Refundable Deposit Collected by the Defendants

The Defendants collectively represented and induced the Claimant to pay a refundable Deposit of Euro 75,000 (Euro 60,000 + Euro 15,000) promising to deliver SWIFT MT 799 and SWIFT MT 760 from Barclays Bank, London to CIBC Bank in Canada on behalf of the Claimant. The Defendants from time to time informed the Claimant that one or more of the Defendants do not understand English and therefore, many messages were translated into Italian language, and even at the teleconference, one of the Defendants had to translate each sentence from the Claimant in English to Italian language for the other Defendants to understand.
