On January 1, 2008 my wife and I came into Ideal Furniture Inc. (listed as New Century Furniture on Better Business Bureau website) looking for a bedroom set. We were offered a special "New Year's Deal" on any one of the two bedroom sets (a mahogany and a cherry colored set), but we were not sure if we were ready to commit to it. A salesperson named Yevgeniy was taking us around the showroom, and he assured us that even if we put down a deposit, we could change our minds and receive a full refund at any time for any reason if anything was not to our satisfaction. We put down a deposit of $200. I returned to the store with other family members on January 3rd 2006 to look at the furniture once again, and changed our order to the mahogany bedroom set, which consisted of a bed, 2 nightstands, a dresser, a mirror and an armoire for the price of $4, 050.
At the time of the purchase, Yevgeniy assured us that this bedroom set was manufactured in Italy, however he did not provide any proof. Upon returning home, we measured our bedroom, and the bedroom set did not fit. Later that week we saw a similarly styled bedroom set in a different furniture store that was indeed an authentic Italian piece. While it resembled the bedroom set we had put down a deposit for, it was not identical. Moreover, the salespeople requested payment upfront, prior to the delivery of furniture, which seemed unusual. The misrepresentation of the authenticity of the make of the furniture led us to doubt the quality of the furniture and the ability to deliver what was promised.
Since the bedroom was not a good fit, we returned to the store on January 6, 2006, and reminded Yevgeniy of the verbal contract that we had made. Yevgeniy, however, claimed that even though he had promised us a refund for any reason, he would lose his job if he returned us the money. He took our invoice to his boss, Oleg, who told us that he would not refund the deposit under any circumstance. When we questioned the authenticity of the bedroom set, the salespeople refused to provide any proof of the origins of the bedroom set. Ideal Furniture and its salespeople misrepresented the merchandise, falsely advertising it as being made in Italy and promised a refund under any circumstances, which you did not deliver. Please refund the $200 deposit promptly.
