN as merchant service on July 01, 2020. Hence, I should not be charged for Jun's fee. In regards to the equipment, our records indicate that *** purchased the below from the agent which was by separate agreement between *** and Payment *** The check was written out to, paid and cleared by Payment *** and not *** CLOVER FLEX SN C042UQXXXXXXXX CLOVER CASH DRAWER *** D0UHXXXXXXXX We have a separate free equipment agreement which is signed by Tu *** for the Clover Mini indicated below through our Free Terminal Program: CLOVER MINI *** C032UQXXXXXXXX The Clover Mini is owned by MBN. We have attached the free terminal program agreement that we received swhich is signed by ***. On 8/6/20. we sent a return label for the merchant to return the Clover Mini to us for no cost to them. We are expecting the equipment back to prevent any further charges from MBN as per the attached agreement. In summary, MBN has acted, and continues to act, pursuant to the commercial agreement entered into between the parties. Followings are how Payment *** response: "This merchant account for Four Seasons Nails was opened June 22, 2020 and they received their equipment they purchased on June 30,2020 and processed credit card transactions until July 19, 2020. The merchant has decided to close their merchant account and the account was closed on August 04, 2020. Since there is processing in July, these fees will be charged. We are closing the merchant account and as a courtesy to the merchant, we have waived the contractual fees and ETF. Payment received by Payment Lynx from ***/Four Seasons Nails were for equipment and gift cards which they have received. In summary, Payment Lynx and MBN has acted, and continues to act, pursuant to the commercial agreement entered into between the parties. Payment Lynx (XXX)-XXX-XXXX ext 5 Merchant Bancard Network (XXX) XXX-XXXX" PLEASE take a look at how Payment Lynx's response, Payment Lynx stated that the check I sent them was for Equipment and Gift Card. With that being said, all equipment is owned by 4 Seasons Nails and we do not have to return it. In addition, on my previous response to MBN, I did inform that I did not receive the equipment until July 01 and I did not even start using MBN's service until July 01. Hence, I should not be charged *** for JUNE Transaction Fees. I would like MBN to return $ *** to my bank account as soon as possible. Business Response Dear ***: We have reviewed your account further. Our records indicate that you purchased equipment from the sales representative. We are not referring to those pieces. We have previously sent you the free terminal agreement that you signed with us for the Clover Mini and have attached it for your reference again. We are not asking for the equipment you purchased from the agent, but solely the Clover Mini. In addition, we emailed you a prepaid label to ship to us at no charge on 8/6/2020 which is still valid. It appears that there is a misunderstanding. Please call us to discuss further at (XXX) XXX-XXXX. I have been asking for the refund but you never response. I would like you to refund that money - *** to my account then we will settle this matter down. I shouldn't be charged for Jun since I did not receive your equipment until July 01 and I did not even start using your service until July 01.
