LoanCare / Lakeview review: Requested loan modification/forbearance & loancare put sale on home/foreclosure

Our loan is in active foreclosure, submitted a formal Loan Modification Application/forbearance on 12-15-22, no one has reached out to us via phone or email.

Called LoanCare [protected] on 12-22-22 spoke to David. He advised, “all items submitted for loan modification have been received and nothing else is needed at this time. Loan modifications takes 30 days & loan processor/underwriter will reach out”. David confirmed LoanCare received our two large payments for our “trial loan modification”: $5,976.15 on 11-15-22 and $5,976.15 on 12-15-22. David advised since we applied for a loan modification, “sale date” of foreclosure put on hold.

1-5-23, received letter dated 12-19-22 from LoanCare saying items are needed and to submit online: 1) Proof of income for Matt (this has been uploaded to LoanCare 3 times: on 12-15-22, 12-20-22 and 1-5-23) and 2) Uniform Borrower Assistance Form.1-5-22 at 8:35 pm, I uploaded these items in LoanCare site, received a message in green “ Congratulations! You have successfully uploaded your documents”.

1-5-23 received letter dated 12-19-22 fLoanCare advising we have been assigned to a “Mortgage Resolution Advocate” Amanda Gauthier (loan processor), and someone would contact us with 5 business days (from 12-19-22), but we never received a call or email.

1-5-23, received “Notice of Trustee’s Sale” dated 1-3-23 with a sale date of 2-2-23 “Notice of Foreclosure Sale”.

1-6-23 Friday, called [protected] spoke to Jasmine. She advised, “Your loan is in active foreclosure, but your loan was assigned today 1-6-23 to Underwriter. Your loan was moved to active foreclosure to suspended”. I also asked to speak with my Mortgage Resolution Advocate, Amanda Gauthier at extension 82958 she refused to transfer my call. I also asked specifically for just the underwriter name, Jasmine refused to give me the information.

In looking at this chain of events, I was told lots of misinformation from LoanCare. David said 12-22-22 our loan modification was being worked on & sale date on hold. Jasmine said 1-6-23 our loan is in active foreclosure with a sale date of 2-2-23 and loan was just assigned to an underwriter on 1-6-23. This is disheartening that I’m not being treated fairly and given correct information. We have proven by making 2 huge payments of $5,976.15 each and submitting a formal loan modification request that we want to keep our home and make our monthly payments (with a loan modification/forbearance).

1-6-23, called ZBS Law Firm, spoke to Maria. She confirmed they have not received Instructions from LoanCare / Lakeview to put a hold on the sale date.

1-9-23 spoke to Dreschetta at [protected], she advise our loan modification is under review (as of Friday 1/6/23) our foreclosure is “suspended”. I specifically asked her if LoanCare has sent the instructions to ZBS Law to let them know to hold the sale date, she said she didn’t know.

1-9-23 called ZBS Law & spoke to Katheryn and she advised the active sale date is 2/2/23 and they have NOT received Instructions from LoanCare/Lake view to hold/suspend the sale date.

Desired outcome: We need our loan file/review moved up the chain and on a rush for review/approval.
